Trading in goods that violate barcode regulations will be fined up to 15 million VND.

Acts of trading in goods that violate regulations on barcodes will be fined from 2 million to 15 million VND, depending on the value of the violating goods.

The Government has just issued Decree 119 regulating administrative sanctions for violations in the field of standards, measurement and product and goods quality. Accordingly, the maximum fine in the field of measurement for individuals is 100 million VND, for organizations is 200 million VND; the maximum fine in the field of standards, product and goods quality for individuals is 150 million VND, for organizations is 300 million VND, except for some cases.

In particular, the Decree specifically stipulates the fine for violations of regulations on the use of barcodes. Specifically, a fine of 2-5 million VND will be imposed for one of the following acts: Failure to pay the maintenance fee for using barcodes in accordance with regulations; failure to complete procedures to extend the validity of the certificate of right to use barcodes; failure to re-register with the competent authority when there is a change in name or transaction address on the business license or failure to notify in writing when the certificate of right to use barcodes is lost or damaged...

Fines from 6 to 10 million VND for one of the following acts: Using barcodes starting with the Vietnam National Code (893) without being granted the right to use the barcode by a competent authority; using a revoked barcode; selling or transferring a granted barcode.

A fine of 10-20 million VND shall be imposed for one of the following acts: Using foreign barcodes to print on products, goods manufactured, processed, packaged, or decanted in Vietnam without written permission from a competent foreign agency or the organization that owns the barcode; using signs that cause confusion with barcodes of competent state management agencies of Vietnam and the International Barcode Organization.

A fine of 20-50 million VND shall be imposed for one of the following acts: Providing or using data sources on barcode numbers that are not consistent with the data sources on barcode numbers of competent state management agencies of Vietnam and the International Barcode Organization; providing false information about the owner or legal user of GS1 barcode numbers; developing and providing services, solutions, and applications based on the barcode number platform of competent state management agencies of Vietnam.

Fines for trading in goods that violate regulations on barcodes range from VND500,000 to VND15 million depending on the value of the violating goods.

The Decree takes effect from December 15./.
