Need to strictly handle the situation of building houses on agricultural and forestry land
(Baonghean) - Currently, the construction of temporary houses and structures on agricultural and forestry land in Yen Thanh district is violating planning, causing disorder in land management and construction. Nghe An Newspaper had a dialogue with comrade Nguyen Van De - Member of the Provincial Party Committee, Secretary of Yen Thanh District Party Committee on related issues.
Reporter:The construction of houses and temporary structures on agricultural and forestry land in Yen Thanh recently has created frustration among the people. Could you please share the current situation?

Comrade Nguyen Van De:The construction of temporary houses and structures on agricultural and forestry land in Yen Thanh district mainly takes place on forestry land and land rented for farms and ranches. According to the results of the review by July 30, 2016 of the communes, there are currently 484 cases of house construction on forestry land in the district. Of which, there are 301 cases of permanent house construction, mainly concentrated in households participating in the construction of new economic zones in Tan Thanh, Tien Thanh, Lang Thanh communes, on Highway 22 and households built before 2005.
There are 366 cases of building houses on land rented for farms and ranches; of which 172 cases are building permanent houses. The cases of building permanent houses on farm and ranch land are mainly rented by the People's Committees of communes. This problem has occurred and lasted for a long time. Of course, the district has directed to handle it many times, but the results are still not high and the handling is not thorough.
Reporter:So why has the illegal construction on agricultural and forestry land been going on for so long and Yen Thanh district has not been able to completely resolve it?

Comrade Nguyen Van De:It is true that this situation has been going on for a long time and has been reported many times through many channels. The District Party Committee has directed many times, the District People's Council has included it in the resolution, the District People's Committee has developed a handling plan, established a working group to inspect, review and issued many official dispatches urging communes to implement. However, the progress of handling illegal housing construction on forestry land, farms and family farms is still slow compared to the policy and plan.
There are many reasons, such as: illegal housing construction on forestry land, farms, and ranches has existed for a long time, so it is difficult to prepare and handle the case; many households take advantage of loopholes in government management to upgrade temporary houses (made to protect property) into permanent houses, take advantage of forest land located far from residential areas or close to their residential land to build separate houses for their children...
However, the fundamental reason is that the Party committees and authorities, especially the grassroots level, have not really taken action for a long time; the state management of forestry land, farm land, and family farms is still loose; the inspection and examination of land use issues are not regular; the handling of violations is not resolute... The above reasons lead to the results of implementing the handling plan according to Decision 2450 dated May 27, 2014 of the District People's Committee not meeting the requirements, mainly stopping at the level of developing plans and reviewing and making records to handle the current situation.

Comrade Nguyen Van De:Yen Thanh district determined that handling the issue of house construction on agricultural and forestry land to maintain strict discipline and the law is an important task, requiring the drastic participation of the entire political system from the district to the grassroots. The district Party Committee assigned the district People's Committee to review, evaluate, and supplement the handling plan, to resolutely complete it as soon as possible and thoroughly.
Grassroots Party Committees, especially Party Committee Secretaries, must truly demonstrate their leadership role in leading and directing the government and commune-level departments and branches to develop plans, clearly defining the purpose, content, time, resources, and responsible person. Strengthen propaganda and mobilization work for people to implement, focusing on promoting the pioneering and exemplary role of cadres and Party members in organizing implementation.

Article 108 of the 2013 Land Law specifically stipulates the responsibilities of the Chairmen of People's Committees at all levels in detecting, preventing and handling violations of the law on land management and use. In particular, the Chairmen of People's Committees at the commune level are responsible for detecting, preventing and promptly handling illegal transfers of land use rights and illegal changes of land use purposes; detecting and applying measures to prevent and promptly handle the construction of works on encroached land, occupied land, land used for the wrong purpose in the locality and forcing violators to restore the land to its condition before the violation. The province's guiding viewpoint is to strictly handle violations of land law in two directions: First, handle administrative violations according to authority and enforce demolition; second, if violations are in accordance with planning, apply for conversion of land use purpose, fulfill financial obligations to the State according to market land price at the time of conversion to grant authority to allocate land with a limit. |
Mr. Nguyen Tri Hoa - Party Secretary, Chairman of People's Council of Son Thanh commune (Yen Thanh):Cannot convert production land into residential land In Son Thanh commune, there are 8 households receiving land for farms and ranches; of which 2 households receive forestry land and 4 households receive agricultural land in remote and poor areas. Through inspection, there are currently 4 households violating the construction of houses on agricultural and forestry land. The viewpoint and attitude of the Party Committee and the Son Thanh authorities are resolute and firm in handling violators, and cannot allow households to take advantage of turning the communal land into private residential land. Regarding the handling method, the Commune Party Committee is assigning the Commune People's Committee to evaluate the farm's performance, including compliance with the regulations on farm construction and development issued by the Son Thanh Commune People's Council, which clearly stipulate that each farm is only allowed to build camps and build wells of no more than 40 square meters. This is the original document that households signed before building the farm, so the commune will handle and resolutely dismantle violations, and at the same time require the return of the land and conversion to another economic model. |
