AIC Chairwoman Nguyen Thi Thanh Nhan requested the company's key employees and leaders to leave Vietnam and destroy documents and evidence, according to C03.

Although she has fled Vietnam, Ms. Nhan is still proposed by the Ministry of Public Security's Investigation Police Agency to be prosecuted for two crimes:BriberyandViolation of bidding regulations causes serious consequences.Seven other people in the case also fled, and were proposed for prosecution by C03 and informed that if they did not appear, it would be considered a waiver of the right to self-defense.

In the same case, C03 proposed to prosecute former Secretary of Dong Nai Provincial Party Committee Tran Dinh Thanh and former Chairman of the Provincial People's Committee Dinh Quoc Thai for the crime.Take bribes.Mr. Phan Huy Anh Vu (Director of Dong Nai Department of Health) was proposed to be charged withTake bribesandViolation of bidding regulations causes serious consequences.32 others were indicted on three counts..

In conclusion, AIC Company specializes in trading medical equipment, is an enterprise equitized from a labor export center under the Ministry of Transport. Ms. Nhan is the Chairwoman of the Board of Directors and General Director, managing all activities of the company.

At AIC, departments coordinate with each other according to an internal regulation set by Ms. Nhan on participating in bidding. Departments skillfully contact and collude with investors, consulting units and "blue team" companies to ensure that AIC wins bid packages.

Ms. Nhan also established and directly managed internal committees to transfer illegal profits. She assigned her confidants to act as focal points to legalize documents, then pay off the books to leaders of the Provincial Party Committee, Provincial People's Committee, and investors according to the mechanism she set.

Since 2003, Ms. Nhan began to approach and establish a relationship with Mr. Tran Dinh Thanh, then Deputy Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Dong Nai Province, during Mr. Thanh's meetings in Hanoi. Four years later, before the Dong Nai Provincial People's Committee approved the investment project to build the Provincial General Hospital, Ms. Nhan once again went to Dong Nai to raise the issue.

With the green light from the Provincial Party Secretary, Ms. Nhan and her subordinates established close relationships with provincial officials. To smooth the project, Ms. Nhan and her subordinates bribed Mr. Tran Dinh Thanh and Dinh Quoc Thai each with 14.5 billion VND, and Mr. Phan Huy Anh with 14.8 billion VND.

Although she knew that AIC did not have the financial capacity to participate in the bidding package in Dong Nai, Ms. Nhan instructed the chief accountant Do Van Son (who has fled) to adjust the data to provide dishonest information about financial capacity. This behavior was assessed as "fraud in bidding". Since then, AIC Company has won 16 bidding packages in the Dong Nai General Hospital project, worth more than 665 billion VND, making illegal profits and causing losses to the state of nearly 150 billion VND.

C03 accused that, in order to cope with the inspection and investigation activities of the authorities, Ms. Nhan asked key employees and leaders to leave Vietnam and destroy documents and evidence. However, C03 still had enough basis to determine that Ms. Nhan was the mastermind, leader, and main responsible for the violations of AIC Company in the Dong Nai General Hospital project.

In addition to the above bidding violations, C03 determined that since 2009, the Dong Nai General Hospital project was approved by the Prime Minister to be allocated capital from government bonds. According to regulations, the project would be allocated a maximum of 30% of the total investment (about more than 266 billion VND), but later this project was allocated up to more than 336 billion VND.

According to the conclusion, the allocation of government bond capital for the project exceeded nearly 70 billion VND. The capital arrangement time coincided with the time Dong Nai General Hospital paid the contract fee to AIC.

In addition to Dong Nai, AIC Company won bids for many projects related to the allocation of central budget funds. Therefore, to ensure the overall conclusion of the projects, C03 separated the investigation related to the allocation and use of central budget funds for later processing.
