President: 'Do not let criminals imagine that foreign countries are a hiding place'

The President emphasized: Do not let criminals have the illusion that foreign countries are a hiding place, a safe place to hide, to escape punishment from the law.

On the afternoon of November 10, in Hanoi, President Tran Dai Quang worked with the investigation agencies of the Ministry of Public Security, the Ministry of National Defense and the Supreme People's Procuracy on the situation, organization of activities and coordination between the agencies. Also attending were Senior Lieutenant General To Lam, Politburo member, Minister of Public Security; Secretary of the Party Central Committee, Chief Justice of the Supreme People's Court Nguyen Hoa Binh, and leaders of ministries, departments and branches.

In 2016, the quality of investigation and handling of crimes continued to change positively, ensuring the right people, the right crimes, and the right laws were handled; the rate of investigation and discovery of crimes continued to increase (in particular, cases related to social order reached over 82%; very serious and especially serious cases investigated and discovered reached over 92%).

The investigation agencies have closely coordinated with the Procuracy and the Court in the investigation, prosecution and trial, especially in economic and corruption cases that have attracted public attention. Along with that, the investigation agencies have basically guaranteed the right to self-defense or to have others defend the detainees, defendants as well as those with rights and obligations related to the case, ensuring the democratic rights of citizens according to the provisions of law.

Speaking at the working session, on behalf of the Party and State leaders, President Tran Dai Quang acknowledged, highly appreciated and commended the results and achievements that the investigation agencies have achieved in recent times. Regarding the difficulties and obstacles in investigating and handling crimes, the President said that currently, non-traditional crimes with many new and sophisticated methods and tricks have appeared, such as organized crimes, transnational crimes, high-tech crimes, etc.

Some economic and corruption criminals commonly use the trick of having other people register their assets from crime, transferring money and assets abroad to disperse them; and finding ways to escape abroad, especially to countries that have not signed a mutual legal assistance agreement with Vietnam.

In addition, the system of legal documents between Vietnam and some countries is not compatible, so it is difficult to resolve requests for judicial assistance from foreign partners; Expertise in economic, corruption and drug cases still has many shortcomings.

In that spirit, the President requested that the investigation agencies continue to thoroughly grasp and effectively implement the Party and State's policies and guidelines on the judicial field, focusing on the Resolution of the 12th National Party Congress. At the same time, focus on perfecting the organizational apparatus, improving the quality of the team of investigators, strengthening socialist legality, upholding the spirit of "Rule of law", ensuring accurate, objective prosecution, investigation, and recommendation of prosecution of the right person, the right crime, and the right law, without letting criminals escape, without injustice or mistakes. Thereby contributing to the prevention and fight against crimes and law violations, building a society of order, discipline, and successfully serving the task of socio-economic development and international integration of the country.

President Tran Dai Quang requested to improve the quality of investigation and discovery of criminal cases, especially particularly serious cases, economic cases, major corruption cases, high-tech cases of public concern; speed up the investigation of key cases, pending cases to resolve them completely; have active preventive measures, manage and closely monitor, not let subjects escape abroad with the spirit of resolutely fighting against crime, handling them resolutely and thoroughly; handle them clearly, do not let them drag on, have no forbidden zones and do not submit to pressure from any organizations or individuals.

Focus on detecting economic and corruption cases as well as recovering lost assets and assets appropriated by corrupt subjects. Focus on correcting and overcoming limitations and shortcomings in investigation work, strengthening inspection, guiding investigation and handling of crimes. Strictly implement the information, reporting and requesting court orders regime as prescribed.

The President suggested that investigative agencies should focus on training, fostering, professional qualifications, law, and promoting the sense of responsibility of the investigative team. In particular, in the context of increasingly complex high-tech crimes, it is necessary to pay attention to training and fostering a team of investigators with the necessary knowledge of science and technology, foreign languages, and international law to improve the quality of investigations into this dangerous crime.

Besides, investigation agencies need to focus on researching, participating in building and perfecting the draft Law on amending and supplementing a number of articles of the 2015 Penal Code and related draft laws; at the same time, effectively implementing new laws on justice.

President Tran Dai Quang proposed: “Expand international cooperation in investigating and handling crimes, especially organized crimes, transnational crimes, terrorism, drugs, economic crimes, corruption, human trafficking, money laundering and high-tech crimes... Closely coordinate with international police organizations and relevant judicial agencies of countries around the world to urgently arrest criminals hiding abroad, especially those who commit economic crimes and corruption, and at the same time take effective measures to recover the assets of corrupt officials that have been dispersed, ensuring the strictness of the law and deterring those who intend to flee abroad; not letting criminals have the illusion that foreign countries are a hiding place, a safe haven, and escape punishment from the law”.

The President affirmed that the Party, State and people always pay special attention, care and build a system of judicial agencies, including investigation agencies, to be increasingly clean and strong, performing well the assigned functions and tasks. The President believes that with the attention, leadership and direction of the Party and State, the close coordination of ministries, branches, localities and the consensus and support of all classes of people, the investigation agencies will certainly achieve even greater results and achievements, worthy of the expectations of the Party, State and people./.
