I see that during Tet, at some temples or pagodas, there are many children and old people standing begging. So, will the person who organizes or forces them to do this be punished?

Currently, the Penal Code does not have any specific provisions on criminal liability for those who lead or force others to beg. However, Decree 144/2013 stipulates the main form of punishment for those who force or force the elderly and children to beg.

Specifically, anyone who forces the elderly to work or do things against the law will be fined from 5 million to 10 million VND according to Clause 2, Article 20 of Decree 144.

Also in Clause 3, Article 27 of the above Decree, anyone who abuses or takes advantage of children for profit purposes: organizing or forcing them to beg will be fined from 10 million to 15 million VND.

In addition, if it is proven that the herders beat and forced the elderly and children to fast, they can be prosecuted under Article 110 of the Penal Code for the crime of torturing others.

Depending on the nature and severity, violators may be subject to a warning, non-custodial reform for up to one year, or imprisonment from 3 months to 3 years.

Currently, the situation of leading the elderly and children to beg, sell goods on the street, sell lottery tickets... is becoming more and more common, so in my opinion, there should soon be a separate law in the Criminal Code with the crime of: Taking advantage of the elderly and children for personal gain. Because then there will be a basis to handle and prevent those who lead and force the elderly and children to beg, sell lottery tickets...
