(Baonghean.vn) - The National Assembly delegation of Nghe An province held a conference to collect comments on the draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations, on the morning of September 10.

Commenting on the draft Law, delegates said that the construction of the Law amending and supplementing a number of articles ofLaw on Handling of Administrative Violationsto continue to improve mechanisms, policies, procedures and processes in the law on handling administrative violations and to overcome as much as possible the limitations and shortcomings in the provisions of the Law on Handling Administrative Violations, contributing to ensuring the effectiveness and efficiency of law enforcement on handling administrative violations in practice, ensuring security, order and social safety.

At the conference, delegates discussed many issues such as: Principles of administrative sanctions; subjects of administrative sanctions; consistency in the legal system; statute of limitations for administrative sanctions; time limit for enforcement of administrative sanctions decisions; issues of enforcement of administrative sanctions decisions; confiscation of exhibits and means of administrative violations...

Regarding the issue of increasing authority and fines in handling administrative violations, Lieutenant Colonel Nguyen Nam Hong - Deputy Head of the Traffic Police Department of the Provincial Police said that according to the draft at Point d, Clause 1, Article 24 of the amendment, the maximum fine for the fields of road, railway, and inland waterway traffic is 75 million VND. It is proposed to increase it to 80 million VND to suit the practical work and the authority of the person making the current decision to impose fines. Specifically, the Director of the Provincial Police Department has the right to impose 50% of the maximum fine for the corresponding field, equivalent to 37.5 million VND (according to the draft amended Law); the Head of the Traffic Police Department is 20%, equivalent to 15 million VND.

In addition, delegates focused on discussing a number of issues on additional public service, additional penalties; disciplinary sanctions according to the law on cadres, civil servants, and public employees; issues of witnesses, confiscation of vehicles, evidence of violations, appraisal of evidence, detention time...
