Proposal to prosecute Ms. Nguyen Thi Thanh Nhan in the bidding case at VNCERT

With the request for prosecution for the crime of "Violating bidding regulations causing serious consequences" in the bidding case at the VNCERT center, this is the 5th case in which Ms. Nguyen Thi Thanh Nhan has been criminally prosecuted.

The Ministry of Public Security's Investigation Police Agency has just issued the Investigation Conclusion of the case.Violation of bidding regulations causing serious consequencesoccurred at the Vietnam Computer Emergency Response Center (VNCERT) under the Ministry of Information and Communications, International Progress Joint Stock Company (AIC) and related units.

Nguyen Thi Thanh Nhan (Chairwoman of the Board of Directors of AIC Company) was proposed to be prosecuted for the crime of "Violating bidding regulations causing serious consequences." This is the 5th case in which Ms. Nguyen Thi Thanh Nhan has been criminally prosecuted.

In addition, the defendants Do Van Son (former head of project management board 2 of Tien Bo International Joint Stock Company), Nguyen Trong Duong (former deputy head of the Department of Financial Planning, Ministry of Information and Communications, former director of VNCERT), Ngo Quang Huy (former deputy head of the Office of the Ministry of Information and Communications, former deputy director of VNCERT) were also proposed to be prosecuted for the above crime.

According to the conclusion of the Investigation Police Agency, right from the project establishment stage, Nguyen Thi Thanh Nhan assigned Nguyen Van The, Head of Economic Department 7, to coordinate with VNCERT to build a list of equipment and software expected to be purchased and set the output price.

In which, because the initial plan introduced by AIC Company was a system using Israeli technology with high price, not compatible with VNCERT's available equipment, Nguyen Trong Duong, former Director of VNCERT (then Deputy Director of the Department of Financial Planning, Ministry of Information and Communications) assigned Ngo Quang Huy, Deputy Director to preside over and direct VNCERT's departments together with Mai Phuong Nam, Deputy Director of Khang Phat Company to survey the current situation, collect equipment procurement needs to review the list of investment needs (with a scale of less than 100 billion VND) and report to the leaders of the Ministry of Information and Communications.

After the Ministry of Information and Communications approved the contractor selection plan, Mai Phuong Nam, together with Nguyen Trong Duong and Ngo Quang Huy, drafted the construction design and total estimate with the equipment list in accordance with the list agreed upon with AIC Company...

From there, in order to agree on the estimated price with the project investor, ensuring that AIC Company gets a profit of 40% and is oriented to be the unit that will win the bid to supply equipment.

After the investor implemented the steps to request approval and legalize the consulting steps based on the list and equipment prices agreed between AIC Company and the investor, Nguyen Thi Thanh Nhan continued to direct Do Van Son to set up a "blue team" and "red team" to bid.

This is aimed at helping AIC Company win package number 8 (investment in purchasing equipment and software).

The Investigation Police Agency determined that the actions of defendant Nguyen Thi Thanh Nhan and her accomplices caused damage to state property of more than 17 billion VND.

Nguyen Thi Thanh Nhan is still on the run and wanted. In addition to the above case, Nguyen Thi Thanh Nhan has been sentenced to a total of 30 years in prison for violations of bidding regulations and bribery in Dong Nai, Ho Chi Minh City, Quang Ninh.../.
