Overloading in seaport areas, fined up to 16 million VND
From February 1, 2018, drivers of overloaded vehicles in seaport areas will also be fined and have their driving licenses revoked.
According to Decree No. 142 of the Government regulating administrative sanctions for violations in the maritime sector, effective from February 1, 2018, violations of regulations on the load capacity of road vehicles in seaport waters are subject to fines and, depending on the severity of the violation, may result in the revocation of the driving license.
Specifically, according to Article 14 of the Decree, in case the total weight (total mass) of the vehicle exceeds the allowable load of the bridge or road by 10-20%, the fine will be 2-3 million VND; carrying goods exceeding the size limit of the bridge or road or exceeding 20-50% of the total load will be fined 3-5 million VND; exceeding 50-100% will be fined 5-7 million VND; exceeding from 100 to 150% will be fined 7-8 million VND; exceeding 150% will be fined 14-16 million VND.

Failure to comply with vehicle load and size limit inspection when there is a signal or command requesting vehicle load and size limit inspection; transferring or using other tricks to avoid detection of overloaded or oversized vehicles... will also be subject to a fine of 14 - 16 million VND.
Violations with fines of VND3 million or more will also have their driving licenses for cars, tractors and similar vehicles, and specialized vehicle driving certificates revoked for 1-5 months; and will be forced to reduce the load of overloaded or oversized vehicles.
Regarding authority, the person with authority to sanction administrative violations and civil servants and public employees under the management of the person with authority to sanction administrative violations specified in Articles 60, 61, 62, 63, 64, 65 and 66 of the above Decree who are performing official duties and tasks within their scope of responsibility and discover administrative violations in the maritime field must promptly prevent and make a record of the administrative violation according to regulations.
Some authorized positions include: Chief Representative of the Maritime Port Authority, Director of the Maritime Port Authority, Head of the specialized inspection team of the Maritime Port Authority, Director of the Vietnam Maritime Administration, Chief Inspector of the Vietnam Maritime Administration, Head of the specialized inspection team of the Vietnam Maritime Administration, Head of the specialized inspection team of the Ministry of Transport, Chief Inspector of the Ministry of Transport.
