(Baonghean) - Recently, 21 households in Lac Son commune (Do Luong) have sent petitions everywhere to request authorities at all levels to verify the land transfer records in Bau Kinh area to Ms. Nguyen Thi Hong and Ms. Nguyen Thi Kim Lien to implement the Thien Ly New Urban Area project. This case has been tried at first instance by the court, and for some objective reasons, the case has not been completely resolved. Currently, many households have raised aquatic products on the transferred land plot. To have more information about this issue, Nghe An Newspaper had an interview with comrade Truong Thi Tuyet - Deputy Secretary of the Party Committee - Chairman of the People's Committee of Lac Son commune.

PV:Dear comrade, how has the locality handled the issue of 21 households in Lac Son commune filing a lawsuit about the land transfer to An Thien Ly Service Construction Company, represented by Ms. Nguyen Thi Hong and Nguyen Thi Kim Lien?

Comrade Truong Thi Tuyet:The incident happened 8 years ago. At that time, I was not yet the Chairman of the Commune People's Committee, but through the system of documents that I received and through regular meetings, I learned that this was a rather complicated incident, and until now, people continue to petition through meetings with voters of the Provincial and District People's Council delegates.

Starting from An Thien Ly Construction Service Company Limited, an enterprise from Ho Chi Minh City investing in the Thien Ly New Urban Area project in Do Luong district under the socio-economic development cooperation program between Ho Chi Minh City and Nghe An province. The location that the company was approved for is at Bau Kinh land.

To have enough area, the company needs to transfer 34 plots of land from 21 households with agricultural land at this location. Due to disputes and lawsuits related to the land transfer between 21 households and individuals Nguyen Thi Hong and Nguyen Thi Kim Lien (two relatives of the investor An Thien Ly Service Construction Company), after 8 years the project has not been implemented.

The lawsuit occurred when these 21 households claimed that the land in Bau Kinh was being used for the wrong purpose if the government allowed the construction of a new urban area. In the lawsuit, the households also claimed that they had not signed the transfer of these 34 plots of land.

The case has had a total of more than a dozen documents from the province to the district directing its resolution since 2011.

PV:Regarding the incident where people said that the 34 sets of documents transferred to Ms. Hong and Ms. Lien's households were "signed forged", what is the local opinion on this incident, comrade?

Comrade Truong Thi Tuyet:Speaking of the transfer, according to archived documents, in 2006 - 2007, Ms. Nguyen Thi Hong and Ms. Nguyen Thi Kim Lien received the transfer of land use rights from 21 households and individuals in the Bau Kinh area, Lac Son commune, with a total area of ​​61,361m2.

Of the 34 plots of land of 21 households and individuals who transferred land use rights to Ms. Nguyen Thi Hong and Ms. Nguyen Thi Kim Lien, only 3 plots of land actually grew two rice crops, with a total area of ​​1,349 square meters, of which 31 plots were for aquaculture, and 3 contracts stated the purpose of use as land for annual crop cultivation.

Also according to Conclusion 111/KL - UBND.KT, of the 21 land use right transfer contracts that 21 households and individuals signed with Ms. Nguyen Thi Hong and Ms. Nguyen Thi Kim Lien, there were 15 contracts signed in 2006 and 6 contracts signed in 2007.

The signing of land use right transfer contracts is carried out in accordance with Joint Circular No. 04/2006/TTLT/BTP - BTNMT dated June 13 of the Ministry of Justice and the Ministry of Natural Resources and Environment guiding the notarization and certification by the People's Committees of communes, wards and towns of contracts and documents implementing the rights of land users. Thus, the 21 households and individuals mentioned above have agreed to sign land use right transfer contracts for Ms. Nguyen Thi Hong and Ms. Nguyen Thi Kim Lien in accordance with the 2005 Civil Code.

However, in case the above households and individuals have disputes over the Land Use Rights Transfer Contract, it is under the jurisdiction of the People's Court according to the provisions of the 2004 Civil Procedure Code, the Law on Amendments and Supplements to a Number of Articles of the 2011 Civil Procedure Code, and not under the jurisdiction of the Chairman of the People's Committee of Do Luong District and the Chairman of the People's Committee of Nghe An Province.

PV:So, in response to citizens' opinions that the Provincial People's Committee has issued Decision 2899/QD-UBND.KT to cancel Conclusions No. 30/KL-UBND.KT and 111/KL-UBND.KT, but the local government does not base its decision on the content of the above decision to resolve the matter, what are your ways of propagating so that people can rest assured and wait for a fair trial by the court?

Comrade Truong Thi Tuyet:In fact, after the Provincial People's Committee issued Conclusion 30/KL - UBND.KT on the revocation of 34 Land Use Right Certificates that had been transferred by 21 households to Ms. Lien and Ms. Hong, we were also directed by the district to resolve the issues after the conclusion, and did a good job of reassuring the people.

However, not long after, we received Conclusion 111/KL - UBND.KT canceling the content of Conclusion 30/KL - UBND.KL, requesting the locality to re-verify the land origin of these 34 Land Use Right Certificates, and we were also directed by the district to coordinate well in fulfilling the requirements of Conclusion 111/KL - UBND.KT. However, immediately after this conclusion was issued, the citizens who had transferred to Ms. Hong and Ms. Lien filed a lawsuit.

And most recently, we received Decision No. 2899/QD-UBND.KT canceling both of the above conclusions. Regarding this incident, we are also waiting for instructions from our superiors to find a solution. Regarding the content of the transfer signing that the households are suing in court, the households will soon receive the court's judgment.

We continue to propagate the policies of the Party and the State on land use and exploitation in the area. Especially for Bau Kinh area, we are actively propagating so that people maintain the status quo of the land, waiting for the court's judgment.

“Initially, Mr. Nguyen Canh Ha - Director of An Thien Ly Company wanted to invest in an aquaculture project. But later, when the enterprise wanted to change the purpose of using Bau Kinh land to build a new urban area. In addition to the necessary administrative procedures, the Commune People's Committee consulted with the people. Regarding the transfer of land by 21 households to Ms. Hong and Ms. Lien, the authorities witnessed the transfer of 14 households at a price of 500,000 VND/sao and had signatures from both parties. The remaining 7 households went to Ms. Hong and Ms. Lien's houses to transfer directly without the presence of the local authorities, and we did not know the transfer price..
