Need to promptly resolve the problems and issues of the Samurai Nghi Thach project

Assigned by the Standing Party Committee, on July 18, 2025, the People's Committee of Dong Loc commune sent a document reporting on the Samurai project to the Provincial People's Committee, and at the same time, responded to the information reflected by Nghe An Newspaper and Radio and Television in the article: "Silence at the Samurai Nghi Thach project".

Report and recommendations from Dong Loc Commune People's Committee

Document No. 72/UBND-KT dated July 18, 2025 of Dong Loc Commune People's Committee sent to Nghe An Provincial People's Committee; Nghe An Newspaper, Radio and Television with the content as follows:

“On July 6, 2025, Nghe An Newspaper, Radio and Television had an article “Silence at Samurai Nghi Thach project"reflects many shortcomings of the project as well as the project implementation location becoming an environmental black spot. After inspection, the People's Committee of Dong Loc commune found that the reflection reported by Nghe An Newspaper and Radio and Television was correct.

On December 12, 2014, the Provincial People's Committee issued a Decision to lease the above land to Samurai Company Limited to build a factory for manufacturing and assembling refrigeration and household appliances. On April 23, 2015, the Department of Natural Resources and Environment issued a Certificate of Land Use Rights with an area of ​​15,252 m2 to Samurai Company Limited for use for production and business purposes in the form of annual land lease payment.

By 2016, the Provincial People's Committee had approved the change of land use purpose for the above Project to implement the project of dividing residential land plots in Document No. 3755/UBND-NN dated June 1, 2016. The Provincial People's Committee issued Decision No. 3422/QD-UBND dated July 14, 2016 on approving the detailed construction plan at a scale of 1/500 to divide residential land plots in Nghi Thach commune. However, from 2016 to present, Samurai Company Limited has not completed the procedures to be allocated land to implement the project according to regulations.

Therefore, the People's Committee of Dong Loc commune respectfully requests the People's Committee of Nghe An province to assign relevant departments, branches and sectors to work with the investor to urge the project implementation. In case the investor fails to implement the approved project schedule, it will be studied, considered and handled according to the provisions of law.

Requesting Vice Chairman of Dong Loc Commune People's Committee Phung Ngoc Tu to provide more information about the problems that led to "Samurai Company Limited not completing the procedures to be allocated land". According to Mr. Phung Ngoc Tu, due to the slow implementation of the project, voters had feedback, so Nghi Loc District (old) has repeatedly sent written reports to the Provincial People's Committee and related departments and branches. Recently, an inspection team of the province has conducted inspections of backlogged projects, including reviewing the project of Samurai Company Limited, however, Nghi Loc District (old) has not yet accessed the conclusions of the team.

Vice Chairman of Dong Loc Commune People's Committee Phung Ngoc Tu said: "If there are any problems from the investor, only the investor will know, but if there are problems from administrative procedures, they are mainly related to provincial agencies. Administrative procedures under the authority of the district level (old), when there are instructions from provincial agencies, they have been implemented by Nghi Loc district (old). Therefore, we do not know specifically what problems the project is facing, we can only report and recommend to competent authorities to consider and handle according to regulations..."

According to Mr. Phung Ngoc Tu, along with the report and recommendations to the Provincial People's Committee, in the near future, the People's Committee of Dong Loc commune will take measures to ensure that the land where Samurai Company Limited is implementing the project does not have any problems that cause consequences for the people.

Specifically, Mr. Phung Ngoc Tu said: “The People’s Committee of Dong Loc Commune will issue a document requesting Samurai Company Limited to take responsibility for managing the land where the project is being implemented while waiting for competent authorities to handle the problems. In particular, it is required to ensure environmental sanitation and not allow illegal construction to occur…”.

In recent days, we have had access to many more documents related to the project of Samurai Company Limited. Of note is Document No. 3533/SKHĐT-DN dated October 2, 2020 of the Department of Planning and Investment (old) on "Reviewing the process and procedures for implementing the Project of dividing residential land plots in Nghi Thach commune, Nghi Loc district (old)".

Regarding the legal procedures of the project, according to statistics of the Department of Planning and Investment (old), Samurai Company Limited was granted by the Department of Natural Resources and Environment (old) a Certificate of Land Use Rights, House Ownership Rights and Other Assets Attached to Land No. BY 969837 dated April 23, 2015 with an area of ​​15,252.0 m2 in Nghi Thach commune for the purpose of use as non-agricultural production land (factory for manufacturing and assembling refrigeration and household appliances), land use term until September 26, 2064.

On June 1, 2016, the Provincial People's Committee issued Document No. 3755/UBND-NN agreeing in principle to allow Samurai Company Limited to convert the land use purpose of the land to residential land. On July 14, 2016, the Provincial People's Committee issued Decision No. 3422/QD-UBND approving the detailed construction plan 1/500 to divide residential land in Nghi Thach commune, Nghi Loc district, invested by Samurai Company Limited. On June 7, 2017, the Provincial People's Committee issued Decision No. 2425/QD.UBND approving the investment policy of the residential land division project for Samurai Company Limited. On June 13, 2017, the Department of Planning and Investment (old) issued Investment Registration Certificate No. 3304424882 to Samurai Company Limited to implement the residential land division project in Nghi Thach commune, Nghi Loc district.

Regarding the results of reviewing the process and procedures, in Document No. 3533/SKHĐT-DN dated October 2, 2020, the Department of Planning and Investment (old) reported to the Provincial People's Committee specifically the opinions of the Department of Natural Resources and Environment (old), the Department of Construction; at the same time, the system of legal regulations related to the project. Thereby determining:“The request of Samurai Company Limited to change the land use purpose from non-agricultural production land to residential land to implement the Project of dividing residential land in Nghi Thach commune, Nghi Loc district and has been approved by the Provincial People's Committee in Decision No. 2425/QD.UBND dated June 7, 2017 is in accordance with the provisions of the Investment Law 2014 and the Land Law 2013”.

However, studying the provisions of the 2014 Housing Law, the Department of Planning and Investment (old) was concerned about appointing investors without auction or bidding, with the following comments:“Samurai Company Limited is not qualified to be appointed as the investor of the Residential Land Subdivision Project in Nghi Thach Commune, Nghi Loc District (old) (The Company has legal land use rights but it is not yet legal residential land)”.

Thereby recommending the Provincial People's Committee:“Regarding the compliance with the provisions of the Housing Law 2014, there is currently no consensus on the form of selecting investors. Therefore, the Department of Planning and Investment (old) respectfully requests the Provincial People's Committee to assign the Department of Construction (State housing management agency) to consult the specific opinions of the Ministry of Construction to report to the Provincial People's Committee”.

In April 2021, Samurai Company Limited submitted Document No. 03/TTr to the Provincial People's Committee explaining the contents of the Department of Planning and Investment (old) stated in Document No. 3533/SKHDT-DN, requesting permission to continue implementing the project. Samurai Company Limited's proposal was responded to by the Provincial People's Committee in Document No. 2860/UBND-NN dated May 11, 2021 with the content of assigning the Department of Planning and Investment (old) to preside over and coordinate with the Department of Natural Resources and Environment (old), Department of Construction (old); relevant agencies to review and advise on handling in accordance with the provisions of law...

With the above information, we have somewhat understood the problems in the project of Samurai Company Limited. It is worth mentioning that because the problems have not been completely resolved, the project has been prolonged for many years, leading to land waste, causing consequences for the locality, and voters are worried and petitioning.

Therefore, it is recommended that competent authorities pay attention to thoroughly handling the issue in accordance with the direction of the Prime Minister at the National Conference to review the removal of difficulties and obstacles for projects and land according to Conclusion No. 77-KL/TW of the Politburo and Resolution No. 170/2024/QH15 of the National Assembly (dated July 17, 2025). That is: If the project has violations, it must be strictly handled; if there are signs of violations, it must be carefully considered before making a decision; and if there are problems with legal procedures, it must be promptly resolved!
