Tenants of public housing who sublet, lend or authorize the management of public housing will be fined from 50 to 60 million VND and have their public housing revoked.

This is one of the contents proposed by the Ministry of Construction in the draft Decree regulating administrative sanctions for violations in construction investment activities; exploitation, processing, and trading of minerals for construction materials, production, and trading of construction materials; management of technical infrastructure works; real estate business, housing development, and management of the use of houses and offices.

The act of arbitrarily renovating, repairing or demolishing public housing will also be fined the same amount. In addition, the violator is forced to restore the original condition or to dismantle the illegal construction or part of the construction.The draft clearly states that a fine of 50-60 million VND will also be applied to the following acts: Not using the house for residential purposes and serving the living needs of oneself and family members during the rental period; not returning the official housing to the State when no longer eligible to rent the house according to regulations. These acts will also result in the revocation of the official housing.

Re-renting social housing that has been reclaimed

Also according to the draft, the lessee or hire-purchaser of social housing who sells, sub-leases, lends the house during the rental period, hire-purchases or resells the house in violation of regulations will be fined from 50 to 60 million VND and have the social housing revoked.

Similarly, people who are rented state-owned houses or rent-purchase houses who convert, sublease or lend houses without the consent of competent authorities as prescribed will also be fined from 50 to 60 million VND.
