Need to re-define the subjects who are equipped with and use weapons

(Baonghean.vn) - It is necessary to regulate the subjects who are equipped and use weapons flexibly, in accordance with the organizational structure, functions and tasks of agencies and units in each period. At the same time, it is necessary to have regulations on the recovery of weapons floating in society, limiting crimes arising from weapons. That is the content discussed at the conference to collect opinions on the draft law organized by the National Assembly Delegation of the province this morning (February 17).

In order to ensure safety, avoid loss and misuse of weapons and explosives for criminal activities, on the basis of the Ordinance on Management and Use of Weapons, Explosives and Supporting Tools issued by the 12th National Assembly Standing Committee in 2011, the 14th National Assembly Standing Committee continued to direct the research and development to incorporate these contents into the Law on Management and Use of Weapons, Explosives and Supporting Tools (VKVLNCCHT). Accordingly, the draft Law on VKVLNCCHT consists of 8 chapters and 72 articles regulating the management and use of weapons, explosives and explosive precursors, supporting tools; receiving, collecting, classifying, preserving, liquidating, destroying and state management of VKVLNCCHT.

Agreeing with the need to promulgate the Law on VKVLNCCHT as well as the structure and content of the draft Law, delegates contributed comments on the wording of the draft, ensuring strictness and accuracy. Many delegates directly contributed comments on a number of provisions of the draft Law, focusing on regulations on shooting; subjects equipped with and using weapons and support tools.

Lieutenant Colonel Tran Huong Nam (Provincial Police) proposed to add cases that require warning before shooting, which are cases of breaking into prisons, rescuing people being brought to trial; cases that can be shot without warning for drug-related crimes using weapons to resist arrest; people sentenced to death for crimes against national security who are on the run and if they do not shoot immediately, they will escape.

Also referring to this regulation, Mr. Ho Ba Vo - Provincial Lawyers Association, emphasized the regulation: In all cases of gunfire, the user needs to limit the damage caused by the gunfire.

Regarding the subjects equipped with and using weapons and support tools, according to some delegates, it is necessary to have flexible regulations, consistent with the organizational structure, functions and tasks of agencies and units in each period. Some delegates said that it is necessary to assign the Minister of Public Security and the Minister of National Defense to make appropriate regulations.

Regarding management and use, some delegates proposed regulations prohibiting individuals from owning weapons, explosives, and support tools, but not prohibiting individuals from owning primitive weapons that are displayed, exhibited, or heirlooms. At the same time, it is necessary to add regulations to recover weapons that are illegally stored and circulating in society.

Colonel Ha Tan Tien - Deputy Commander of Military Region IV, proposed to add conditions for management, construction, and preservation of VKVLNCCHT, which are regulations on building warehouses, and add responsibilities of organizations assigned to manage support tools that are currently not included in the draft Law.

Also this morning, the Provincial National Assembly Delegation also collected comments on the draft Law on Security Guards which will be submitted to the 3rd session, scheduled to open on May 20, 2017.
