According to regulations on recruitment, employment and management of civil servants, during the probationary period, the probationary employee is entitled to 85% of the salary level 1 of the recruitment category; in case the probationary employee has a master's degree that meets the recruitment requirements, he/she is entitled to 85% of the salary level 2 of the recruitment category.

Ms. Nguyen Thi Bich Phuong (Hanoi)), submitted her application for the Tax civil service exam on February 10, 2017. Because she defended her master's thesis on January 19, 2017 and June 12, 2017, Ms. Phuong was just awarded her master's degree, so on April 10, 2018, she went to the recruitment agency to complete her application and add her master's degree.

On April 16, 2018, Ms. Phuong received a recruitment decision to the General Department of Taxation with the position of archivist, receiving salary level 1 coefficient 2.34. Ms. Phuong asked, in her case, is the salary level 2 coefficient 2.67 or the salary level 1 coefficient 2.34?

Article 35 of the Law on Cadres and Civil Servants stipulates that recruitment of civil servants must be based on job requirements, job positions and staffing quotas.

According to Article 2 of Circular No. 13/2010/TT-BNV of the Ministry of Home Affairs, the application for civil servant recruitment includes: Application for civil servant recruitment; A self-written CV certified by a competent authority within 30 days from the date of application submission; A copy of the birth certificate; Copies of diplomas, certificates and academic results as required by the position; A health certificate issued by a competent health authority within 30 days from the date of application submission; A certificate of priority in civil servant recruitment (if any) certified by a competent authority.

Complete the application before signing the recruitment decision.

Clause 2, Article 9 of this Circular stipulates that within 30 days from the date of receiving the notice of recognition of the recruitment results from the competent authority for civil servant recruitment, the successful candidate must go to the competent authority for civil servant recruitment to complete the application file. The application file must be supplemented for completion before signing the recruitment decision, including:

- Copies of diplomas, certificates and academic results as required by the position applied for, certified by a competent authority;

- Criminal record certificate issued by the Department of Justice of the place of permanent residence.

The time for the competent authority to authenticate diplomas, certificates, academic results and issue criminal records is within 30 days from the date of receipt of the admission notice.

Salary ranking by education level when recruiting

Clause 1, Article 22 of Decree No. 24/2010/ND-CP dated March 15, 2010 of the Government regulating the recruitment, use and management of civil servants stipulates that during the probationary period, the probationary employee shall receive 85% of the salary level 1 of the recruitment category; in case the probationary employee has a master's degree that meets the recruitment requirements, he/she shall receive 85% of the salary level 2 of the recruitment category; in case the probationary employee has a doctoral degree that meets the recruitment requirements, he/she shall receive 85% of the salary level 3 of the recruitment category.

According to Ms. Nguyen Thi Bich Phuong, on February 10, 2017, Ms. Phuong submitted her application for the General Department of Taxation civil service position. Previously, on January 18, 2017, Ms. Phuong had completed her training program and successfully defended her master's thesis, but at the time of submitting her application for the civil service position, because the training institution had not yet awarded the degree, her application did not include a master's degree. It was not until June 12, 2017 that Ms. Phuong was awarded a master's degree. After receiving the notification of her admission, on April 10, 2018, she went to the recruitment agency to complete her application and supplement her master's degree before the recruitment agency made a recruitment decision.

According to the lawyer, in order to have a basis for salary classification according to the provisions of Clause 1, Article 22 of Decree No. 24/2010/ND-CP, it is necessary to clearly determine whether from the time Ms. Phuong received the notice of being recruited as a civil servant to the date of submitting her master's degree (April 10, 2018), within the 30-day period, she must complete her application according to the provisions of Clause 2, Article 9 of Circular 13/2010/TT-BNV or not? Is Ms. Phuong's master's degree suitable for the recruitment requirements of a civil servant for archival purposes or not?

If Ms. Phuong completes the application, submits her Master's degree within the prescribed time limit, and the submitted Master's degree meets the requirements for recruiting civil servants for archival work, then that Master's degree will be used as the basis for ranking and salary level when appointing civil servants. Accordingly, when implementing the probationary regime, because Ms. Phuong has a Master's degree, she will receive 85% of the salary level 2 of the Clerical work category (MS 02.007); When appointed as a civil servant, she will receive 100% of the salary level 2 of the Clerical work category (MS 02.007) with a coefficient of 2.67.

In case the application is not completed within the prescribed time limit, the submitted master's degree does not meet the requirements for the recruitment of a civil servant in the field of archival records, the recruiting agency will base on the university bachelor's degree submitted before the recruitment to determine the salary. When implementing the probationary regime, Ms. Phuong will receive 85% of the salary level 1 of the Clerical category (MS 02.007). When appointed as a civil servant, she will receive 100% of the salary level 1 of the Clerical category (MS 02.007), coefficient 2.34.
