Based on the investigation results, there is sufficient evidence to determine that the incident shows signs of a crime, therefore a criminal case has been initiated. Currently, the investigating agency is continuing to clarify the case to handle it according to the law.

On May 18th, the Investigation Police Department of Dong Thap province initiated a criminal case.Violations of bidding regulations have resulted in serious consequences.This occurred at the Dong Thap Provincial Center for Disease Control (CDC Dong Thap) and other medical units and facilities.

According to the investigating agency, after receiving a request for prosecution regarding suspected irregularities in the procurement of biological products and medical equipment by Viet A Technology Joint Stock Company in Dong Thap province, on April 21, the investigating agency proceeded to handle the case according to the procedures for handling complaints, reports of crimes, or requests for prosecution.

Previously, the People's Committee of Dong Thap province issued a press release concluding the inspection of the procurement of medical equipment, supplies, biological products, test kits, vaccines, and drugs for the prevention and control of COVID-19. The total value of contracts for the procurement of medical equipment, supplies, biological products, and test kits by units in Dong Thap in 2020-2021 exceeded 742 billion VND. Specifically for Viet A Technology Joint Stock Company, units in Dong Thap purchased 10 contracts with a total value of over 233 billion VND. Of this, the actual value of purchases was over 197 billion VND, with over 156 billion VND already paid and over 40 billion VND remaining unpaid.

According to the inspection results, the bidding packages, in terms of documentation, procedures, and pricing, were generally compliant with the regulations of the Government, the Ministry of Health, and the Ministry of Finance. However, some shortcomings were noted during the procurement process, such as: some investors received goods in advance before signing the contract; the monitoring of inventory inflow and outflow was not reasonable; some bidding and winning bid documents lacked customs declarations, certificates of origin, and quality certificates for imported goods; handover and acceptance records lacked the signatures of technical staff; the approved contractor selection plan and results were published later than the stipulated time; there were no warranty documents proving the remaining shelf life of the goods from the time of delivery and no inspection and testing documents to ensure that the goods had technical characteristics suitable for the contract requirements; and there was a lack of documents proving the origin, code, label, and validity of the products and goods.

Following the inspection findings, the People's Committee of Dong Thap province issued a directive to the Department of Health, requiring investors to immediately rectify the shortcomings identified in the inspection. Simultaneously, it instructed the Department to hold accountable investors who were found to have deficiencies in the bidding process for the procurement of medical equipment, supplies, biological products, and test kits. Furthermore, it mandated coordination with the Department of Planning and Investment and the Department of Finance to review the bidding packages identified as flawed and those remaining. The results of this review should be reported to the People's Committee of Dong Thap province, and the implementation of these measures must be completed no later than the end of the third quarter of 2022.

The People's Committee of Dong Thap province also assigned the Provincial Inspectorate to monitor and promptly propose to the Provincial People's Committee solutions regarding the bidding packages related to Viet A Technology Joint Stock Company, after receiving conclusions from the competent authority.
