Provincial People's Council delegates wonder why the number of economic cases is still low.

(Baonghean.vn) - Working with the People's Court and the Department of Civil Judgment Enforcement of Vinh City, members of the Legal Committee and the Provincial People's Council wondered why the number of cases of economic management order violations in the area is still low.

On the morning of September 21, the Provincial People's Council's Legal Committee, headed by Ms. Thai Thi An Chung, conducted a supervision at the People's Court and the Vinh City Civil Judgment Enforcement Office on the results of the trial and enforcement of cases of violations of economic management order. Attending the meeting was Mr. Tran Van Mao - Deputy Head of the Provincial National Assembly Delegation.

At the meeting, members of the monitoring delegation as well as representatives of the People's Court (PC) and the Civil Judgment Enforcement Department (CJE) of Vinh City focused on discussing the issue of the very small number of cases of economic management order violations in Vinh City from January 2015 to June 2017.

Among the cases in this field that have been accepted and handled, the majority are cases of trafficking in prohibited goods related to firecrackers; this raises the question: is it possible that crimes in this field do not occur or are they not detected by the authorities?

In addition, the handling of violations in the trade of fireworks is currently facing difficulties due to inconsistent legal guidance documents from all levels and sectors, causing difficulties for competent authorities to perform their duties.

Delegates also mentioned a number of other issues related to the content of supervision such as: The role of lawyers; advisory work for Party committees and functional branches on the fight against and prevention of crimes that violate economic management order; the level and effectiveness of coordination with commune and ward authorities in ensuring the validity of judgments; the situation of paying court fees to related subjects...

Responding to the issues raised, Mr. Tran Anh Sang - Chief Justice of Vinh City People's Court said that many district levels have not received official dispatches updating regulations on handling cases of violating economic management order, specifically the crime of trading in explosives, leading to inconsistencies between levels in handling cases.

Providing specific figures, Mr. Sang said that every year, Vinh City People's Court handles over 2,150 cases of all kinds. For cases of economic management violations, from January 2015 to June 2017, the court accepted 18 cases, 24 defendants.

Of these, 16 cases, 21 defendants were charged with trading in prohibited goods; 2 cases, 3 defendants were charged with illegally trading in invoices. The court tried 12 cases, 15 defendants, returned 5 cases, 8 defendants for additional investigation for trading in prohibited goods, and temporarily suspended 1 case, 1 defendant for trading in cigarettes.

Mr. Dang Van Hai - Head of the Vinh City Economic Enforcement Office said that every year the office executes about 3,000 cases with about 5 trillion VND, accounting for 15 - 20% of the province's economic cases.

However, cases of economic management order violations account for a very small proportion. Specifically, from January 2015 to June 2017, the unit completed 5 cases with a fine of 2.5 million VND; entrusted the execution of 4 cases; is preserving evidence of 8 cases, of which 5 cases are related to firecrackers with more than 74kg of firecrackers; has handled more than 156kg of firecrackers and some other evidence in a total of 9 received judgments.

Regarding the problems in the execution of judgments in cases of violations of economic management order, Mr. Dang Van Hai added that currently, some evidences have not been allowed to be processed, including firecrackers, because the Vinh City People's Court has suspended them according to the provisions of the guiding documents.

At the meeting, Mr. Tran Van Mao - Deputy Head of the Provincial National Assembly Delegation received feedback on inadequacies related to policies and legal documents that agencies reported to make recommendations to relevant agencies.

At the end of the meeting, Ms. Thai Thi An Chung requested Vinh City People's Court to further improve the initiative and quality of trial of cases; pay attention and closely coordinate with relevant units and localities in resolving cases that have returned files for additional investigation.

Ms. An Chung also requested the THADS Department to pay more attention and handle more promptly the enforcement of cases of violations of economic management order.

Regarding the recommendations of the agencies at the meeting, the Legal Committee, Provincial People's Council will synthesize, reflect, and advise relevant competent agencies... to help the agencies improve the quality of trial and execution of cases of violation of economic management order in Vinh City./.
