The draft Decree on administrative penalties in the health sector under the Law on Prevention and Control of Tobacco Harm, currently being circulated by the Ministry of Health for public comment, stipulates that the act of using, buying, or selling tobacco products when under 18 years of age will be subject to a warning or a fine ranging from VND 100,000 to VND 300,000.
The expected fines range from 500,000 VND to 2,000,000 VND for any of the following acts: selling or supplying tobacco to persons under 18 years of age; using persons under 18 years of age to sell tobacco; failing to display a sign stating that tobacco is not sold to persons under 18 years of age...
Many argue that the regulations of the Law on Prevention and Control of Tobacco Harm, as well as the regulations outlined in the aforementioned draft, are highly impractical. Previously, when applying Government Resolution No. 12/2000 dated August 14, 2000, on the national policy for preventing and controlling tobacco harm, the number of cases penalized for smoking violations was also very rare.
