People's petition
From the general shabby landscape, difficulty in traveling, flooding when it rains..., the people of Group 7, Block 2, Quan Bau Ward sent a petition to Nghe An Newspaper. The petition was presented by the head of the residential group - Mr. Cao Van Cuong: "According to the planning, Tan Da Street has a boundary of 12 m. People have also paid land tax for the use of the 12 m road for many years. Recently, some households, when building houses, have encroached on the boundary of the road by 3 - 3.5 m; raised the foundation, narrowing the road, with some sections remaining only 5 m, creating a basin, making it difficult to travel; when it rains, the water is deep, causing flooding. Recently, while the illegal encroachment of families and individuals has not been resolved, in the same area, the Mountainous Trading Joint Stock Company continues to build on the planned land of Tan Da Street.
Tan Da Street is adjacent to Phan Boi Chau Street, behind is Nguyen Canh Hoan Street, there is Nguyen Trai Primary School, densely populated (2 new apartment buildings have been built nearby), and a lot of traffic. Therefore, we write this petition, requesting the competent authorities to inspect, consider and take measures to end the illegal construction; clear the illegally built land according to the planning to renovate the urban area, creating convenience in traffic...
Tan Da Street was planned a long time ago, but the current road width is only about 7m. Houses on both sides of the road are closed; or have been built solidly; or have roofs, built walls, gates, and created a slide down to the road for use. For the Mountainous Trade Joint Stock Company, a new fence and a house for business have been completed.

According to some residents of Group 7, in order to own the right to use the land, they had to spend money to buy it according to the planned price of a 12m road. Over the years, they also had to pay land tax for the 12m road, while not being able to use it. There are also some households that have just bought land to build houses, but illegally encroached on it and built, but the authorities ignored it. Inspections are only carried out when people make a request, but it is not resolved. The same is true for the Mountainous Trading Joint Stock Company that organized the construction. Only when people make a request, will it be handled. But the handling is to temporarily suspend the construction, then this unit "runs" for a construction permit...
Head of residential group No. 7, Mr. Cao Van Cuong, said that recently, Vinh City People's Committee has issued a document responding to the people's petition. In it, it stated that the Mountainous Trading Joint Stock Company has a certificate of land use rights, so the Department of Construction has granted a temporary construction permit with a term. Regarding some households violating construction regulations, the city said that it has issued many directives but the local government has been slow to handle the matter. Recently, the ward held a meeting with the people, then pushed the issue back, asking the block executive committee and residential group to encourage the violators to dismantle themselves... "When people violate, they are not handled. Now pushing the issue back to the people is not showing responsibility for the work..." - Mr. Cuong said.
Quan Bau Ward admits fault
On December 20, 2016, Vinh City People's Committee issued Document No. 2308 regarding the settlement of the petition of citizens of Group 7, Block 2, Quan Bau Ward. The document stated that the construction of the Mountainous Trading Joint Stock Company was granted a temporary license No. 148 GP/SXD by the Department of Construction on November 29, 2016 and the permitted duration is until November 30, 2018; the constructions of this company were built on the land plot for which the Department of Natural Resources and Environment granted a land use right certificate No. AH 469769 on December 26, 2006.
Regarding the content of some households building houses and encroaching on the boundary of Tan Da street, from 2015 to now, Vinh City People's Committee has issued 3 official dispatches directing Quan Bau Ward People's Committee to inspect, take measures to clear the encroaching constructions, and promptly handle violations of urban order. However, up to now, Quan Bau Ward People's Committee has not yet resolved the issue, allowing citizens to continue to submit petitions.

Also in Official Dispatch No. 2308, Vinh City People's Committee directed Quan Bau Ward People's Committee to: Check the current construction status and land use of households at houses No. 13, 15a, 15b, 15c and other households on both sides of Tan Da Street (section with 12m boundary); identify violations of construction order and take measures to handle them according to regulations. Organize dialogues and collect opinions from people in Block 2 on the implementation of Tan Da Street planning, as well as handling violations of construction order...
Mr. Ho Sy Dung - Chairman of Quan Bau Ward People's Committee acknowledged that the reflections of the people of Group 7 were basically correct. The ward was not determined when allowing some households to expand, build fences, gates, and slides on the planned road boundary. "When the households carried out the construction, the Code Team went to the scene, made a record and suspended the construction. However, the households later wrote a petition to the ward government asking for permission to temporarily use the construction works that violated the boundary, and at the same time committed that when the State reclaimed the land, they would dismantle it themselves and not ask for compensation... Considering that the construction of these households was in the drainage ditch, and was the same as the households on the road, and they had made a commitment, so Quan Bau Ward did not handle the violation...".
Regarding the case of the Mountainous Trading Joint Stock Company, Mr. Dung informed that the company previously had a fence and some kiosks along Tan Da Street; after many years of use, they had deteriorated, so they carried out new renovations. Through information reflected by the people, the ward and the city's Urban Order Team inspected and discovered that the company was constructing without a license, so they made a record of the scene and suspended the construction. The company complied and stopped for a while, only starting construction when the Department of Construction granted a temporary construction permit...
Raising the question, with the direction of Vinh City People's Committee in Official Dispatch No. 2308, how will Quan Bau Ward People's Committee implement? According to Mr. Dung, on December 23, 2016, the ward held a meeting with residential group No. 7 to listen to the people's opinions. In the immediate future, the ward will assign households to dismantle the slide, and at the same time conduct a survey of all households that have built on the road boundary. After that, it will assign the block and residential groups to mobilize households to dismantle. Mr. Dung further discussed: "It is true that the ward is at fault in the incident of allowing some households to build in violation of the road boundary. However, to handle the matter, we hope that these households will voluntarily dismantle; only enforce it when they do not comply...".
So the incident that happened on Tan Da Street, Quan Bau Ward is clear. The contents of the people's petition are well-founded. And because the situation of expansion and encroachment on the road boundary is prolonged, the people of Group 7 are completely right to criticize the ward government. Therefore, the Quan Bau Ward government needs to seriously learn from experience and rectify its management work./.
