Proposing policies to support additional cadres, civil servants, and non-professional workers who are redundant due to the merger of commune and district levels in Nghe An

In addition to the support policies under current State regulations, Nghe An province is seeking opinions to issue additional support policies for cadres, civil servants, public employees, workers, and part-time workers who are redundant due to the rearrangement of administrative units at district and commune levels.

Accordingly, the drafting agency, the Department of Home Affairs, proposes that for cadres, civil servants, public employees, and workers (labor contracts according to Decree 111/2022/ND-CP dated December 30, 2022 of the Government) at district and commune levels who are redundant when rearranging administrative units at district and commune levels and have been approved by competent authorities to retire, in addition to the regime and policies on staff reduction enjoyed according to current law provisions, they will be provided with additional support as follows:

3 months of current salary for each year of early retirement in case of early retirement; 1 month of current salary for each year of work with social insurance contributions in case of immediate termination of employment; 1 month of current salary for each year of work for district- and commune-level cadres, civil servants and public employees who are enjoying retirement benefits.

As for non-professional workers, Standing Committee members of the Vietnam Fatherland Front, Standing Committee members of commune-level mass organizations who are redundant when arranging commune-level administrative units and have been approved by competent authorities to retire, in addition to the regimes and policies enjoyed according to current law provisions, it is proposed to provide additional support as follows:

Part-time commune-level workers are supported once according to their working time, specifically: each working year is equal to 1 month of current allowance (maximum support not exceeding 15 months).

Standing members of the Vietnam Fatherland Front and standing members of commune-level mass organizations are supported one time with an amount of VND 2,500,000/person.

The above proposed policies do not apply to those who have been notified of retirement; cadres who do not meet the age requirements for re-election, reappointment, or retirement as prescribed in Decree No. 26/2015/ND-CP.

The drafting agency is proposing four implementation principles, according to which in the case of holding multiple positions, support will only be given to the position with the highest level of support.

The support period is calculated according to the principle that from 1 month to 6 months is counted as 1/2 year; from 6 months to 12 months is counted as 1 year.

Working time to calculate support is total working time, if interrupted, it is accumulated.

Current salary includes: position salary or salary according to rank or level; position allowances, seniority allowances beyond the framework, seniority allowances, salary retention difference, party work allowances (if any).

Nghe An Provincial People's Council has passed a Resolution on approving the policy of arranging commune-level administrative units in Nghe An province, period 2023 - 2025 and a Resolution on approving the policy of expanding administrative boundaries and urban space of Vinh city, establishing wards and arranging commune-level administrative units in Vinh city, Nghe An province.

Based on the above Resolutions of the Provincial People's Council, the Department of Home Affairs advised the Provincial People's Committee to complete the dossier of the Project on rearranging administrative units at district and commune levels and send it to the Ministry of Home Affairs for appraisal and submission to the Government to report to the National Assembly Standing Committee for consideration and decision in the coming time.

According to the Project on reorganizing district and commune-level administrative units in the 2023-2025 period, Nghe An province will reorganize 92 commune-level administrative units (65 unqualified units and 27 adjacent qualified units) into 44 units (including 43 newly established units and 1 administrative unit with partial adjustment of natural area and population).

In addition, Nghe An will expand the administrative boundaries and urban space of Vinh by merging the entire town of Cua Lo and 4 communes of Nghi Loc district (Nghi Xuan, Nghi Thai, Phuc Tho, Nghi Phong).

According to statistics, the number of cadres and civil servants in communes, wards and towns subject to rearrangement and adjoining areas alone is 1,712 (885 cadres and 827 civil servants). According to regulations, it is expected that 913 cadres and civil servants will be arranged (514 cadres and 399 civil servants) in 43 commune-level administrative units formed after the rearrangement. Thus, after arranging cadres and civil servants in new communes according to regulations, there will be a surplus of 799 people (374 cadres and 425 civil servants).
