(Baonghean) - The incident of dozens of households in Quang Thanh commune (Yen Thanh) encroaching on hundreds of hectares of forestry land in Tan Ky district has been going on for more than 10 years. Although all levels of government from the province to the district and commune have taken action, the encroachment on forestry land in sub-areas 853 and 860 under the administrative area of ​​Nghia Dung commune, Tan Ky district has not been resolved yet.

Events

Sub-areas 853 and 860 in Nghia Dung commune, Tan Ky district, also known as Trai Trau area, in 1996, the Provincial People's Committee issued Decision No. 239/QD-UB on allocating forestry land to Kieu Phuong Company Limited for production, business, protection, construction and forest development. However, by 2005, in this area, a land dispute occurred between citizens of Quang Thanh commune (Yen Thanh) and the forest owner.

Although at that time, the local government and related departments and agencies directed to resolve the issue, it was not resolved. Until 2007, the situation of households in Quang Thanh commune clearing forests to plant acacia trees on forestry land within the administrative boundaries of Nghia Dung commune (Tan Ky) was rampant.

On March 23, 2009, the Provincial People's Committee issued Decision No. 889/QD-UBND to resolve the forestry land dispute in this area. At that time, the forestry land area of ​​Kieu Phuong Company Limited was encroached by Quang Thanh commune people by more than 90 hectares. Up to now, although all levels and sectors have actively propagated and mobilized Quang Thanh people to return the land to Tan Ky district, the people still do not cooperate, and the encroachment still occurs.

On July 13, 2015, the Provincial People's Committee issued Official Dispatch No. 4755/UBND-KT on handling the results of the inspection of encroachment on forestry land in Nghia Dung commune, Tan Ky district. Accordingly, the Chairman of the Provincial People's Committee assigned the Tan Ky District People's Committee to direct the handling of violations in the field of land according to its authority for households and individuals who violate the law on encroachment on forestry land; take measures to dismantle illegal housing and camp constructions on forestry land under its management; preside over and coordinate with the Yen Thanh District People's Committee to direct the People's Committees of Nghia Dung and Quang Thanh communes, relevant district-level departments, agencies and branches to promptly develop a plan to request households in Quang Thanh commune to return the land and completely handle the case.

The Provincial People's Committee also agreed with Kieu Phuong Company Limited on the agreement on the value of supporting assets in the form of trees for households and individuals who encroached on forestry land. Organize a serious review meeting for relevant organizations and individuals of Tan Ky District People's Committee and Nghia Dung Commune People's Committee over the periods in not paying attention to thoroughly and promptly handling the situation of encroachment on forestry land in the area. Assign the Chairman of Yen Thanh District People's Committee to organize propaganda, mobilize and persuade households in Quang Thanh Commune and other communes in Yen Thanh District who are encroaching on forestry land in Nghia Dung Commune (Tan Ky).

Sub-areas 853 and 860 in Nghia Dung commune, Tan Ky district have long been encroached upon by dozens of households from Quang Thanh commune (Yen Thanh) for forest planting.

Mr. Dang Tho Xuan - Vice Chairman of Tan Ky District People's Committee said: Implementing Official Dispatch No. 4755/UBND-KT of the Provincial People's Committee, in the past, Tan Ky District People's Committee has coordinated with Yen Thanh District People's Committee many times to direct Nghia Dung Commune to draw up administrative violation records for 33 cases of land encroachment. However, before conducting field work to check the current situation and draw up administrative violation records, although the authorities of the two districts invited households to come directly to the field to check, review, measure, and draw up records, most households were not present.

Currently, on the encroached forestry land of Nghia Dung commune, 15 households have built houses, sheds and barns for raising buffalo, cows, goats, etc. According to the assessment of the authorities, the value of these construction works is about 800 million VND. The District People's Committee has submitted to the Provincial People's Committee for consideration of support for the households. Regarding the crop assets of the households encroached before September 2009, based on the results of the inspection and review of the current situation, the District Steering Committee has directed the relevant agencies to calculate a support plan for 21 households with a total amount of nearly 6 billion VND.

Because this land has been assigned to Kieu Phuong Company Limited, the company must pay to get the land back. However, on August 5, 2016, at the meeting between the People's Committees of Tan Ky and Yen Thanh districts, between the two related communes and Kieu Phuong Company Limited, Kieu Phuong Company Limited did not agree with the above support plan, but proposed a plan for the company to be responsible for negotiating with households to measure crop assets in the field to buy back crop assets on the land of households at market prices and requested the People's Committees of Nghia Dung and Quang Thanh communes to send staff to participate in the measurement. The company will proactively coordinate and report the implementation results to the district People's Committee before September 10, 2016. But up to now, Kieu Phuong Company Limited has not been able to do so.

Talking to us, Mr. To Anh Phuong - Director of Kieu Phuong Company Limited said: In the face of the prolonged and complicated encroachment of Quang Thanh commune citizens on the company's forestry land, the local government has not been able to handle it, so the company is also looking for the most optimal solution, convenient for all parties to resolve it satisfactorily.

The company's current plan is that the company is willing to support households by going directly to each household to measure assets such as crops on the land to negotiate payment for households during the process of investing in land preparation, buying seedlings, care, etc. However, households have not cooperated, so the company's plan is at a standstill.

To solve this problem, local authorities at all levels and sectors continue to promote propaganda and mobilization so that people understand their responsibilities and the law; Yen Thanh district also needs to focus on directing more strongly so that its citizens comply with land laws./.
