Proposal to sentence female bank director to death for embezzling 2,600 taels of gold

Ms. Oanh brought in a family member to become the leader of the Ben Thanh branch of Agribank, which she managed, and then colluded to withdraw 2,600 taels of gold and appropriate it.

On December 11, the trial of Nguyen Thi Hoang Oanh (57 years old, former director of Agribank Ben Thanh, District 1) and 11 accomplices entered the debate phase. The defendants were prosecuted for a series of crimes: Embezzlement of property, Fraudulent appropriation of property, Giving and receiving bribes, Violating regulations on lending in the operations of credit institutions.

Expressing his opinion on the case, the People's Procuracy said that Oanh took advantage of her position and used her family members to hold leadership positions in the bank to easily connect with the bank to borrow gold and then embezzle it.

In order to conceal his actions, the defendant used many legal entities under the names of his relatives, entered false names of customers to sign loan contracts to withdraw gold at maturity, causing great losses to the bank. The defendant also persuaded subordinates to disregard the law to commit his wrongdoings, infringing on state assets.

In addition, Oanh also took advantage of her position as director to approve contracts that did not meet the conditions for lending to customers, leading to the loss of a large amount of money for the bank.

From there, the People's Procuracy proposed applying the death penalty to the former female director for the crimes of embezzlement, bribery, and violation of lending regulations in the operations of credit institutions.

For the six defendants who were Oanh's subordinates and committed the crime as accomplices, the People's Procuracy proposed a sentence of 11 to 30 years in prison. "The defendants were assigned to manage bank assets, but because of their corruption, they falsified documents and helped Oanh appropriate bank assets, so they need to be severely punished," the People's Procuracy stated.

Next, defendant Le Van Tinh (55 years old, director of Kim Gia Thuan Company Limited) was identified as the mastermind in the fraud of appropriating more than 5,600 taels of gold from Agribank. According to the prosecution, to appropriate this amount of gold, Tinh accepted the condition that Oanh would receive a large profit in his contract.

In addition, Tinh also established many fake companies in the names of his relatives to continue borrowing money from banks to pay off debts for previous contracts.

The People's Procuracy determined that the prosecution of Tinh and his accomplices was correct and proposed that the People's Court sentence them to life in prison for the crime of Fraudulent appropriation of property and 14-16 years in prison for the crime of Bribery.

In connection with the case, Tinh's wife and children were recommended to be sentenced to 4-5 years in prison for the crime of Fraudulent appropriation of property.

According to the accusation, in 2008-2009, during her term in office, Oanh used the names of 8 individuals to create fake documents to borrow 2,660 taels of gold (47 billion VND) to buy a house on Nguyen Quang Khai Street (District 1) and then put her daughter in the name of the house. She rented it to Agribank for 5,800 USD per month to open the Far East Transaction Office and received a total of more than 5.6 billion VND from the bank.

Oanh instructed her brother-in-law Truong The Thanh (head of the credit department) to use the legal entity of Huynh Ngoc Thach (Oanh’s son-in-law) and several other businesses to continue borrowing gold from Agribank. Director Oanh used this gold to pay off the debt when the previous loan was due. When the case was prosecuted, she still owed 44 billion VND.

In addition, Ms. Oanh also approved a loan of 13 billion VND for her brother-in-law to invest in real estate without any collateral. When the loan was due, Thanh used the name of a relative to continue borrowing to pay off the debt. During the investigation, he died of a serious illness, so the Supreme People's Procuracy suspended the investigation.

The prosecution determined that Ms. Oanh approved Tinh’s company to borrow 5,600 taels of gold from Agribank and then appropriated it. Although the company did not meet the conditions, Oanh still agreed to lend money.

Using this trick, Oanh received a bribe of nearly 25 billion VND in the difference when converting gold to money.

During the trial, Oanh admitted all her crimes. Mr. Tinh said he did not know that Oanh had embezzled the difference when borrowing gold from Agribank.
