How is agricultural land used by individuals regulated in the 2024 Land Law?
Mr. Hoang Van Hai, residing in Tan Ky district, asked: What types of agricultural land are used by individuals? And how is it regulated in the 2024 Land Law?
Reply:
Article 178 of the 2024 Land Law stipulates:
1. Agricultural land used by individuals includes agricultural land allocated, leased, or recognized by the State for land use rights; land leased from other land users; land converted, transferred, inherited, or donated according to the provisions of law.

2. The use of agricultural land allocated by the State to individuals is regulated as follows:
a) Individuals who have been allocated land by the State before the effective date of this Law shall continue to use it in accordance with the provisions of this Law;
b) For localities that have not yet allocated land to individuals according to the provisions of the law on land, the People's Committee of the commune where the land is located shall develop a land allocation plan and request the People's Committee of the district to decide on land allocation;
c) For localities where People's Committees at all levels have guided households and individuals to negotiate land adjustments with each other during the implementation of land policies and laws before October 15, 1993 and are using them stably, they may continue to use them.

3. Agricultural land users are allowed to convert crop and livestock structures to use land for multiple purposes as prescribed in Article 218 of this Law; and are allowed to use an area of land as prescribed by the Provincial People's Committee to build facilities directly serving agricultural production.
In case of using land for rice cultivation, it shall be implemented according to the provisions of Article 182 of this Law.
