National Assembly delegates from Nghe An province proposed solutions for specialized agencies under provincial and district People's Committees to operate immediately after the reorganization.
On the morning of February 14, continuing the program of the 9th Extraordinary Session, the 15th National Assembly discussed in the hall the draft Resolution regulating the handling of a number of issues related to the reorganization of the State apparatus.

Speaking at the discussion, Mr. Tran Nhat Minh - full-time National Assembly member of Nghe An delegation agreed with the majority of opinions in the National Assembly's Law Committee to propose that this Resolution take effect the day after the National Assembly passes it to create a legal basis as soon as possible for agencies from the central to local levels to carry out the arrangement and assignment of functions, tasks, and powers, ready to come into operation immediately from the time of the decision of the competent authority on the arrangement of the State apparatus.

For example, currently, to carry out the task of deciding on the establishment and abolition of specialized agencies under the People's Committees according to the provisions of the Law on Organization of Local Government, the People's Councils at the provincial and district levels must issue resolutions, but in terms of legal basis, the Government's decrees on the organization of specialized agencies under the People's Committees at the provincial and district levels are still legally effective and have not been amended or supplemented according to the new organizational model; therefore, to apply the documents of the Steering Committee on summarizing the implementation of Resolution No. 18 of the Government supplementing and perfecting the plan for the arrangement of specialized agencies of the People's Committees at the provincial and district levels, we must wait for this Resolution of the National Assembly to be issued.

Therefore, delegate Tran Nhat Minh said that if the effective date of this Resolution is March 1, 2025 as in the draft, it is late and does not meet the purpose of developing the resolution as stated in the Government's Submission: The issuance of the Resolution aims to create a legal basis for implementing the reorganization of the apparatus of State agencies from the central to local levels; thereby promptly handling issues arising when implementing the reorganization of the State apparatus; avoiding legal gaps in the condition that it is not possible to amend and supplement a very large number of legal documents.

Furthermore, according to the delegate of Nghe An, the regulation of the early effectiveness of this Resolution is also consistent with the direction of the Steering Committee on summarizing Resolution No. 18 of the Government in Official Dispatch No. 05, dated January 12, 2025, that immediately after the closing session of the National Assembly, the Provincial Party Committee and the Provincial People's Committee shall announce decisions on the organization of specialized agencies under the Provincial and District People's Committees to operate immediately, without legal gaps, continuously, effectively and efficiently.

Also in this morning's session, the National Assembly listened to the submission and review report on special mechanisms and policies for investment in the construction of the Ninh Thuan nuclear power project. The National Assembly also discussed in the hall the draft Law on Government Organization (amended). Minister of Home Affairs Pham Thi Thanh Tra spoke to explain and clarify a number of issues raised by National Assembly deputies.
