Regarding the B5 Cau Dien project, where the Hanoi Court is trying the defendants for abusing power while performing official duties, Ms. Chau Thi Thu Nga was summoned to court.

On September 15, the Hanoi Court brought Nguyen Van Tuan (born in 1958, former Chairman and General Director of Hanoi Development Construction Investment and Import-Export Company Limited - HAIC) and Bui Manh Ha (born in 1963, former Chief Accountant of HAIC) to trial for the crime of Abuse of power while performing official duties.

According to the accusation, from 2008 to 2011, although the Cau Dien B5 Project had not been granted a construction permit and the housing design had not been approved, Nguyen Van Tuan - Chairman and General Director of HAIC Company - a 100% state-owned enterprise owned by the Hanoi People's Committee - directed and, together with Bui Manh Ha, organized the mobilization of capital from customers who wanted to buy houses to implement the Cau Dien B5 project, collecting a total amount of more than 263 billion VND.

Nguyen Van Tuan's organization of capital mobilization when the project had not been approved for construction by competent authorities was contrary to the provisions of the 2005 Housing Law and exceeded the assigned time limit.

Tuan and Ha did not use the money raised for the B5 Cau Dien project but used it for many other purposes without reporting to the Hanoi People's Committee.

As a result, the B5 Cau Dien project has not been implemented, and the company is unlikely to recover the capital raised for investment outside.

HAIC Company is unable to pay more than VND 88 billion to 84 customers who have applied for capital withdrawal.

In addition, the purchase and sale of some construction equipment also caused losses of more than 1.5 billion VND.

Tuan's actions have caused particularly serious consequences for HAIC Company and the rights and interests of capital contributors, and have committed the crime of Abuse of Power while performing official duties. Bui Manh Ha was determined by the prosecution agency to have assisted Tuan in committing the act of abuse of power.

Regarding the case, former National Assembly delegate Chau Thi Thu Nga - former General Director of Housing Group Joint Stock Company - Housing Group was also brought to court as a person with rights and obligations related to the case.

The prosecution agency clarified that on August 1, 2008, Nguyen Van Tuan, as a representative of HAIC Company, and Ms. Chau Thi Thu Nga, representing Housing Group, signed a memorandum of investment cooperation on the implementation of the investment project to build an apartment complex and garden villas at the B5 Cau Dien land lot.

The two parties agreed that HAIC Company would contribute 40% of the capital in the form of land use rights, assets on land and cash. Housing Group Company would contribute 60% of the total investment in construction of the project. In addition, Housing Group would establish and implement the project and take charge of the site clearance steps.

From early August 2008 to early November 2011, HAIC Company received from Housing Group Company and 3 individuals to cooperate in investing capital to implement the B5 Cau Dien project, the total amount of money collected was more than 37 billion VND, of which Housing Group alone received more than 34 billion VND.

Regarding the B5 Cau Dien project, Ms. Chau Thi Thu Nga was prosecuted and detained by the Ministry of Public Security's investigation police agency for the crime of Fraudulent appropriation of property.

The investigation results determined that the victims were not informed by Housing Group that it had not been approved by the authorities as the project investor, had not been adjusted in planning, and had not been granted a construction permit.

They were only provided by Housing Group with information and documents such as project land use planning maps and plot location extracts (not yet legally valid) and were explained to believe that Housing Group was actually the investor of the B5 Cau Dien project.

During the investigation, the Ministry of Public Security determined that 602 customers contributed a total of more than 322 billion VND to Housing Group and are currently unable to pay.

On the first day of the trial (September 15), during the debate, the representative of the People's Procuracy proposed to sentence defendant Nguyen Van Tuan to 18 to 20 years in prison. Bui Manh Ha was proposed to be sentenced to 12 to 14 years in prison.

The Hanoi Court is expected to announce the verdict on September 19./.
