Nghe An National Assembly Delegate: National Competition Authority needs to be independent

Contributing comments to the draft law, State Auditor General Ho Duc Phoc (Nghe An delegation)The Ministry of Industry and Trade must clarify how many unfair competition cases it has handled in the past 10 years and what are the real problems in the implementation process to see whether it is necessary to issue the Competition Law (amended) or not.
Mr. Ho Duc Phoc also expressed concern that the draft Law on Competition (amended) has points of conflict with many specialized laws such as the laws on Public Investment, Bidding, and Prices.
Citing Article 29 of the draft Law on Competition (amended) on acts that prohibit enterprises and groups of enterprises with dominant market positions from performing acts such as: "Imposing unreasonable purchase prices, selling prices of goods and services or setting minimum resale prices that cause or may cause damage to customers", delegate Ho Duc Phoc asked: what is "unreasonable"?
Because according to this delegate, the Law on Prices stipulates that determining product prices is the right of enterprises, they only have to publicly list prices. Therefore, according to delegate Phuc, this Law project needs to be carefully considered in order to be effectively implemented.
Delegate Nguyen Van Chi - Standing Member of the National Assembly's Finance and Budget Committee (Nghe An delegation) assessed that the draft Law on Competition (amended) opens up the legal aspect to regulate acts outside of Vietnam's territory but negatively affects and impacts competition in the Vietnamese market.
However, according to this delegate, the draft Law only includes this content in the scope of regulation but does not provide specific provisions to regulate these behaviors. "So can the goal of handling this limitation be handled?" - delegate Van Chi wondered.
Delegate Hoang Thi Thu Trang (Nghe An delegation) proposed that the draft Law on Competition (amended) must clearly stipulate the legal status, functions, tasks, and organizational structure of the National Competition Authority.
“In my opinion, to ensure independence and avoid the situation of both playing football and blowing the whistle, the National Competition Authority should have an independent position under the Government, not under the Ministry of Industry and Trade,” said delegate Trang.
