Proposal to adjust the fee for appraisal of land title applications
(Baonghean.vn) - On the morning of June 8, the Legal Committee of the Provincial People's Council conducted a field survey at the Office of Land Use Rights Registration, Department of Natural Resources and Environment on the issuance of Certificates of land use rights, house ownership rights and other assets attached to land in Nghe An province.

At the meeting, Director of the Office of Land Use Rights Registration, Mr. Vo Van Son proposed that the Provincial People's Council and People's Committee adjust the fee for appraisal of granting Land Use Rights Certificates as prescribed in Resolution No. 47/2016/NQ - HDND dated December 16, 2016 (Resolution 47).
This is a resolution regulating fees for appraising dossiers for granting Land Use Right Certificates; fees for exploiting and using land documents; fees for granting Land Use Right Certificates, House Ownership Rights, and Property Attached to Land in Nghe An province.
Regarding the fee for appraising the application for a land use right certificate, Resolution 47 stipulates: the fee for the first issuance of a land use right certificate for households and individuals is 230,000 VND/application, for organizations is 1.6 million VND/application; the fee for changing or reissuing a land use right certificate for households and individuals is 200,000 VND/application, for organizations is 255,000 VND/application; and the fee for confirming changes on the land use right certificate for households and individuals is 100,000 VND/application, for organizations is 220,000 VND/application.
Mr. Son analyzed the reason for the proposed adjustment is due to the reality of granting land use right certificates. Currently, each organization only submits one set of documents, but there are organizations that have to grant many land use right certificates, such as real estate companies.
But in reality, the unit is only allowed to collect fees on the number of documents as prescribed, not on the number of land use right certificates, so it is not enough to cover the cost of appraisal and issuance of land use right certificates to ensure balance. Also at the meeting, the head of the Land Use Registration Office proposed that the Provincial People's Council and People's Committee direct the District People's Committee to pay attention to directing the District Land Use Registration Office to seriously carry out the work of updating and correcting cadastral records according to regulations.
Mr. Son also suggested that the Provincial People's Council and People's Committee allocate funding and promptly implement the work of building a land database for Nghe An province.
According to the regulations of the Provincial People's Committee, in the case of granting a Certificate of Land Use Rights associated with new land allocation or land lease, the implementation time shall not exceed 20 days, a reduction of 10 days compared to the regulations; in the case of granting a Certificate of Land Use Rights associated with recognition of land use rights or land lease of organizations currently using the land, the implementation time shall not exceed 20 days, a reduction of 10 days compared to the regulations; in the case of granting a Certificate of Land Use Rights associated with land allocation or land lease for investment project implementation, the implementation time shall not exceed 7 days, a reduction of 23 days compared to the regulations.
The survey shows that at the Land Use Rights Registration Office, the reception and processing of administrative procedures related to the application for granting certificates and registering changes are all guaranteed to be on time and most of the processing time is shortened compared to regulations.
During the period from 2015 to April 30, 2018, this unit received 1,322 applications, of which 1,293 were processed before the deadline, 29 were processed on time, and no applications were processed past the deadline.

Concluding the meeting, Ms. Thai Thi An Chung - Deputy Head of the Legal Committee of the Provincial People's Council acknowledged that the unit has paid attention to shortening the processing time of administrative procedures related to land issues; adjusting changes in land records; and archiving work is quite scientific and clear.
The Deputy Head of the Legal Department of the Provincial People's Council also requested the unit to pay more attention to granting land use right certificates to organizations; strengthen coordination with relevant agencies to handle land records; guide and inspect the work of updating and adjusting changes in land records at the district level...
