National Assembly delegates from Nghe An discuss the draft Law on Credit Institutions (amended)

Speaking at the discussion, Mr. Hoang Minh Hieu - Standing Member of the National Assembly's Law Committee, delegate of Nghe An delegation, suggested that the Drafting Committee review and study the experiences of other countries and legalize the regulations that have been applied stably in sub-law documents to supplement the draft, creating a solid legal framework for credit institutions in digital transformation activities, especially serving the construction of digital banks.
The delegate from Nghe An also said that it is necessary to study and strengthen the regulations on the controlled testing mechanism, because this is an extremely important regulation to create a basis for promoting innovation and creativity in banking activities, which is highly anticipated by credit institutions as well as financial technology companies.

Delegate Hoang Minh Hieu proposed to consider adjusting the contents related to regulations on organization, administration and management of credit institutions in the Law on Credit Institutions in the direction of applying general regulations on organization, administration and management of credit institutions as stipulated in corresponding laws such as: Law on Enterprises, Law on Cooperatives, Law on Securities. The Law on Credit Institutions only stipulates specific requirements for credit institutions on related contents.
Discussing the draft Law on Credit Institutions (amended), Mr. Tran Nhat Minh - full-time delegate of the National Assembly Delegation of Nghe An expressed his high agreement with the assessment of the National Assembly's Economic Committee in the Full Verification Report.
Resolution No. 42 on piloting bad debt settlement of credit institutions is a pilot resolution issued in the context of high, complicated and concentrated bad debt of credit institutions in a certain period of time.
Therefore, the legalization of the provisions of Resolution No. 42 needs to be carefully and cautiously evaluated, in the context of current legal provisions that have been completed more clearly and completely.
It is necessary to comprehensively and objectively assess the current context and requirements for bad debt handling, thereby perfecting regulations, ensuring the legitimate rights and interests of the parties, avoiding administrativeization of civil and economic relations, ensuring harmony and fairness with the subjects participating in civil and economic relations on the principle of only legalizing appropriate contents under normal conditions.

Delegate Tran Nhat Minh suggested that the drafting agency should study regulations on the responsibilities of the civil litigation and enforcement agencies in supporting credit institutions when requested to determine the status of collateral assets in order to seize collateral assets.
At the same time, consider regulating the determination of the right to seize and procedures for seizing assets in accordance with the provisions of law, avoiding legal conflicts leading to infeasibility and difficulties in the process of law application.
Delegate Tran Nhat Minh also requested that the drafting agency study and add a separate chapter or section regulating the operations of policy banks in the draft Law on Credit Institutions (amended).
Earlier, in the morning of the same day, the Nghe An National Assembly Delegation discussed in Group 3 with the National Assembly Delegations of Bac Kan and Bac Lieu provinces about the draft Law on Citizen Identification (amended) and the draft Law on Telecommunications (amended).
The working session on June 10 also marked the completion of the first phase of work. The 5th session of the 15th National Assembly will continue working in the second phase from June 19 to June 24.
