New functions, tasks and organizational structure of the Government Office
Deputy Prime Minister Pham Binh Minh has just signed Decree 79/2022/ND-CP stipulating the functions, tasks, powers and organizational structure of the Government Office.

General consulting and coordination to help the Government
Accordingly, the Government Office is a ministerial-level agency of the Government, an apparatus assisting the Government and the Prime Minister.
The Government Office has the function of providing general advice and coordination to help the Government and the Prime Minister (including Deputy Prime Ministers) organize general activities of the Government, lead, direct and operate the activities of the Government and the state administrative system from the central to the grassroots level, ensuring unity, smoothness and continuity of the national administration; controlling administrative procedures; ensuring information serving the leadership, direction and operation of the Government and the Prime Minister and providing information to the public in accordance with the provisions of law; ensuring material, technical and logistical conditions for the activities of the Government and the Prime Minister.
The Government Office performs the tasks and powers prescribed in Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies, Decree No. 101/2020/ND-CP dated August 28, 2020 of the Government amending and supplementing a number of articles of Decree No. 123/2016/ND-CP stipulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies and specific tasks and powers.
In particular, in terms of general advice and coordination to help the Government and the Government Office develop and manage the Government's work program in accordance with the provisions of law; monitor and urge ministries, ministerial-level agencies, agencies under the Government (hereinafter referred to as ministries and branches), People's Committees of provinces and centrally-run cities (hereinafter referred to as provincial-level People's Committees), relevant agencies and organizations to implement the Government's work program and the Government's Working Regulations; synthesize and evaluate the situation and implementation results, and report to the Government; coordinate with ministries, branches, provincial-level People's Committees, relevant agencies and organizations in the process of preparing and completing projects, draft legal documents to submit to the Government for consideration and decision in accordance with the provisions of law; examine the order, procedures, handling authority and provide general advice on the content; have independent opinions on projects, draft legal documents, reports according to the Government's work program and other work submitted to the Government by ministries, branches, provincial People's Committees, relevant agencies and organizations.
At the same time, preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to prepare content for Government meetings and conferences; assist the Government in working relations with agencies of the Party, the National Assembly, the National Assembly Standing Committee, the President, the Central Committee of the Vietnam Fatherland Front and central agencies of socio-political organizations, the Supreme People's Court, the Supreme People's Procuracy; develop projects, drafts of legal documents and reports when assigned by the Government.
General advice and coordination to assist the Prime Minister
Regarding general advice and coordination to help the Prime Minister, the Government Office builds and manages the Prime Minister's work program according to the provisions of law; monitors, urges, inspects, synthesizes, evaluates, and reports on the situation and results of the implementation of the Prime Minister's work program; recommends to the Prime Minister key and important tasks that need to be focused on leading, directing, and operating in certain periods of time.

Reviewing the order, procedures, and authority for handling and providing general advice on content; providing independent opinions on projects, draft legal documents, reports according to the Prime Minister's work program and other work submitted to the Prime Minister by ministries, branches, provincial People's Committees, relevant agencies and organizations.
Preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to complete the content, procedures, records and draft documents to submit to the Prime Minister for consideration and decision on other regular tasks submitted by ministries, branches, provincial People's Committees, agencies and organizations.
Assist the Prime Minister in regulating and coordinating activities between ministries, branches, and provincial People's Committees in formulating and implementing policies and laws; activities of Councils, Committees, Steering Committees, and inter-sectoral coordination organizations headed by the Prime Minister in accordance with the provisions of law.
Recommend the Government and the Prime Minister to assign ministries, branches, provincial People's Committees, relevant agencies and organizations to develop mechanisms, policies, projects, draft legal documents to submit to competent authorities for decision; or proactively research and propose mechanisms and policies to submit to the Government and the Prime Minister for consideration and decision.
Preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to prepare work reports, explanatory reports, and responses to questions of the Government and Prime Minister before the National Assembly, the National Assembly Standing Committee, the President, competent agencies and the People under the direction of the Prime Minister.
Preside over drafting and editing articles, speeches, press interviews, documents for the Prime Minister and other reports and documents as directed by the Prime Minister.
Assist the Prime Minister in monitoring, urging and inspecting the implementation of tasks assigned by the Government and the Prime Minister to ministries, branches, provincial People's Committees, relevant agencies and organizations; recommend to the Prime Minister necessary measures to urge implementation, overcome shortcomings and limitations, ensure discipline, administrative discipline and effectiveness and efficiency of state management.
Preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to prepare content and serve the Prime Minister's meetings, work, and business trips to localities and establishments.
To attend meetings and conferences of ministries, branches, People's Councils, Provincial People's Committees, relevant agencies and organizations; to request ministries, branches, Provincial People's Committees, agencies and organizations to provide relevant documents, data and papers, and to report on the implementation of tasks assigned by the Government and the Prime Minister; to participate in Councils, Committees, Steering Committees, and inter-sectoral coordination organizations headed by the Prime Minister according to regulations; to proactively work with ministries, branches, Provincial People's Committees, agencies and organizations to grasp the situation to serve the leadership, direction and administration of the Government and the Prime Minister.
In case there are still different opinions on issues submitted to the Government or Prime Minister, the Minister and Head of the Government Office shall chair a meeting with leaders of ministries, branches, provincial People's Committees, relevant agencies and organizations to discuss, reach consensus or clarify issues with different opinions before submitting to the Government or Prime Minister.
Return the dossier to the sender and clearly state the reason or transfer the dossier to the competent authority for settlement of incomplete dossiers, dossiers that do not follow the correct order, procedures, regulations or are not within the authority of the Government, the Prime Minister or the submitting agency does not clearly propose a settlement plan; develop projects, drafts of legal documents and other documents when assigned by the Prime Minister.
Administrative procedure control
Regarding administrative procedure control, the Government Office guides, monitors, urges, and inspects the implementation of administrative procedure control work by ministries, branches, and provincial People's Committees; synthesizes the situation and implementation results, and reports to the Government and the Prime Minister.
Preside over the implementation of administrative procedure reform tasks and the one-stop and inter-connected one-stop mechanisms in handling administrative procedures at state administrative agencies; communication work on administrative procedure reform.
Recommend that the Government and the Prime Minister assign ministries, branches, and provincial People's Committees to study and propose or proactively study and propose policies, solutions, and initiatives to reform administrative procedures and related regulations; evaluate and handle the results of the review of administrative procedures in accordance with the provisions of law.
Preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to build, manage and operate the National Database on Administrative Procedures and the National Public Service Portal; organize the implementation of related tasks assigned by the Government and the Prime Minister.
Receive and handle feedback and recommendations from organizations and individuals on administrative regulations under the management of the Government, the Prime Minister and state administrative agencies in accordance with the law; perform the duties of the standing council of the Advisory Council on Administrative Procedure Reform.
Ensuring information for leadership, direction and operation
Regarding information assurance to serve the leadership, direction and administration of the Government and the Prime Minister, the Government Office shall implement periodic, thematic and ad hoc reporting regimes according to regulations and other reports as required by the Government and the Prime Minister.
Receive information from ministries, branches, provincial People's Committees, agencies, organizations and individuals on the leadership, direction and administration of the Government and the Prime Minister; proactively monitor, coordinate and grasp the practical situation to promptly advise and propose to the Government and the Prime Minister to consider and direct the handling of urgent, prominent, pressing issues of public concern.
Provide information to members of the Government, Heads of Government agencies, Chairmen of People's Councils, Provincial People's Committees, Party and State agencies and relevant agencies and organizations on the country's socio-economic situation and the leadership, direction and administration of the Government and Prime Minister according to regulations.
Preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to develop, manage and operate information systems and databases assigned by the Government and the Prime Minister; connect, coordinate, integrate and share information between the Government Office and ministries, branches and provincial People's Committees to serve the leadership, direction and administration of the Government and the Prime Minister in accordance with the law.
Preside over and guide ministries, branches, and provincial People's Committees in sending and receiving electronic documents; handling administrative procedures in the electronic environment; implementing the reporting regime to serve the direction and administration of the Government and the Prime Minister according to regulations.
Provide information to the public
Regarding providing information to the public, the Government Office provides information to the public on key activities, important decisions in leadership, direction and administration of the Government, the Prime Minister, outstanding political, economic and social events and other information as prescribed by law and directed by the Prime Minister; performs the task of being the spokesperson of the Government and the Prime Minister.
Preside over and coordinate with ministries, branches, provincial People's Committees, relevant agencies and organizations to organize Government press conferences, provide information to the press periodically and suddenly; advise the Prime Minister on press interviews; and issue press releases in accordance with the law.
Require relevant agencies to correct and press agencies to correct inaccurate information content that is not in accordance with the leadership, direction and administration requirements of the Government and Prime Minister according to the provisions of law.
Perform state management of official gazettes; organize management, publication and distribution of the Official Gazette of the Socialist Republic of Vietnam according to the provisions of law.
Manage the organization and operation of the Government Electronic Information Portal.
The Government Office has 20 units.
Regarding the organizational structure, the Government Office has 20 units. The Minister and Head of the Government Office shall submit to the Prime Minister for promulgation a Decision stipulating the functions, tasks, powers and organizational structure of the Government Electronic Information Portal; and promulgate a list of other public service units under the Government Office.
The Minister and Head of the Government Office prescribes the functions, tasks, powers and organizational structure of units under the Government Office, except for the Government Electronic Information Portal.
Regarding the transitional provisions, the Information Technology Center continues to operate according to current regulations until the Decision stipulating the functions, tasks, powers and organizational structure of the Department of Administrative Procedure Control and the Department of Administration issued by the Minister and Head of the Government Office takes effect.
The Decree takes effect from October 10, 2022.
