Adjacent to that is the house and land at 185 Hai Ba Trung, a state property assigned to the Light Music Center (under the Department of Culture, Sports and Tourism of Ho Chi Minh City) to manage and serve as headquarters and organize art performances.

Through an acquaintance, Ms. Duong Thi Bach Diep learned that the Light Music Center was looking for units to cooperate with and renovate its headquarters. With the desire to merge the land at 179bis, 181 - 185 Hai Ba Trung to create a 5-star hotel complex, Ms. Diep discussed and proposed to Mr. Vy Nhat Tao to use the land at 57 Cao Thang (District 3, Ho Chi Minh City) in exchange for the premises at 185 Hai Ba Trung.

Seeing that this proposal was beneficial to the Light Music Center, Mr. Vy Nhat Tao agreed. However, Ms. Nguyen Thi Hong - Vice Chairwoman of the Ho Chi Minh City People's Committee did not approve the exchange of the two assets.

Still not stopping, Ms. Duong Thi Bach Diep and Mr. Vy Nhat Tao still agreed that Diep Bach Duong Company would support 20 billion VND to repair house number 57 Cao Thang, according to the function of the Light Music Center.

After the repairs were completed, Mr. Tao invited Mr. Nguyen Thanh Rum (Director of the Department of Culture, Sports and Tourism of Ho Chi Minh City at that time) to visit the property at 57 Cao Thang. During the exchange, Ms. Diep mortgaged the house and land at 57 Cao Thang to borrow capital from Agribank, Ho Chi Minh City branch. Not only that, when she was granted the house and land certificate at 185 Hai Ba Trung, Ms. Diep continued to mortgage it to borrow 160 billion VND from Phuong Nam Commercial Joint Stock Bank, and to this day has been unable to repay the debt.

Regarding the violations of Mr. Nguyen Thanh Tai, the indictment determined that Mr. Tai was not in charge of handling and rearranging State assets, was not a member of the Steering Committee 09 of Ho Chi Minh City, but signed a document sent to relevant units with the content of approving the swap of assets at 185 Hai Ba Trung and assets at 57 Cao Thang; did not closely monitor the direction of inspection and verification of the legal conditions of the real estate at 57 Cao Thang, did not detect that this real estate was mortgaged, and was deceived by Ms. Diep, leading to the loss of State assets.

Mr. Tai's subordinates, the directors and deputy directors of the city's departments and branches, due to trust, failed to check and verify the legal conditions of the land and house at 57 Cao Thang, creating conditions for Ms. Duong Thi Bach Diep to commit the act.Cheat.
