The Chairman of the People's Committee at the commune level decides on land allocation, land lease, land recovery and compensation.
Minister of Agriculture and Environment Do Duc Duy said that in the coming time, the Chairman of the People's Committee at the commune level will be able to decide on land allocation, land lease, permission to change land use purpose, land recovery, compensation, support, and resettlement.
On the morning of June 15, the National Conference on training on the organization and operation of Party organizations, government, Fatherland Front, and political organizations at the commune level (new) coordinated by the Ho Chi Minh National Academy of Politics with the Government Party Committee, the Fatherland Front Party Committee, central organizations, and central departments, ministries, branches, and organizations continued the program content.
The conference was broadcast live to 10,035 points nationwide with more than 1.5 million delegates attending. In Nghe An, the conference was connected to 487 points at 3 levels (province, district and equivalent, commune) with more than 20,300 delegates attending.

At the conference, comrade Do Duc Duy - Member of the Party Central Committee, Minister of Agriculture and Environment reported on the basic contents of decentralization, delegation of power, and division of authority in the fields of Agriculture and Environment when implementing 2-level local government.
Minister Do Duc Duy said that the Ministry of Agriculture and Environment has reviewed 1,055 documents and classified and identified 141 authorities of the Government and the Prime Minister, 500 authorities under the responsibility of the Minister of Agriculture and Environment, along with more than 1,000 authorities and tasks of local authorities.
The Ministry of Agriculture and Environment has submitted 3 Decrees to the Government and is urgently completing and issuing 18 circulars amending and supplementing specialized circulars under its authority to decentralize authority from the Minister to local authorities, especially in handling administrative procedures for organizations and individuals.

Regarding decentralization, there are 166 authorities and tasks, mainly administrative procedures and decentralization from the Minister of Agriculture and Environment to local authorities; decentralization from provincial authorities to commune authorities has 11 authorities and tasks.
There are a total of 17 areas of authority and decentralized tasks, including the following areas: fisheries and fisheries control, animal husbandry and veterinary medicine, crop cultivation and plant protection, geology and minerals, hydrometeorology, dykes and natural disaster prevention, climate change, seas and islands, land, remote sensing, irrigation, water resources, nature conservation and biodiversity, environment, quality, agricultural, forestry, fishery, forestry, and land processing.
According to the Minister of Agriculture and Environment, the authorities and tasks of the central agencies and competent persons decentralized to provincial authorities are very large, especially the authority to resolve administrative procedures decentralized to the Chairman of the Provincial People's Committee.

Among them, there are many tasks that are decentralized to localities for the first time, such as granting licenses for exploration and exploitation of Group II minerals or checking the quality of animal feed and veterinary medicine.
The authorities and tasks that have been decentralized to localities and have regulations requiring the opinion of central agencies before deciding or approving are no longer required to be implemented; local agencies and competent persons decide for themselves.
In addition, 192 authorities and tasks were assigned from the district-level government to the new commune-level government and partly to the provincial level, of which 178 authorities and tasks were transferred from the district level to the commune level.

There are a number of groups of regulations that are not within the authority and duties of district-level authorities but are related to and associated with district-level authorities that have been amended and handled accordingly to ensure clarity and consistency in the implementation of legal provisions.
Regarding the implementation procedures, Decree No. 131/2025/ND-CP redesigned the implementation procedures of 33 administrative procedures corresponding to the assigned tasks, reducing 492/1,039 days of 33 administrative procedures with assigned authority; correspondingly, the time to handle administrative procedures has been reduced by 47.35%.
Decree No. 151/2025/ND-CP redesigns the procedures for implementing 55 administrative procedures and cuts 165 days of administrative procedure implementation; including eliminating 3 steps. Decree 151 stipulates eliminating 11/66 administrative procedures on land; eliminating 8/24 conditions for performing services in the land sector; eliminating 8 types of documents; eliminating 29/73 forms with similar content in administrative procedures.

Minister Do Duc Duy said that in the distinction between general authority and specific authority, People's Committees at all levels do not resolve administrative procedures, but all authority to resolve administrative procedures for organizations and individuals is transferred to the Chairman of the People's Committee at the provincial and communal levels for implementation.
For example, in the land sector, the Chairman of the People's Committee at the commune level decides on land allocation, land lease, permission to change land use purposes, land recovery, compensation, support, and resettlement to promote the role and responsibility of heads of agencies and organizations at all levels, avoiding the situation of pushing, avoiding and delaying in implementing tasks and powers.
Commune-level administrative units after the rearrangement shall continue to use district-level land use planning, annual district-level land use plans or plans established in accordance with the provisions of law on urban and rural planning approved by competent state agencies in accordance with the provisions of law before July 1, 2025 in the area or land use targets in the land allocation and zoning plan of the provincial planning allocated to commune-level administrative units after the rearrangement as a basis for performing state management tasks on land until the work of reviewing and establishing land use planning and plans according to the new administrative units is completed.

When submitting an application for registration and issuance of a Certificate, the applicant can choose one of the places to submit the application within the province.
The agency handling administrative procedures on land is not allowed to request land users to correct records and documents related to land after the arrangement and organization of two-level local governments, but to do so simultaneously when land users carry out administrative procedures or based on the needs of land users.
Minister of Agriculture and Environment Do Duc Duy emphasized that the Ministry has established a standing unit with a hotline to receive and guide the resolution of difficulties, problems, proposals and recommendations from agencies, units and localities.
