Waiting for new land policies from the 5th Central Conference

From the new policies of the Party, the National Assembly, and the Government institutionalized by law, contributing to the effective management and use of land and limiting the situation of "getting rich thanks to land, going to jail because of land" as General Secretary Nguyen Phu Trong said.

One of the important contents discussed at the ongoing 5th Central Conference of the 13th tenure is the summary of 10 years of implementing the Resolution of the 6th Central Conference of the 11th tenure on continuing to innovate land policies and laws during the period of comprehensively promoting the renovation process.

Land is a very large, fundamental, extremely complex, sensitive, and especially important field for the stability and sustainable development of the country. During the period of Renovation up to now, the Party and the State have continuously improved institutions, mechanisms, and policies on land.

Many laws related to land have been enacted such as: Housing Law, Construction Law, Mineral Law, Real Estate Business Law, etc. However, there are still many different opinions about the perception of public ownership of land; functions and tasks of state management of land. Land policies and guidelines, especially on planning and land use plans; on land finance, land price determination and real estate market development, etc.

This Central Conference continues to review, discuss and approve clear issues, issues that have been proven in practice and need to be promptly adjusted and supplemented.

Specifically, in the past 10 years, what has been institutionalized in the implementation of Resolution of the 6th Central Conference, what problems have there been, clarifying the successes as well as the shortcomings and limitations of this work.

In addition, for new issues, many viewpoints in society are not unified and need to be seriously considered and continued to be studied. It can be seen that the issue of innovation in land policies and laws in our country is still a process of "doing and testing" on the path to socialism that our Party has outlined.

All policies, mechanisms and strategies on land must closely follow the orientation and guidance in the Political Platform, Constitution and Resolution Documents of the 13th National Party Congress.

At the conference, General Secretary Nguyen Phu Trong said, “Many people got rich thanks to land, but there are also many people who became poor because of land, even went to jail because of land, lost the relationship between father and son, brothers, and comrades because of land... It is no coincidence that in the past, more than 70% of the complaints and denunciations were related to land.”

Thus, it can be seen that besides the positive aspects of current mechanisms, policies and laws on land, there are still many limitations and loopholes in the management and enforcement of legal regulations.

Many officials and officials have fallen from their horses and organizations and interest groups have been caught up in the law because of land violations. Socially, many people have had conflicts and disputes over land, causing the relationship between fathers and children, brothers and sisters, relatives to crack, and even go to jail. In addition, some social hot spots, collective lawsuits, and denunciations account for nearly 80% of land-related cases that the State must handle and resolve.

Recognizing the importance of this issue, the Politburo and the Secretariat early established the Steering Committee for the Summary of Resolution No. 19 of the 11th Central Executive Committee on continuing to innovate land policies and laws during the period of comprehensively promoting the renovation process. The Committee's work is led by two Politburo members (Prime Minister Pham Minh Chinh and Head of the Central Economic Commission Tran Tuan Anh). After its establishment, the Committee held many seminars and conferences with the National Assembly Party Delegation, the Government, the Central Theoretical Council and 63 local Party Committees, experts, scientists, etc.

As of April 12, 2022, the Steering Committee has drafted the Summary Report on the Implementation of Resolution 19 of the 11th Central Committee on land issues 15 times... In particular, during that process, the Politburo has twice commented on this draft report. Such analysis shows that this is a major issue that has been carried out meticulously, seriously, and carefully by the Committee under the direction of the Politburo.

At this conference, the Central Committee will issue new policies on land. Land issues will continue to be innovated and improved to be appropriate, close to reality and meet the development requirements in the new period as the General Secretary suggested in his opening speech at the conference.

The Central Committee's decision will be an important political orientation, timely guidance and a basic premise for amending the 2013 Land Law (which has been postponed four times) by the end of this year.

The consideration, discussion and adoption of Resolutions at Central Conferences is very important. Especially for Resolutions on land, its importance is even more evident. Doing this well reflects the Party's leadership capacity as well as the Party's ability to closely follow the reality of economic and social life.

The Party's new policies on land will be institutionalized by the National Assembly and the Government through law, contributing to the effective management and use of land and limiting the situation where "many people get rich thanks to land, but there are also many people who become poor because of land, even go to jail because of land" as the General Secretary said.
