Proposal for 4th subscriber without signing contract with network operator

The regulation requiring a contract with network operators when using a fourth SIM card is ineffective, according to the regulator.

According to the revised regulations in Decree 49/2017, for the first three prepaid mobile phone numbers, the subscriber only needs to provide information and sign the declaration. However, for the fourth or more subscriber numbers, the user must sign a standard contract with the network operator for each subscriber number. This regulation is considered a soft measure to limit businesses from deliberately falsifying subscriber information and activating prepaid SIM cards as has been the case for a long time.

However, in the draft amendment to Decree 49 that was recently released for comments, the Ministry of Information and Communications said that this provision does not really bring about the desired effect. The Ministry also said that the Constitution does not limit the number of SIM cards an individual can register to use.

Currently, mobile users who register for a 4th SIM card will have to sign a contract with the network operator.

"Moreover, in reality, the limitation by signing a contract is not effective because businesses cannot control users transferring the right to use without re-signing the contract," the agency said.

This Ministry also gave an example of contracts that initially used more than 100 SIM cards, but later the user transferred the rights to 20 SIM cards and neither the transferor nor the transferee signed again, so the business could not know.

With that view, in the draft new decree to replace Decree 49, the Ministry of Information and Communications does not mention the provision limiting the number of SIM cards. However, this agency proposes prohibited acts when providing subscriber information.

Specifically, it is prohibited to forge or use identity documents or legal certificates of other individuals or organizations to enter into contracts. It is also not allowed to enter subscriber information or activate prepaid mobile services for SIM cards without completing the entry and storing of complete and accurate subscriber information.

In addition, buying, selling, and circulating pre-entered SIM cards with pre-activated prepaid mobile services is also a violation of the law.
