Civil servants are not allowed to take the promotion exam if it does not meet the requirements of the job position.

The Ministry of Home Affairs is drafting a Circular detailing a number of contents on recruitment of civil servants and public employees, upgrading civil servant ranks, promoting professional titles of public employees and implementing the contract regime for a number of types of work in state administrative agencies and public service units.

Accordingly, the draft clearly states the organization of civil servant promotion exams as follows: The organization of civil servant promotion exams can only be carried out when the civil servant management agency meets the following conditions:

The civil servant management agency has built the civil servant rank structure of agencies, organizations and units under its management and has been approved by competent authorities.

The civil servant management agency has described and determined the number of job positions lacking compared to the civil servant rank structure of agencies, organizations and units under its management approved by competent authorities as a basis for determining the promotion target for each civil servant rank.

Based on the number of promotion quotas of the civil servant management agency prescribed above, civil servants who meet all the standards and conditions prescribed in Clause 3, Article 29 of Decree 24/2010/ND-CP, amended and supplemented in Clause 14, Article 1 of Decree 161/2018/ND-CP, can register for the exam. There is no limit on the number of civil servants registering for the exam for each promotion quota.

The competent authority organizing the civil servant promotion exam shall have a written report on the number and structure of the existing civil servant ranks of the agencies, organizations and units under its management, the list and number of job positions of each agency, organization and unit approved by the competent authority and the number of civil servants who have met the standards and conditions to participate in the promotion exam of each civil servant corresponding to each job position approved by the competent authority, sent to the Ministry of Home Affairs or the Central Organization Committee for consensus before organizing the promotion exams under its authority.

The draft also clearly states: Civil servants who are nominated to take the promotion exam but do not meet the standards, conditions or do not meet the requirements of the job position will not be allowed to take the promotion exam. In case civil servants use illegal degrees or certificates, or make false declarations to meet the standards and conditions for the promotion exam, when discovered, they will be disciplined according to the provisions of the law on cadres and civil servants and have their promotion exam results annulled. The competent authority organizing the promotion exam is responsible for annulling the promotion exam results in these cases.
