(Baonghean Newspaper) - On April 9, 2015, Baonghean Newspaper published an article titled: "Vinaconex 9B Apartment Building Leaks and Leaks: When Will It Be Fixed?". Following the publication, Construction Joint Stock Company No. 9 received Document No. 2270/UBND.ĐTXD dated April 16, 2015, from the Provincial People's Committee requesting action on the issue raised by Baonghean Newspaper. On April 21, 2015, Construction Joint Stock Company No. 9 sent Official Letter No. 407/2015/CV/VC9-ĐT providing the following detailed explanation:

1. Regarding construction warranty:

The 12-story CT, B apartment building, part of the Tay Dai Lo Xo Viet Nghe - Tinh New Urban Area Project, located in Hamlet 19, Nghi Phu Commune (Vinh City), was completed and officially put into use at the end of 2013. During its use, the building as a whole has not experienced any major damage affecting its quality. However, some residents on the 11th floor have experienced leaks and seepage, as reported in the media. Immediately after receiving notification from the residents, the Project Management Board organized the waterproofing of the 11th-floor roof as requested by the residents. To date, the leaks on the 11th floor have been largely resolved and no longer affect the residents. Regarding the leaks from the drainage system in the technical box caused by the drilling and breaking of the wall pillars for equipment installation, the company will coordinate with the residents to identify the location and cause and propose a repair plan as soon as possible.

2. Regarding apartment building service fees:

Currently, Construction Joint Stock Company No. 9 is collecting a management and operation fee of 3,000 VND/m2, in accordance with Decision No. 2584/QD-UBND dated June 11, 2014, of the People's Committee of Nghe An province, which stipulates the maximum service price for apartment buildings in Nghe An province. This price has been agreed upon and fully paid monthly by residents of apartment buildings CT and A. However, in apartment buildings CT and B, 43 out of 70 households have not yet agreed to pay the service fee at this rate. This fee is insufficient to cover the management and operation costs of the apartment buildings; since their operation began, the company has been incurring monthly losses on the management and operation of both apartment buildings.

3. Regarding the use of the maintenance fund and the establishment of the apartment building management board:

According to current regulations, the apartment building maintenance fund is managed and used by the developer for the maintenance of the apartment building until a Management Board is established. Currently, until a Management Board is formed, the company continues to manage the maintenance fund and use it for the maintenance of the apartment building in accordance with regulations. After the Management Board is established, the company will finalize the maintenance work already performed and hand over the remaining maintenance funds to the apartment building's Management Board.

From 2013 to 2014, the company held apartment building conferences and proposed the establishment of a Management Board for apartment buildings CT,A and CT,B, but to date, it has not received the unanimous support of the residents living in these two apartment buildings.

As the project's investor, Construction Joint Stock Company No. 9 commits to strictly complying with current regulations on investment and construction management, continuing to review and address the remaining issues mentioned in the Nghe An newspaper on April 9, 2015, and fully fulfilling its warranty responsibilities as stipulated.

The company hopes to continue receiving support and feedback from the committee, agencies, and departments of the province so that it can better serve the people living in the urban area it develops, contributing to the overall economic and social development of the province.
