Nghe An LGBT Community: Living true to yourself

(Baonghean.vn) -On August 13, the LGBT community in Nghe An organized the Viet Pride event. This is the third year the event has been held in Nghe An, attracting more than 100 young people to attend.

The National Assembly has promulgated the 2015 Civil Code (effective from January 1, 2017) and the 2014 Law on Civil Status (effective from January 1, 2016), which stipulate the right to change civil status for transgender people. Specifically as follows:

“Article 36: Right to gender reassignment

1. Individuals have the right to re-identify their gender.

Gender reassignment is performed in cases where a person's gender is congenitally defective or not yet accurately formed and requires medical intervention to clearly determine the gender.

2. Gender reassignment is carried out in accordance with the provisions of law.

3. Individuals who have undergone gender reassignment have the right and obligation to register changes to their civil status according to the provisions of the law on civil status; have personal rights consistent with their reassigned gender according to the provisions of this Code and other relevant laws.

Article 37: Gender reassignment

Gender reassignment is carried out in accordance with the provisions of law. Individuals who have undergone gender reassignment have the right and obligation to register changes to their civil status in accordance with the provisions of the law on civil status; and have personal rights consistent with their transformed gender in accordance with the provisions of this Code and other relevant laws.

Article 3 (Law on Civil Status) allows the recording in the Civil Status Book of changes in an individual's civil status according to the judgment or decision of a competent state agency of the following contents:

a) Change of nationality;

b) Identify father, mother, child;

c) Re-identifying gender…”.

As one of the few people who openly revealed their true gender in Vinh city, Bao Loc - a member of the LGBT community of Nghe An shared: "About 5 years ago, in the whole Vinh city, there were only a few people who dared to live their true identity, but they had to endure a lot of criticism. Nguyen Ha Vy - a member of the organizing committee of Viet Pride Nghe An event said that the organizers had planned early, calling on volunteers and the LGBT community of Nghe An to participate. According to Vy, it is currently very difficult to count how many homosexuals there are in Nghe An. Viet Pride is funded by the European Union, supported by the iSEE Institute for Social, Economic and Environmental Studies, OXFAM, ISC Center - an organization that protects and promotes the rights of LGBT people in Vietnam, NEXTGEN network - a youth leadership program working for LGBT rights and organized by the NextGEN Nghe An group and friends in the community.
According to the provisions of the 2014 Law on Marriage and Family, the prohibition on same-sex marriage has been removed, but same-sex marriage has not yet been recognized. Thus, in Vietnam, same-sex people can still get married, but will not be protected by the law when disputes arise.
