New points in the draft Regulation on early salary increase for cadres, civil servants, public employees and workers in Nghe An
(Baonghean.vn) - Currently, the draft of this Regulation is in the process of collecting comments and is expected to be submitted to the People's Committee of Nghe An province for consideration and decision at the meeting in May 2023 for promulgation.
The draft regulation has changes compared to the content in Official Dispatch No. 1095/SNV-CCVC dated September 3, 2013 guiding the implementation of Circular No. 08/2013/TT-BNV on salary increase regime for cadres, civil servants and public employees of the Department of Home Affairs related to achievement level, priority order and adding the method of calculating the number of people in the rate of salary increase before the deadline.

The draft Regulation is being consulted to develop detailed minimum achievement levels corresponding to the time of early salary increase. Specifically:
1. Consider salary increase 12 months ahead of schedule for cadres, civil servants, public employees and workers who achieve at least one of the following titles and achievements:
a) Gold Star Order; Ho Chi Minh Order; Independence Order of all classes; Labor Order of all classes.
b) State honorary titles: Hero of Labor; People's Teacher; Meritorious Teacher; People's Physician; Meritorious Physician; People's Artisan; Meritorious Artisan; People's Artist; Meritorious Artist;
c) Ho Chi Minh Prize; State Prize;
d) Certificate of Merit from the Prime Minister.
d) Title of National Emulation Fighter.
2. Consider salary increase 9 months ahead of schedule for cadres, civil servants, public employees and workers who achieve at least one of the following titles and achievements:
a) Received a Certificate of Merit from the Chairman of the Provincial People's Committee and the Standing Committee of the Provincial Party Committee for performing duties.
b) Received a Certificate of Merit from the Head of a Central Ministry, Department, Branch, or Organization, Chairman of the Provincial People's Committee, or the Provincial Party Executive Committee for a period of 5 years or more.
c) Received an extraordinary Certificate of Merit from the Head of a Central Ministry, Department, Branch, or Organization, the Chairman of the Provincial People's Committee, or the Provincial Party Executive Committee (or according to a topic with a period of less than 5 years) and during the period of holding the salary level, achieved the title of Emulation Fighter at the grassroots level for 1 year.
c) Title of Provincial Emulation Fighter.
d) The Chairman of the Provincial People's Committee awarded a Certificate of Merit to those assigned to directly train, educate, teach, and coach individuals who won the Encouragement Prize (or equivalent) or higher in international, regional, national, and national competitions; during the time holding the title of Advanced Worker.
3. Salary increase 6 months ahead of schedule for civil servants, public employees and workers who achieve at least one of the following titles and achievements:
a) Having 2 years of being awarded the title of Emulation Fighter at the grassroots level (or the Head of the specialized agency and equivalent under the Provincial People's Committee, the Chairman of the District People's Committee awarded the Certificate of Merit), the remaining years during the salary grade holding period achieving the title of Advanced Worker in the case of a salary increase cycle of 3 years/grade.
Awarded the title of Emulation Fighter at the grassroots level for 1 year (or the Head of a specialized agency and equivalent under the Provincial People's Committee, the Chairman of the District People's Committee awards a Certificate of Merit); in the remaining years during the salary grade, the title of Advanced Worker is achieved in the case of a salary increase cycle of 2 years/grade.
b) Received a Certificate of Merit from the head of the provincial union, and achieved the title of Advanced Worker in the remaining years of holding the salary grade.
c) Receive a Certificate of Merit from the Chairman of the Provincial People's Committee for those assigned to directly train, educate, teach, and coach individuals who won First Prize (or equivalent) in provincial-level competitions; during the time holding the title of Advanced Worker.
In addition, Official Dispatch No. 1095 of the Department of Home Affairs currently stipulates:
-Advance the deadline by 12 months for cadres, civil servants, public employees and workers who have achieved one of the following forms of commendation: Medals of all ranks, National Emulation Fighter, Certificate of Merit from the Prime Minister or higher.
- Advance the deadline by 9 months for cadres, civil servants, public employees and workers who achieve one of the following forms of reward: Provincial Emulation Fighter or equivalent title; awarded a Certificate of Merit by a central ministry, branch or the Provincial People's Committee.
- Advance 6 months ahead of schedule: For cadres, civil servants, public employees and workers with a 3-year salary cycle/level achieving one of the following forms of commendation: 2 times achieving Emulation Fighter at the grassroots level or equivalent title; 2 times being awarded Certificates of Merit by the Director of the Department, Department-level agency; Chairman of the People's Committee of districts, cities, towns; Heads of public service units under the Provincial People's Committee; and for cadres, civil servants, public employees and workers with a 2-year salary cycle/level achieving one of the following forms of commendation: 1 time achieving Emulation Fighter at the grassroots level or equivalent title; 1 time being awarded Certificates of Merit by the Director of the Department, Department-level agency; Chairman of the People's Committee of districts, cities, towns; Heads of public service units under the Provincial People's Committee.
The Draft Regulation also specifies priorities in considering early salary increase, including:
1. In case the number of people qualified for early salary increase due to excellent achievements is greater than the prescribed rate, priority will be given to those with higher achievements; if the highest achievements are equal, other achievements will be considered.
2. In case cadres, civil servants, public employees and workers have the same achievements, priority will be given according to the regulations on early salary increase of the agency or unit. Agencies and units shall base on the actual situation of their agency or unit and on the basis of the following priority regimes to develop an appropriate order of priority:
a) Cadres, civil servants, public employees, and workers with excellent achievements who were considered for early salary increase in the previous period, but have not been increased due to no more quotas.
b) Officials, civil servants, public employees, and workers who are older or have more years of work experience.
c) Cadres, civil servants, public employees and workers whose scientific research works and innovative initiatives in their work have been applied and brought about clear results (recognized by the Provincial Science Council or competent authority);
d) Cadres, civil servants, public employees and workers who have not had their salary increased ahead of schedule or whose salary is still low.
e) If cadres, civil servants, public employees and workers do not have their salary increased before the deadline, they will no longer be eligible (having enjoyed the last salary level) to have their salary increased before the deadline.
g) Female cadres, civil servants, public employees and workers.
h) Cadres, civil servants, public employees, and workers who are ethnic minorities, border, island, mountainous, remote, and isolated areas.
3. In case the achievements and priority order are still the same, the Council for considering early salary increase will consider and decide.
Current Official Dispatch No. 1095 stipulates:In agencies and units with many people who have made outstanding achievements in the process of performing their duties, early salary increases should be prioritized for those who are about to retire, those who have not received early salary increases during their work, those whose salary relationship is still disadvantaged, etc.
The Draft Regulation also specifically stipulates how to calculate the number of people eligible for early salary increase; meanwhile, Official Dispatch No. 1095 does not mention this content.
Therefore, on the basis of current legal regulations, the Department of Home Affairs advises the Provincial People's Committee to issue the Regulation on early salary increase for cadres, civil servants, public employees and workers of Nghe An province, which is necessary and in accordance with its authority.
