The Government issued a decree to control the assets and income of people holding positions.

(Baonghean.vn) - On October 30, 2020, the Prime Minister issued Decree No. 130/2020/ND-CP on controlling assets and income of people holding positions and powers in agencies, organizations and units.

Accordingly, the Decree has 8 chapters and 25 articles regulating the control of assets and income of people holding positions in state agencies, organizations and units. The Decree details a number of articles of the Law on Anti-Corruption on the control of assets and income of people holding positions and powers in agencies, organizations and units.

Decree No.130/2020/ND-CPIt is stated that those who are obliged to declare as prescribed in Point b, Clause 3, Article 36 of the Law on Anti-Corruption include:

- The following civil servant ranks and titles: Enforcement officer; investigator; accountant; forest ranger; prosecutor; bank controller; market controller; auditor; Party inspector; customs inspector; tax inspector; inspector; judge.

- People holding leadership and management positions from Deputy Head of Department and equivalent or higher working in a number of fields identified in the list in Appendix III issued with this Decree.

- Representative of state capital in the enterprise.

Decree 130/2020/ND-CP also stipulates thepublic declarationof persons expected to be appointed to leadership and management positions at agencies, organizations and units; public declarations of persons expected to be appointed or elected to leadership and management positions at state-owned enterprises. In addition, the Decree also provides details on the development and approval of annual asset and income verification plans.

According to the Decree, people who are obliged to declare assets and income but do not declare truthfully or explain the origin of assets and additional income dishonestly will be handled according to the provisions of the Decree, depending on the nature and extent.Article 51 of the Law on Anti-Corruption.

A person who is obliged to declare assets and income but disperses or conceals assets and income, obstructs the control of assets and income, or fails to submit a declaration after being urged in writing twice shall, depending on the nature and severity of the violation, be subject to one of the following penalties: warning, salary reduction, demotion, dismissal, dismissal, forced resignation, military rank reduction, or rank reduction.

The Decree also stipulates that heads of agencies, organizations and units who are irresponsible in organizing the declaration, publicizing the declaration, and submitting the declaration will, depending on the nature and extent, be subject to disciplinary action in one of the following forms: reprimand, warning, demotion...

Decree No. 130/2020 takes effect from December 20, 2020 and will replace Decree No. 78/2013/ND-CP dated July 17, 2013 of the Government on transparency of assets and income.
