Prohibition of business registration and company headquarters in apartment buildings

According to the Hanoi Department of Planning and Investment, implementing the provisions of the 2014 Housing Law (effective from July 1, 2015), one of the prohibited acts is: using an apartment for purposes other than residence.

The Hanoi Department of Planning and Investment has just announced to organizations, enterprises, and business households in Hanoi not to register their headquarters, branch offices, representative offices, or business locations in apartments in apartment buildings.

According to the provisions of Clause 7, Article 80, Decree No. 99/2015/ND-CP, dated October 20, 2015 of the Government (effective from December 10, 2015) detailing and guiding the implementation of a number of articles of the Housing Law on transitional handling of housing development and management: In case the business registration certificate issued by a competent authority states the use of an apartment as a business location before the effective date of the Housing Law, the organization, household or individual granted this business registration certificate must transfer the business activities to another location other than an apartment within 6 months from the effective date of this Decree.

Businesses are not allowed to operate in apartment buildings.

The competent authority that issues business registration documents must carry out procedures to adjust the business location stated in the business registration documents issued to organizations, households, and individuals to another location within the time limit specified in this Clause; after the time limit specified in this Clause, organizations, households, and individuals are not allowed to do business at apartment buildings.

To ensure that organizations, enterprises, and business households comply with and properly implement the above regulations, the Department of Planning and Investment requests that organizations, enterprises, and business households in Hanoi not register to locate their headquarters, branch offices, representative offices, or business locations in apartments in apartment buildings.

In case an enterprise, business household or organization has set up its head office or branch office, representative office or business location in an apartment in an apartment building, it must register to change its head office or branch office, representative office or business location to another location other than an apartment in an apartment building according to the procedures prescribed by the business registration authority at all levels according to its authority.

Violations will be inspected and handled by relevant agencies according to regulations.
