Former police chief prosecuted for fraud and misappropriation of tens of billions of VND.
Despite knowing that the land plots could not be issued land use right certificates, the former head of the Phu Quoc City Police and another woman still agreed to help, defrauding numerous victims of tens of billions of VND.
The Investigation Police Department of Kien Giang province has just completed its supplementary investigation report and recommended the prosecution of defendants Le Van Mot (59 years old, residing in Rach Gia City) and Nguyen Thi Hang (46 years old, residing in Nam Dinh province) for the crime of "Fraudulent appropriation of property"
Suspect Mot, the former head of the Phu Quoc City Police, was indicted in early April 2024 and is currently under temporary detention. Meanwhile, suspect Hang was indicted and detained at the end of May 2023. Hang had previously been sentenced to 4 years and 6 months in prison by the Hanoi High People's Court for the same crime.
According to the investigation's conclusions, in mid-2021, through an acquaintance, the defendant Hang met and asked Mot for help with business in Phu Quoc.
In November 2021, Ms. TTMT (residing in Ho Chi Minh City) intended to purchase 40 hectares in Bai Thom commune, Phu Quoc city. Knowing that the land did not yet have a Certificate of Land Use Rights, she asked Mr. Mot for advice on whether it was possible to obtain the necessary documents. Mr. Mot said "it is possible" and introduced Hang to Ms. T. to handle the land paperwork.
Trusting Mr. Mot, who was then the leader of the Phu Quoc City Police, Ms. T. transferred nearly 22 billion VND to Hang between November 2021 and September 2022, but Hang did not fulfill her promise.
In addition, Ms. T. stated that she had given cash and gifts to Mr. Mot directly at his office on several occasions, totaling 3.5 billion VND and 10,000 USD; and transferred 800 million VND to Hang to lend to Mr. Mot.
During the process of obtaining a land use right certificate for Ms. T., Hang and Mot discovered that the actual area of the land was 3 hectares larger than the original land area. At this point, the defendants discussed and agreed to sell it to two men in Ho Chi Minh City for 11 billion VND.
Hang claimed that she withdrew the money in cash, giving Mr. Mot 7 billion VND in several installments and transferring it to him through various bank accounts.
The investigating agency determined that this was a case of fraud and misappropriation of assets, with the two defendants, Mot and Hang, directly committing the crime. Despite knowing that the land plots were forest land, managed by the state and therefore unsuitable for obtaining land use right certificates, the two defendants still sold the land and provided certificates to four victims, aiming to misappropriate nearly 66 billion VND.
In addition, the suspect Hang also committed fraudulent acts by falsely claiming to handle land documents and loans, then misappropriating money from 6 victims, totaling over 30 billion VND.
According to the investigation's conclusions, defendant Hang embezzled over 96 billion VND, while defendant Mot is jointly responsible with Hang for nearly 66 billion VND.
