Clarifying land use rights

Informing Nghe An Newspaper, a representative of Quy Hop District People's Committee said: Dong Hop Forestry Farm belongs to Song Hieu Forestry Industry Union (now Song Hieu Forestry One Member Co., Ltd). Song Hieu Forestry Industry Union was established under Decision No. 31/CP dated March 8, 1965 of the Prime Minister.

In 1989, the Ministry of Forestry allocated land to the Song Hieu Agricultural Forestry Union in Decision No. 104LN/KL dated March 3, 1989; of which Dong Hop Forest Farm was 10,144 hectares. In 2003, Dong Hop Forest Farm was granted a Land Use Rights Certificate by the Provincial People's Committee in Decision No. 694/QD-UBND.DC dated August 29, 2003; of which Tam Hop commune (Quy Hop) was 728.0 hectares.

During the land use process (since the issuance of the Land Use Right Certificate), Dong Hop Forestry has complied with the land recovery decision of the Provincial People's Committee 5 times, returning the land to local management. Of which, the total area in Tam Hop commune returned is 382.96 ha, specifically:

Decision No. 456/QD-UBND.DC dated June 10, 2007 of the Provincial People's Committee on land recovery in Tam Hop and Dong Hop communes with a total area of ​​83.10 hectares; of which Tam Hop commune is 37.37 hectares.

Decision No. 212/QD-UBND.DC dated August 24, 2012 of the Provincial People's Committee on land recovery in the communes: Chau Loc, Yen Hop, Tam Hop, Dong Hop, Tho Hop, Chau Cuong, Chau Hong, Chau Thai, Chau Ly and Chau Thanh commune with a total area of ​​1,488.87 hectares, of which in Tam Hop commune: 67.77 hectares.

Decision No. 21/QD-UBND.DC dated January 25, 2014 of the Provincial People's Committee on land recovery in the communes of Chau Loc, Tam Hop, Dong Hop, Yen Hop, Chau Cuong, Chau Thanh, Chau Thai, Chau Ly and Tho Hop with a total area of ​​310.75 hectares; of which in Tam Hop commune is 2.55 hectares of unused land (land planned for production forests).

Decision No. 203/QD-UBND.DC dated April 21, 2018 of the Provincial People's Committee on land recovery in the communes of Chau Loc, Tam Hop, Yen Hop, Dong Hop with a total recovered area of ​​618.06 hectares; of which in Tam Hop commune is 207.98 hectares.

Decision No. 375/QD-UBND.DC dated June 13, 2018 of the Provincial People's Committee on land recovery in Tam Hop and Dong Hop communes with a total area of ​​71.16 hectares; of which Tam Hop commune is 67.29 hectares.

Currently, the remaining land of Dong Hop Forestry Farm in Tam Hop commune is 328.46 hectares.

On average, each household in Long Thanh hamlet is currently using 1.05 hectares. Compared to other hamlets in the same area of ​​Tam Hop commune (average 0.52 hectares), households in Long Thanh hamlet are currently managing and using land with an area larger than the average in the whole commune.

Regarding the management and use of land by Long Thanh hamlet residents, through inspection, the People's Committee of Quy Hop district informed: Long Thanh hamlet was established in 2001, on the basis of merging Roc Vo hamlet and Vang hamlet. Currently, Long Thanh hamlet has 166 households/753 people; is using a total land fund of 174.90 hectares (of which 49.22 hectares are residential land and garden land; 125.68 hectares are agricultural land). On average, each household in Long Thanh hamlet is currently using 1.05 hectares (including residential land, garden land and agricultural land).

In addition, also in Long Thanh hamlet, there are 97 households that have received contracts with Dong Hop forestry farm with a total contracted area of ​​140 hectares to grow raw material forests. If compared with other hamlets in the same area of ​​Tam Hop commune, for example, in Hop Thanh hamlet, on average each household manages and uses an average of 0.52 hectares; then households in Long Thanh hamlet are currently managing and using land with an area larger than the average in the whole commune.

Recently, the People's Committee of Quy Hop district has continued to assign specialized departments to collect records and documents to re-determine the location, owner, and management of the disputed land area in Long Thanh hamlet. Accordingly, this land area is identified as lot d7 and d8, plot 5, sub-area 278, the state has assigned the right to manage and use the land to Dong Hop Forestry; and the People's Committee of Nghe An province has granted the Land Use Right Certificate No. X327472 with an area of ​​728.0 ha, according to Decision No. 694/QD-UB.DC.

In 2010 - 2011, Dong Hop Forestry signed a joint venture contract for periodic production forest planting with Mr. Ha Van Ngoan in the contracts: No. 67/HD.LDTR, No. 24/HD.LDTR. On July 26, 2017, Mr. Ha Van Ngoan authorized Mr. Nguyen Tien Canh to continue using the above land area in the Minutes of Agreement No. 01PL/HD-LD-TR (signed by 3 parties, including: Mr. Ha Van Ngoan - Mr. Nguyen Tien Canh - Dong Hop Forestry).

On January 18, 2019, Mr. Nguyen Tien Canh submitted an application to exploit the joint venture forest plantation 49/51 planted in 2010 and liquidated the contract on May 15, 2019 with Dong Hop Forestry (with a contract liquidation record dated May 15, 2019). After harvesting acacia, Mr. Nguyen Tien Canh did not continue the joint venture forest plantation contract with Dong Hop Forestry but arbitrarily hired people, planted together, and people helped plant acacia on Dong Hop Forestry's land. This led to a fight on August 2, 2019.

Quy Hop District People's Committee also affirmed that, through inspection, the current status of the disputed land area is not included in the land area that the Provincial People's Committee reclaimed from Dong Hop Forestry Farm and transferred to Quy Hop District People's Committee for management according to Decision No. 212/QD-UBND.DC dated August 24, 2012.

Will continue to hold dialogue

It is known that after the land dispute incident on August 2 occurred, on August 14, the representative of Long Thanh hamlet, Hamlet Chief Ho Van Kiem, sent a written report summarizing the opinions and recommendations of the people to the Chairman of the People's Committee of Quy Hop district.

Discussing this content, the representative of the People's Committee of Quy Hop district said that the district leaders had received the report of the Head of Long Thanh hamlet. The report stated 6 recommendations including the following contents: People have reclaimed, restored land and lived there since 1981. But why did the People's Committee of Tam Hop commune and the People's Committee of Quy Hop district confirm the dossier to grant land to Dong Hop Forestry Enterprise in Long Thanh hamlet in particular and Tam Hop commune in general, to be approved by the Provincial People's Committee without notifying the people? Request to check whether the dossier to grant land to Dong Hop Forestry Enterprise is in accordance with the 2003 Land Law or not? Request to provide a detailed map of land recovery of Dong Hop Forestry Enterprise to the people of Long Thanh hamlet.

Why have households eligible for land allocation under Decision 212 not been granted land use right certificates? Why is there a delay in implementing Decision 203/QD-UBND dated April 12, 2018 of the Provincial People's Committee? Propose that the District People's Committee reclaim 6.7 hectares of land in Nghia Hung commune that is being cultivated in Long Thanh hamlet. Propose that Dong Hop Forestry Enterprise implement raw material forest planting contracts in Long Thanh hamlet because they are overdue; at the same time, clarify the responsibilities of the forestry enterprise in implementing the state's policies to support production forest planting according to Decision 147/2007/QD-TTg dated September 10, 2007, amended and supplemented by a number of articles in Decision No. 66/2011/QD-TTg dated December 0, 2011.
