Public announcement of court judgments and decisions on the electronic information portal
This solution aims to improve the capacity and responsibility of judges, increase consistency in law enforcement, and create conditions for people to participate in monitoring the trial activities of the Court.
Strategic level requirements
Speaking at the opening ceremony of the Electronic Information Portal announcing the Court's judgments and decisions, Vice Chairman of the National Assembly Uong Chu Luu stated that, implementing the 2013 Constitution and new judicial laws promulgated by the National Assembly, the Court's authority has been expanded, the rights of judicial positions have been enhanced, but it also requires improving the capacity, qualifications and mettle of Judges and other judicial positions. The Supreme People's Court's leadership's request for the Courts to publicly announce legally effective judgments and decisions on the Court's Electronic Information Portal is a correct, creative and popular decision.
“This will be one of the effective mechanisms for people to inspect and supervise the activities of the Court, which is of great significance in contributing to improving the quality of trial activities and the responsibility regime of Judges and Jurors to realize the goal of judicial reform and building a democratic, fair and civilized society,” said Vice Chairman of the National Assembly Uong Chu Luu.
Chief Justice Nguyen Hoa Binh affirmed that the implementation of public and transparent activities of the Court in general and the public disclosure of legally effective judgments and decisions of the Court in particular is a breakthrough solution of the People's Court system to improve the quality of adjudication, strengthen responsibility and discipline in the spirit of "Responsibility, discipline, quality, for justice".
The policy of publicizing judgments and decisions on the electronic information network is a strategic requirement of judicial reform, of the Constitution and laws, and is an advanced international practice. This is also a mechanism for people to control judicial activities in general and the work of the Court in particular, a way to help Judges improve their responsibility and qualifications, thereby accurately selecting and selecting competent and qualified Judges, contributing to building a team of honest, dedicated and qualified Judges. The Court's publication of judgments and decisions also aims to increase publicity and transparency in the Court's activities, is a way to ensure the right to access information, and strengthen the supervision of agencies, organizations and individuals over the Court's trial activities.
However, in the implementation process in the past, many judges have not strictly followed this requirement or have posted but not in accordance with the guiding documents. Therefore, the Supreme People's Court will continue to invest in facilities for the Courts to publish judgments and decisions on the Court's electronic information portal; and increase the participation of the people and the media in the activities of evaluating and commenting on the Court's judgments and decisions.

A big step forward in judicial reform
The initial steps to improve the quality of judgments and publicize judgments on the Court's electronic information portal have been effective and have been positively evaluated. Former Deputy Chief Justice of the Supreme People's Court Tong Anh Hao said: Publicizing judgments will increase the responsibility of the panel of judges and the presiding judge. When conducting a trial, the judge will be aware that the trial is being supervised. The product, the judge's judgment, will be evaluated by public opinion. The quality of the trial will therefore be improved.
Wrongful convictions and errors will therefore be reduced when the responsibilities of the jury and the judge are enhanced and monitored more extensively. Of course, wrongful convictions and errors have many causes and can be limited by promoting and improving the quality of litigation in court. Therefore, enhancing the responsibilities of the jury and the presiding judge is also a good measure to reduce wrongful convictions in the trial process.
National Assembly Representative - Lawyer Truong Trong Nghia commented: Currently, even in high-level courts, many judgments still have grammatical and vocabulary errors... Now when judgments are made public, judges must improve their writing skills (judgments). Because if not, people reading the judgment will not know what the judge said and the public will be negatively affected. And the public will immediately know which judge is bad and which judge is good. "Another thing to note is that when the judgment is made public, the public will know whether the judgment is fair or not, whether it ensures justice or not. The judgment is a pressure on form, but the arguments and reasoning of the judgment are a pressure on content.
These two pressures cannot be separated. Many judges apply the law very well, but if they cannot write, their arguments and reasoning will not be able to come out. The technical elements of writing judgments will have a very profound impact.
Publicizing judgments has multifaceted impacts, positively improving the quality of trials at court as well as being reflected in judgments. Promoting this solution is extremely necessary to create a breakthrough for the activities of the People's Court.
