The Government submitted to the National Assembly a draft law on professional soldiers.
On the afternoon of October 21, continuing the 10th Session, National Assembly deputies worked in the Hall, listening to the Report on the draft Law on professional soldiers and defense workers and civil servants.
The Government's submission on the draft Law on Professional Soldiers and Defense Workers and Civil Servants stated: The Law on Military Service and legal documents related to professional soldiers and defense workers and civil servants issued in recent times have created an important legal basis for building a team of professional soldiers and defense workers and civil servants, contributing to building a revolutionary, disciplined, elite, and gradually modern People's Army; acting as the core in performing the task of protecting the socialist Vietnamese Fatherland.

However, in response to the country's development requirements in all aspects and the task of building the People's Army in the new situation, current legal regulations related to professional soldiers and defense workers and civil servants are no longer suitable and need to be studied, revised and supplemented.
Specifically: The 2013 Constitution of the Socialist Republic of Vietnam has many new provisions related to the rights and obligations of citizens, including the rights and obligations of professional soldiers and defense workers and civil servants that need to be specified.
In addition, professional soldiers are subjects of voluntary service, not subject to the Law on Military Service. Workers and defense officials are part of the People's Army's organizational structure, but there are no legal documents regulating and regulating them, and they must apply according to relevant legal documents of the State. Therefore, there must be separate legal documents regulating these subjects.
Current legal documents have not fully regulated the position and functions of professional soldiers and defense workers and civil servants in the Army's organizational structure, so in the recent past, management and use have not been very effective, wasting human resources.
The regulation that professional soldiers retire at the age of 50 or younger when they are young, healthy, and have technical and professional expertise has affected the quality of army building.
The fact that professional soldiers only serve until the age of 50 as currently regulated will not be eligible for the 75% pension rate as stipulated in the 2014 Law on Social Insurance, which will affect the aspirations of professional soldiers.
The regime and policies for defense workers and defense officials have not yet ensured fairness. Although they are in the same unit, same job position, same working conditions and environment as professional soldiers, the regimes and policies are different, such as seniority allowances, health insurance for themselves and their relatives, and other regimes and policies.
Therefore, it is necessary to innovate the regimes and policies for professional soldiers, defense workers, and defense officials serving in the People's Army to attract high-quality human resources.
From the above reality, it is necessary to develop a draft Law on professional soldiers and defense workers and civil servants. The draft Law consists of 7 chapters and 50 articles.
Examining the draft Law, the National Defense and Security Committee agreed on the necessity of promulgating the Law on Professional Soldiers and Defense Workers and Civil Servants to comply with the Constitution and the authority of the National Assembly to regulate the system of ranks and levels of professional soldiers; promptly supplement regulations on the rights and obligations of professional soldiers and defense workers and civil servants; ensure consistency and synchronization with the provisions of other laws, overcome difficulties and problems in practice, and contribute to building the Vietnam People's Army "Revolutionary, disciplined, elite, and gradually modern," meeting the requirements of the new situation./.|
