STATUTES OF THE COMMUNIST PARTY OF VIETNAM

(Adopted by the 11th National Congress of the Party on January 19, 2011)

The Party and fundamental issues concerning Party building.

The Communist Party of Vietnam, founded and nurtured by Comrade Ho Chi Minh, led the people to successfully carry out the August Revolution, establishing the Democratic Republic of Vietnam (now the Socialist Republic of Vietnam), defeating wars of aggression, abolishing colonial and feudal regimes, completing the cause of national liberation and reunification, carrying out the renovation process, building socialism, and firmly defending the independence of the Fatherland.

The Communist Party of Vietnam is the vanguard of the working class, and at the same time the vanguard of the working people and of the Vietnamese nation; it faithfully represents the interests of the working class, the working people, and the nation.

The Party's goal is to build an independent, democratic, prosperous, and just Vietnam, a civilized society free from exploitation, successfully implementing socialism and ultimately communism.

The Party takes Marxism-Leninism and Ho Chi Minh Thought as its ideological foundation and guiding principle for action, promoting the fine traditions of the nation, absorbing the intellectual essence of humanity, grasping objective laws, the trends of the times, and the realities of the country to formulate a correct political platform and revolutionary line that is in line with the aspirations of the people.

The Party is a tightly-knit organization, unified in will and action, taking democratic centralism as its basic organizational principle, implementing collective leadership and individual responsibility, showing camaraderie, and maintaining strict discipline. At the same time, it adheres to the principles of self-criticism and criticism, unity based on the Party's Political Platform and Charter, close ties with the people, and operates within the framework of the Constitution and laws.

The Communist Party of Vietnam is the ruling party, respecting and promoting the people's right to self-governance, subject to the people's supervision; relying on the people to build the Party; uniting and leading the people in carrying out the revolutionary cause. The Party leads the political system, and at the same time is a part of that system. The Party leads, respects, and promotes the role of the State, the Vietnam Fatherland Front, and political and social organizations.

The Party combines genuine patriotism with the pure internationalism of the working class, actively contributing to the cause of peace, national independence, democracy, and social progress of the people of the world.

The Communist Party of Vietnam is built strong in politics, ideology, and organization, constantly renewing and rectifying itself, continuously improving the quality of its cadres and members, and enhancing the Party's fighting capacity and revolutionary leadership ability.

Chapter I

Party member

Article 1.

1. Members of the Communist Party of Vietnam are revolutionary fighters in the vanguard of the working class, the working people, and the Vietnamese nation, striving throughout their lives for the goals and ideals of the Party, placing the interests of the Fatherland, the working class, and the working people above personal interests; strictly adhering to the Political Platform, the Party Charter, the Party's resolutions, and the laws of the State; working diligently and fulfilling assigned tasks well; possessing sound morals and a healthy lifestyle; maintaining close ties with the people; obeying the Party's organization and discipline, and preserving unity within the Party.

2. Vietnamese citizens aged eighteen years and older who acknowledge and voluntarily implement the Party's Political Platform, Charter, standards and duties of Party members, and participate in a Party grassroots organization; and who, through practical experience, have proven themselves to be outstanding individuals trusted by the people, may be considered for admission to the Party.

Article 2.

Party members have the following duties:

1. To be absolutely loyal to the revolutionary ideals and goals of the Party, to strictly abide by the Party's Political Platform, Party Charter, resolutions and directives of the Party, and the laws of the State; to fulfill assigned tasks well; and to absolutely obey the Party's assignments and deployments.

2. Continuously study, train, and improve knowledge, work capacity, political qualities, revolutionary ethics, and maintain a healthy lifestyle; fight against individualism, opportunism, parochialism, bureaucracy, corruption, waste, and other negative manifestations. Abide by the Central Committee's regulations on what Party members are not allowed to do.

3. Maintain close contact with the people, respect and promote the people's right to self-governance; care for the people's material and spiritual well-being and protect their legitimate rights; actively participate in mass work and social work at the workplace and in the place of residence; propagate and mobilize family and the people to implement the Party's guidelines and policies and the State's laws.

4. Participate in building and protecting the Party's guidelines, policies, and organization; obey discipline and maintain unity within the Party; regularly engage in self-criticism and criticism, and be honest with the Party; work in developing Party members; participate in Party activities and pay Party dues as prescribed.

Article 3.

Party members have the right to:

1. To be informed and discuss issues related to the Party's Political Platform, Party Charter, guidelines, policies, and strategies; and to vote on Party matters.

2. Nomination, candidacy, and election of Party leadership bodies at all levels in accordance with the regulations of the Central Committee.

3. To criticize and question the activities of Party organizations and Party members at all levels within the organization; to report and make recommendations to responsible agencies and request responses.

4. Express your opinion when the Party organization reviews, makes decisions regarding your work, or imposes disciplinary measures against you.

Probationary party members have the above rights, except for the right to vote, to run for office, and to elect the Party's leadership bodies.

Article 4.

Procedures for admitting new party members (including readmission):

1. Those joining the Party must:

- There is a voluntary application to join the Party;

- Report your personal information truthfully to the Party branch;

- Recommended by two full party members.

In areas where the Ho Chi Minh Communist Youth Union is organized, young people joining the Party must be members of the Youth Union and be recommended by the grassroots Youth Union executive committee and a full Party member.

In agencies and enterprises where there is no Ho Chi Minh Communist Youth Union organization, those joining the Party must be trade union members, recommended by the grassroots trade union executive committee and a full Party member.

2. The referrer must:

- Must be a full party member and have worked with the person joining the party for at least one year;

- Report to the Party branch on the background, qualities, and abilities of the person applying for Party membership and take responsibility for your recommendation. If anything is unclear, report it to the Party branch and higher levels for consideration.

3. Responsibilities of the Party branch and Party committee:

- Before the Party branch considers and recommends admission, the Party committee checks the applicant's eligibility and seeks feedback from the mass organizations where the applicant is a member.

The issue of political history for those joining the Party must be handled according to the regulations of the Central Committee.

- The Party branch reviews and proposes the admission of each individual. When at least two-thirds of the official Party members in the branch approve, the proposal is submitted to the higher-level Party committee. Upon receiving the decision from the higher-level Party committee, the Party branch organizes an admission ceremony for each individual.

- The grassroots Party committee will review the case, and if at least two-thirds of its members approve the admission, it will propose the candidate to the next higher-level Party committee.

- The Standing Committee of the Party Committee at the immediate higher level of the grassroots Party organization, or the grassroots Party Committee authorized to do so, will consider and decide on the admission of each individual.

4. In areas where there are no Party members or where there are Party members but they do not meet the eligibility criteria for admission, the immediate superior Party committee shall send Party members to conduct propaganda work, consider and recommend candidates for Party membership. Special cases shall be regulated by the Central Committee.

Article 5.

1. Individuals admitted to the Party must undergo a twelve-month probationary period, starting from the date the Party branch holds the admission ceremony. During this probationary period, the Party branch continues to educate, train, and assign full Party members to assist the individual in their progress.

2. Upon completion of the probationary period, the Party branch shall consider each individual for full Party membership and vote as in the admission process; if an individual is deemed ineligible, a proposal shall be submitted to the competent Party committee to remove their name from the list of probationary Party members.

3. The Party branch's resolution proposing the recognition of a new Party member as a full member must be decided by the competent Party committee.

4. For officially recognized party members, their party membership seniority is calculated from the date stated in the admission decision.

Article 6.

The issuance and management of party membership cards, the management of party member records, and the procedures for transferring party membership are regulated by the Central Committee.

Article 7.

Party members who are elderly or in poor health may voluntarily request a reduction or exemption from party duties and activities, which will be considered and decided by the party branch.

Article 8.

1. Party members who skip branch meetings or fail to pay party dues for three months in a year without justifiable reason; party members whose fighting spirit has diminished, who do not fulfill their duties as party members, and who have not improved despite being educated by the branch, will be considered by the branch and recommended to the competent authority to have their names removed from the list of party members.

2. In the above cases, if a party member has a complaint, the party branch shall report it to the competent Party committee for consideration.

3. When a Party member requests to leave the Party, the Party branch will consider the request and propose it to the competent authority that approved their admission.

Chapter II

Principles of Party organization and organizational structure

Article 9.

The Communist Party of Vietnam is organized according to the principle of democratic centralism. The basic content of that principle is:

1. The Party's leadership bodies at all levels are established through elections, implementing collective leadership and individual responsibility.

2. The highest governing body of the Party is the National Congress of Delegates. The governing body at each level is the congress of delegates or the congress of Party members. Between two congresses, the governing body of the Party is the Central Committee, and at each level it is the executive committee of the Party branch or committee (referred to as the Party committee).

3. Party committees at all levels report to and are responsible for their activities before the congress at the same level, before higher-level and lower-level party committees; they periodically inform subordinate party organizations about their activities and practice self-criticism and criticism.

4. Party organizations and members must abide by the Party's resolutions. The minority must submit to the majority, subordinates must submit to superiors, individuals must submit to organizations, and all organizations within the Party must submit to the National Congress and the Central Committee.

5. Resolutions of the Party's leading bodies are only valid and enforceable when more than half of the members of that body approve them. Before voting, each member has the right to express their opinion. Party members whose opinions are in the minority have the right to reserve their views and report them to higher-level Party committees up to the National Congress of Delegates, but they must strictly abide by the resolution and are not allowed to disseminate opinions contrary to the Party's resolution. The competent Party committee shall study and consider such opinions; there shall be no discrimination against Party members whose opinions are in the minority.

6. Party organizations decide on matters within their scope of authority, but must not contradict the principles, guidelines, and policies of the Party, the laws of the State, and resolutions of higher levels.

Article 10.

1. The Party's organizational system is established in accordance with the State's administrative organizational system.

2. Party grassroots organizations are established at the grassroots level of administrative, public service, economic, or work units, under the leadership of the Party committee at the district, county, town, or city level within a province. Party organizations in the Vietnam People's Army and the Vietnam People's Police are regulated in Chapter VI. The establishment of Party organizations in areas with specific characteristics is regulated by the Central Committee.

3. The immediate superior Party committee decides on the establishment or dissolution of subordinate Party committees and branches.

Article 11.

1. The Party Committee convenes a congress at the end of its term, notifying subordinates in advance of the time and agenda of the congress.

2. The Party Committee convening the congress decides on the number of delegates and allocates them to subordinate Party committees based on the number of Party members, the number of subordinate Party committees, and the importance of each Party committee, in accordance with the guidelines of the Central Executive Committee.

3. Delegates to the congress include members of the executive committee at the level convening the congress and delegates elected by the lower-level congress.

4. The appointment of delegates is only permitted for Party organizations operating under special circumstances where it is impossible to hold a congress for elections, as stipulated by the Central Committee.

5. Delegates attending the congress must have their qualifications verified and be approved by a vote of the congress. The Party committee convening the congress may not reject the qualifications of delegates elected by the lower-level congress, except in cases where the delegate is suspended from Party activities, suspended from Party committee activities, or is being prosecuted, indicted, or detained.

6. A congress is only valid when at least two-thirds of the summoned delegates or party members are present, and at least two-thirds of the subordinate party organizations have delegates in attendance.

7. The congress elects the presidium (chairman) to preside over the work of the congress.

Article 12.

1. Party committee members must meet the standards regarding political qualities, revolutionary ethics, and a healthy lifestyle; strictly adhere to the principles of party organization and activities, party discipline, and state laws; possess the knowledge and capacity to participate in collective leadership and successfully complete assigned tasks; unite cadres and party members, and enjoy the trust of the masses.

2. The number of Central Executive Committee members is decided by the National Congress of Delegates; the number of committee members at each level is decided by the congress at that level, following the guidance of the Central Executive Committee. Party committees at all levels need to be renewed, ensuring continuity and development with each congress.

3. The Presidium (Chairman) guides the election:

- Delegates have the right to comment on and question candidates and nominees.

- The list of candidates is discussed and voted on by the congress.

- Elections will be held by secret ballot.

- The winning candidate must receive more than half of the total number of delegates summoned or more than half of the total number of official party members of the summoned party committee or branch.

If the number of candidates with more than half of the votes exceeds the number of positions to be elected, the candidate with the higher number of votes will be selected; if at the end of the list of elected candidates there are many candidates with equal votes and more than the number of positions to be elected, a re-election will be held to select the candidate with the higher number of votes, which does not need to exceed half. If the re-election results in an equal number of votes, the congress will decide whether or not to hold another election.

If the required number of votes is not reached in the first round, the general assembly will decide whether or not to hold another round.

Article 13.

1. The newly elected Party Committee receives the handover from the previous Party Committee, takes over the work immediately after being elected, and is officially recognized upon receiving the approval decision from the immediate superior Party Committee.

2. The addition of missing Party committee members is proposed by the Party committee and decided by the immediate superior Party committee; the number of Party committee members after the addition shall not exceed the total number of Party committee members decided by the congress. When absolutely necessary, the immediate superior Party committee may appoint additional Party committee members from the lower level.

3. When absolutely necessary, the higher-level Party committee has the right to transfer some lower-level Party committee members, but not more than one-third of the total number of Party committee members elected by the congress.

4. When a Party committee member requests to withdraw from a Party committee, the Party committee will consider the request and submit it to the next higher-level Party committee for a decision; for Central Committee members, the decision is made by the Central Executive Committee. Incumbent Party committee members at the provincial level and below, upon receiving a decision to retire or transfer to another unit outside their Party committee, will cease to participate in the Party committees at that level.

For Central Committee members who decide to relinquish their positions in Party, State, or mass organization agencies to retire, they will cease to be members of the current Central Executive Committee.

5. From grassroots Party organizations to Party committees directly under the Central Committee, if new organizations are established, divided, merged, or consolidated during the term, the directly superior Party committee shall appoint the official Party committee; direct the development or supplementation of tasks to suit the circumstances; the first term of these Party committees does not necessarily have to be 5 years so that the term of the congress is consistent with the term of the congress of the superior Party organization.

6. For Party organizations that are unable to hold a congress, the immediate superior Party committee shall appoint the Party committee of that organization.

Article 14.

1. Party committees at each level shall establish advisory and support agencies in accordance with the guidelines of the Central Committee.

2. When necessary, the Party committee shall establish subcommittees, councils, and working groups, and dissolve them upon completion of their tasks.

Chapter III

The Party's leading body at the central level.

Article 15.

1. The National Congress of Delegates is convened regularly every five years by the Central Committee; it may be convened earlier or later, but not more than one year earlier.

2. The Congress assesses the results of implementing the resolutions of the previous term; decides on the Party's guidelines and policies for the next term; supplements and amends the Political Platform and the Party Charter when necessary; and elects the Central Committee. The number of full and alternate Central Committee members is decided by the Congress.

The Central Committee considers transferring qualified alternate Central Committee members to replace full Central Committee members when vacancies arise.

3. When the Central Committee deems it necessary, or when more than half of the subordinate Party committees request it, the Central Committee shall convene an extraordinary National Congress of Delegates. Delegates to the extraordinary Congress shall be incumbent Central Committee members and delegates who attended the National Congress at the beginning of the term and who meet the eligibility requirements.

Article 16.

1. The Central Committee organizes and directs the implementation of the Political Platform, the Party Charter, and the resolutions of the Congress; decides on policies and guidelines regarding domestic and foreign affairs, mass work, and Party building; and prepares for the next National Congress of the Party and any extraordinary National Congress (if any).

2. The Central Executive Committee, based on the actual situation, decides to direct the piloting of a number of new policies.

3. The Central Executive Committee holds regular meetings every six months; extraordinary meetings are held when necessary.

Article 17.

1. The Central Committee elects the Politburo; elects the General Secretary from among the Politburo members; establishes the Secretariat comprising the General Secretary, a number of Politburo members assigned by the Politburo, and a number of Secretariat members elected by the Central Committee from among the Central Committee members; elects the Central Inspection Committee; and elects the Chairman of the Central Inspection Committee from among the Central Inspection Committee members.

The number of members of the Politburo, the Secretariat, and the Central Inspection Committee is decided by the Central Committee.

A General Secretary may not hold the position of General Secretary for more than two consecutive terms.

2. The Politburo leads and inspects and supervises the implementation of resolutions of the National Congress of Delegates and resolutions of the Central Committee; decides on issues concerning policies, organization, and personnel; decides on convening and preparing the content of Central Committee meetings; reports on work done before Central Committee meetings or as requested by the Central Committee.

3. The Secretariat leads the daily work of the Party: directing Party building and mass work; inspecting and supervising the implementation of Party resolutions and directives on economics, social affairs, national defense, security, and foreign affairs; directing the coordination of activities among organizations within the political system; deciding on certain organizational and personnel issues and other matters as assigned by the Central Committee; directing or inspecting the preparation of issues to be submitted to the Politburo for discussion and decision.

Chapter IV

Party leadership bodies at local levels

Article 18.

1. The Party Congresses of provinces, centrally-administered cities, districts, towns, and cities under provincial authority are convened regularly every five years by the Party Committee at the same level; they may be convened earlier or later, but not more than one year.

2. The Congress discusses documents from the higher-level Party committee; evaluates the results of implementing resolutions from the previous term; decides on tasks for the next term; elects the Party committee; and elects delegates to attend the higher-level congress.

3. An extraordinary congress of delegates may be convened when the Party Committee deems it necessary, or when more than half of the subordinate Party Committees request it and the immediate superior Party Committee agrees.

Delegates attending the extraordinary party congress are current party committee members, delegates who attended the party congress at the beginning of the term, are currently active in the party committee, and are eligible.

Article 19.

1. Provincial and centrally-administered city Party committees (hereinafter referred to as provincial Party committees, city Party committees), and district, town, and city Party committees (hereinafter referred to as district Party committees, town Party committees, city Party committees) lead the implementation of resolutions of the Party congresses; and resolutions and directives of higher levels.

2. Provincial, city, district, and town Party committee meetings are convened regularly every three months by the standing committee; extraordinary meetings are held when necessary.

Article 20.

1. Provincial, city, district, and town Party committee conferences elect the standing committee; elect the secretary and deputy secretary from among the standing committee members; elect the inspection committee; and elect the chairman of the inspection committee from among the inspection committee members.

2. The number of members of the Standing Committee and the Inspection Committee is decided by the Party Committee in accordance with the guidelines of the Central Executive Committee.

3. The Standing Committee leads, inspects, and supervises the implementation of resolutions of the Party Congress, resolutions and directives of the Party Committee at the same level and higher levels; decides on issues concerning policies, organization, and personnel; decides on convening and preparing the content of Party Committee meetings.

4. The Standing Committee of the Party Committee, comprising the secretary and deputy secretaries, directs and supervises the implementation of resolutions and directives of the Party Committee, the Standing Committee, and higher-level Party Committees; handles the daily affairs of the Party organization; and decides on convening and preparing the content of Standing Committee meetings.

Chapter V

Party grassroots organizations

Article 21.

1. Grassroots Party organizations (basic Party branches, grassroots Party committees) are the foundation of the Party and the political nucleus at the grassroots level.

2. In communes, wards, and towns with three or more full party members, a grassroots party organization shall be established (directly under the district-level Party Committee). In agencies, enterprises, cooperatives, public service units, military units, police units, and other units with three or more full party members, a party organization shall be established (a grassroots party organization or branch directly under the grassroots Party Committee); the immediate superior Party Committee shall consider and decide which superior Party Committee the organization shall be under; if there are not enough three full party members, the immediate superior Party Committee shall recommend party members to participate in a suitable grassroots party organization.

3. Party organizations with fewer than thirty members shall establish a grassroots party branch, with subordinate party groups.

4. Party organizations with thirty or more members shall establish a grassroots party committee, with subordinate party branches under the committee.

5. In the following cases, the lower-level Party committee must report to and obtain the immediate approval of the higher-level Party committee before taking action:

- Establish a grassroots Party committee in a unit with fewer than thirty Party members.

- Establish a Party branch directly under the grassroots Party committee with more than thirty Party members.

- Establish a subordinate party committee directly under the grassroots party committee.

Article 22.

1. The delegate congress or party member congress of a grassroots party organization is convened by the grassroots Party committee once every five years; it may be convened earlier or later, but not more than one year.

2. The Congress discusses documents from higher levels; evaluates the results of implementing resolutions from the previous term; decides on tasks for the next term; elects the Party Committee; and elects delegates to attend the Party Congress at the higher level.

3. When the Party Committee deems it necessary, or when more than half of the subordinate Party organizations request it and the immediate superior Party Committee agrees, it may convene an extraordinary congress of delegates or a congress of Party members.

Delegates attending the extraordinary party congress are incumbent party committee members, delegates who attended the party congress at the beginning of the term, are currently active in the party committee, and are eligible. Attendees of the extraordinary party congress are party members of that party committee.

4. The Party Committee and grassroots Party branches hold regular meetings once a month; extraordinary meetings are held when necessary.

5. Party committees at the grassroots level with nine or more members elect a standing committee; they elect a secretary and deputy secretary from among the standing committee members; those with fewer than nine members only elect a secretary and deputy secretary.

6. The grassroots Party committee holds regular meetings twice a year; extraordinary meetings are held when necessary. The grassroots Party branch holds regular meetings once a month; extraordinary meetings are held when necessary.

Article 23.

The grassroots Party organization has the following responsibilities:

1. Adhere to the Party's guidelines and policies, and the laws of the State; formulate the political direction and tasks of the Party committee and branch, and lead their effective implementation.

2. Building clean and strong Party committees and branches in terms of politics, ideology, and organization; correctly implementing the principle of democratic centralism; improving the quality of Party activities, practicing self-criticism and criticism, maintaining discipline, and strengthening unity within the Party; regularly educating, training, and managing cadres and Party members, enhancing their revolutionary moral qualities, fighting spirit, knowledge, and work capacity; and carrying out Party membership development work.

3. Leaders shall build clean and strong governments, economic, administrative, public service, defense, security, and socio-political organizations; strictly abide by the law and promote the people's right to self-governance.

4. Maintain close contact with the people, care for their material and spiritual well-being, and protect their legitimate interests; lead the people in building and implementing the Party's guidelines and policies and the State's laws.

5. Inspect and supervise the implementation, ensuring that resolutions and directives of the Party and laws of the State are strictly observed; inspect and supervise Party organizations and Party members in complying with the Party Charter.

If authorized by the immediate superior Party committee, the grassroots Party committee may decide on the admission and expulsion of Party members.

Article 24.

1. Party branches directly under the grassroots Party committee are organized according to the workplace or residence of the Party members; each branch must have at least 3 full Party members. Branches with many members may be divided into several Party groups; each Party group elects a group leader, and if necessary, a deputy group leader; the Party group operates under the direction of the branch committee.

2. The Party branch leads the implementation of the unit's political tasks; educates, manages, and assigns work to Party members; conducts mass mobilization and Party member recruitment; inspects and supervises the enforcement of Party discipline; and collects and submits Party membership fees. The Party branch and its committee hold regular meetings once a month.

3. The Party branch congress is convened by the Party branch committee twice every five years; where there is no Party branch committee, it is convened by the Party branch secretary. With the approval of the grassroots Party committee, it may be convened earlier or later, but not more than six months.

4. For Party branches with fewer than nine full members, a branch secretary is elected; if necessary, a deputy secretary is also elected. For Party branches with nine or more full members, a branch committee is elected, along with a branch secretary and deputy secretary from among the committee members.

Chapter VI

Party organizations within the Vietnam People's Army and the Vietnam People's Police.

Article 25.

1. The Party exercises absolute and direct leadership over the Vietnam People's Army and the Vietnam People's Public Security Force in all aspects; the Party's leadership is concentrated and unified in the Central Committee, directly and regularly through the Politburo and the Secretariat; the Party decides on fundamental issues in building a clean and strong People's Army and People's Public Security Force in terms of politics, ideology, and organization, absolutely loyal to the Party and the Fatherland, wholeheartedly and diligently serving the people, and serving as the core force, together with the entire people, to firmly protect the socialist Fatherland of Vietnam, maintain political security and social order, and participate in national construction. The State uniformly manages the Army, the Public Security Force, and the cause of national defense and security in accordance with the Constitution and laws.

2. Party organizations within the Vietnam People's Army and the Vietnam People's Police operate in accordance with the Party's Political Platform, Party Charter, resolutions and directives, and the laws of the State.

3. The Party committees at all levels, according to their functions, assist the Party committees in guiding, inspecting, and supervising Party building work and mass work in the Vietnam People's Army and the Vietnam People's Public Security.

Article 26.

1. The Central Military Commission is appointed by the Politburo and comprises several Central Committee members working in the military and several Central Committee members working outside the military. It is under the leadership of the Central Committee, and regularly the Politburo and the Secretariat. The General Secretary is the Secretary of the Central Military Commission.

2. The Central Military Commission studies and proposes to the Central Committee for decision on issues concerning military and national defense policies and tasks; and provides leadership in all aspects of the Army.

3. The General Political Department is responsible for Party work and political work throughout the entire army, operating under the leadership of the Party Secretariat and the direct and regular supervision of the Central Military Commission. At each level, there is a political agency and political officers responsible for Party work and political work under the leadership of the Party committee at the same level and the direction of the higher-level political agency.

Article 27.

1. Party committees in the main army and border guard forces at each level are elected by the congress at that level and lead the units under their command in all aspects; in special cases, they are appointed by the higher-level party committee.

2. The Military Region Party Committee comprises comrades working within the military region's Party organization, elected by the corresponding congress, and comrades appointed as secretaries of provincial and city Party committees within the military region; it leads the implementation of resolutions from higher levels, the tasks of building a national defense system and building the people's armed forces; and coordinates with local Party committees to implement the Party's guidelines and policies within the military region.

3. Local military party organizations at each level are under the leadership of the local Party committee at that level in all aspects, and at the same time comply with the resolutions of the higher-level military Party committee on the tasks of national defense and local military work. The higher-level political agency coordinates with the local Party committee to direct Party work, political work, and mass work within the local armed forces.

4. The Party Committee of the provincial, city, district, and town military units consists of comrades working within the local military party committee elected by the congress at the same level, the secretary of the local party committee, and a number of comrades outside the local military party committee appointed by the local party committee. The secretary of the local party committee directly serves as the secretary of the military party committee at the same level.

Article 28.

1. The Central Public Security Party Committee, appointed by the Politburo, comprises several Central Committee members working within the People's Public Security force and several Central Committee members working outside the People's Public Security force, as well as some comrades working within the Central Public Security Party Committee. It is under the leadership of the Central Committee, and regularly the Politburo and the Secretariat. The Central Public Security Party Committee studies and proposes to the Central Committee decisions on issues concerning guidelines, policies, ensuring political security and social order; and leads all aspects of work within the public security force.

2. The Party committee of the police force at each level is elected by the congress of that level; in absolutely necessary cases, it may be appointed by the higher-level Party committee. The Party committee leads the units under its level in all aspects.

3. The General Department of Building the People's Public Security Force is responsible for Party work, political work, and mass work in units under the Party committees of the Public Security forces, operating under the leadership of the Central Public Security Party Committee; coordinating with local Party committees to direct Party work, political work, and mass work in local public security forces.

4. The police force building agency at each level is responsible for Party work, political work, and mass work within the Party committee, operating under the leadership of the Party committee at the same level and the direction of the higher-level force building agency.

Article 29.

1. Local People's Public Security Party organizations at each level are under the direct leadership of the Party committee at that level in all aspects, and at the same time comply with the resolutions of the higher-level People's Public Security Party committee on maintaining political security and social order; leading the building of the People's Public Security force in the locality and building a clean and strong Party committee.

2. The Party Committees of the provincial, city, district, and town police departments are elected by the Party congresses at the respective levels.

Chapter VII

Inspection and supervision work of the Party and the Inspection Committees at all levels.

Article 30.

1. Inspection and supervision are leadership functions of the Party. Party organizations must carry out inspection and supervision work. Party organizations and Party members are subject to the inspection and supervision of the Party.

2. Party committees at all levels lead the work of inspection and supervision and organize the implementation of inspection and supervision tasks to ensure that Party organizations and Party members comply with the Political Platform, Party Charter, resolutions, and directives of the Party.

Article 31.

1. Inspection committees at all levels are elected by the Party committee at the same level, and consist of a number of members from the Party committee and a number of members from outside the Party committee.

2. Members of the inspection committee and the chairpersons and vice-chairpersons of lower-level inspection committees must be approved by the immediate superior Party committee. If the chairperson of the inspection committee is transferred to another position, it must be approved by the immediate superior Party committee.

3. The Inspection Committee operates collectively, under the leadership of the Party Committee at the same level and the guidance and supervision of the higher-level Inspection Committee.

Article 32.

The inspection committees at all levels have the following duties:

1. Inspect Party members, including members of the Party committee at the same level, when there are signs of violations of Party member standards, Party committee member standards, and in the performance of Party member duties.

2. Inspect lower-level Party organizations when there are signs of violations in the implementation of the Political Platform, Party Charter, resolutions, directives of the Party, and organizational principles of the Party; inspect the performance of inspection, supervision, and disciplinary tasks within the Party.

3. Supervise Party committee members at the same level, cadres under the management of the Party committee at the same level, and subordinate Party organizations regarding the implementation of the Party's guidelines, policies, and resolutions of the Party committee, as well as ethics and lifestyle as prescribed by the Central Committee.

4. Review and conclude on cases of disciplinary violations, and decide or propose to the Party committee the implementation of disciplinary measures.

5. Resolving complaints against Party organizations and Party members; resolving appeals regarding Party discipline.

6. Inspect the finances of lower-level Party committees and the financial agencies of Party committees at the same level.

Article 33.

The Inspection Committee has the right to request lower-level Party organizations and Party members to report and provide documents on matters related to the inspection.

Chapter VIII

Rewards and disciplinary actions

Article 34.

Party organizations and party members with outstanding achievements will be rewarded according to the regulations of the Central Committee.

Article 35.

1. Party organizations and party members who violate discipline must be dealt with fairly, accurately, and promptly.

2. Forms of disciplinary action:

- For Party organizations: reprimand, warning, dissolution;

- For full party members: reprimand, warning, dismissal from office, expulsion;

- For probationary party members: reprimand, warning.

Article 36.

Authority to discipline party members who violate regulations:

1. The Party branch decides to reprimand or warn Party members within the branch (including Party committee members at all levels, and Party members under the management of higher-level Party committees) who violate political, ideological, moral, lifestyle, Party activities, or Party member duties (except for duties assigned by higher levels).

The grassroots Party committee decides to reprimand or warn Party members within the Party organization, and dismiss lower-level Party committee members.

The grassroots Party committee authorized to decide on admitting new members also has the right to decide on expelling members, but this excludes Party committee members at the same level and Party members who are officials under the management of a higher-level Party committee.

2. Provincial, city, district, and equivalent Party committees decide on disciplinary measures against Party members; they decide on reprimands and warnings for Party committee members at all levels, and Party members under the management of higher-level Party committees who violate political, ideological, moral, lifestyle, Party activities, and Party member duties; they also decide on reprimands and warnings for Party committee members at the same level who violate tasks assigned by the Party committee.

The Standing Committee of the Party Committee decides on the forms of disciplinary action against Party members; it decides on reprimands and warnings for Party committee members at all levels, Party members under the management of higher-level Party committees who violate political, ideological, moral, lifestyle, Party activities, and Party member duties, and cadres under the management of higher-level Party committees who violate their assigned professional duties.

3. The Central Committee decides on disciplinary measures against Party members, including members of the Central Committee, members of the Secretariat, and members of the Politburo.

The Politburo and the Secretariat decide on disciplinary measures for Party members, including Party members who are officials under the management of the Politburo and the Secretariat; reprimands and warnings are issued to Central Committee members who violate political, ideological, moral, lifestyle, Party activities, and Party member duties.

4. Inspection committees at the district, county, and equivalent levels and above decide on disciplinary measures against Party members, but not those who are Party committee members at the same level; they decide on reprimands and warnings for Party members who are officials under the management of the Party committee at the same level and Party committee members at the directly lower levels.

5. Higher-level Party committees and inspection committees have the right to approve, modify, or revoke disciplinary measures decided by lower-level committees.

6. If a Party member holding multiple positions is disciplined with dismissal, depending on the severity and nature of the violation, one or more positions may be removed.

Article 37.

Authority to enforce disciplinary measures against violating Party organizations:

1. The immediate superior Party committee decides on reprimands and warnings for subordinate Party organizations.

2. Disciplinary action to dissolve a Party organization is proposed by the immediate superior Party committee, and decided by the Party committee one level higher. This decision must be reported to the immediate superior Party committee and the Central Disciplinary Inspection Commission.

3. A Party organization shall only be dissolved if it commits one of the following acts: acting against the Party's guidelines and policies; committing particularly serious violations of the principles of Party organization and activities or the laws of the State.

Article 38.

1. If a Party organization or Party member commits a violation that falls outside the disciplinary authority of its level, it shall propose that the matter be referred to a higher-level authority for a decision.

2. In cases where a lower-level Party organization fails to handle or inadequately handles violations by Party organizations and members, the higher-level Party committee or inspection committee shall decide on disciplinary measures within its authority, while also considering the responsibility of that Party organization.

3. Disciplinary actions such as dissolving a party organization and expelling a party member must be proposed by at least two-thirds of the members of the subordinate party organization and decided by the competent party organization.

Article 39.

1. Party members who violate regulations must conduct a self-criticism before the Party branch and propose their own disciplinary action; if they refuse to conduct the self-criticism or are temporarily detained, the Party organization will still proceed with disciplinary action. If necessary, the Party committee and the inspection committee at the competent level will directly consider disciplinary action.

2. Party organizations that violate regulations must conduct self-criticism, propose disciplinary measures, and report to the higher-level Party committee for a decision.

3. Before making a disciplinary decision, the representative of the competent Party organization shall listen to the opinion presented by the Party member who committed the violation or the representative of the violating Party organization.

4. Decisions by subordinates regarding disciplinary actions against Party organizations and Party members who violate regulations must be reported to the immediate superior Party committee and inspection committee; if the violating Party member is involved in multiple Party leadership bodies, the report must be submitted to the superior leadership bodies of which that Party member is a member.

5. Decisions from higher levels regarding disciplinary action against violating Party organizations and members must be communicated to lower levels where the violating Party organizations and members are located; in cases where broader communication is necessary, the competent Party committee shall make the decision.

6. Disciplinary action against Party organizations and members who violate regulations takes effect immediately after the decision is announced.

7. Party organizations and members who disagree with a disciplinary decision have the right to appeal to the higher-level Party committee or inspection committee, up to the Central Committee, within one month from the date of receiving the decision. The handling of disciplinary appeals shall be carried out in accordance with the regulations of the Central Committee.

8. Upon receiving a disciplinary complaint, the Party Committee or Inspection Committee shall notify the complaining Party organization or Party member; within three months at the provincial, city, district, and equivalent levels, and six months at the central level, from the date of receipt of the complaint, they must consider, resolve, and respond to the complaining Party organization and Party member.

9. While awaiting the resolution of the appeal, the disciplined party organization and party member must strictly comply with the disciplinary decision.

Article 40.

1. Party members who receive a sentence of non-custodial rehabilitation or higher must be expelled from the Party.

2. When a disciplined party organization is dissolved, the immediate superior party committee shall establish a new party organization or introduce party activities for the remaining members.

3. Party members who are disciplined and dismissed from their positions are not eligible for election to Party committees or appointment to equivalent or higher positions within one year from the date of the decision.

4. The suspension of party membership for party members, the suspension of party committee membership for committee members, and the suspension of activities of party organizations must be decided by the competent party committee or inspection committee in accordance with the regulations of the Central Committee.

Chapter IX

The Party leads the State, the Fatherland Front, and political and social organizations.

Article 41.

1. The Party leads the State, the Fatherland Front, and political and social organizations through its political platform, strategies, policies, and guidelines; through ideological work, organizational work, personnel work, and through inspection and supervision of implementation.

2. The Party unifies leadership in personnel work and personnel management, while simultaneously promoting the responsibility of organizations and their leaders within the political system regarding personnel matters.

3. The Party nominates qualified cadres to run for or be appointed to state agencies, the Fatherland Front, and political and social organizations.

4. Party organizations and party members working in state agencies, the Fatherland Front, and political and social organizations must strictly abide by the resolutions and directives of the Party; party organizations must lead the concretization of these into state laws and the policies of the organizations; and lead their effective implementation.

Article 42.

1. In the leadership bodies of the State, the Fatherland Front, and political and social organizations at the central and provincial/city levels, which are established through elections, the Party committee at the same level shall form a Party group comprising a number of Party members working within that organization. Where no Party group is formed, the grassroots Party organization within that agency shall perform the leadership function as prescribed by the Central Executive Committee.

2. The Party group is appointed by the Party committee at the same level; it has a secretary, and if necessary, a deputy secretary. The Party group operates collectively and is accountable to the Party committee.

3. The Party Committee leads and persuades its members to implement the Party's guidelines and policies; maintains close contact with the people; proposes to the Party Committee on directions, tasks, organization, personnel, and makes decisions within its authority; and leads the inspection of the implementation of the Party's guidelines and policies.

4. When necessary, the Party group convenes Party members within the organization to discuss the Party committee's policies and devise measures for their implementation.

Article 43.

1. In executive and judicial agencies at the central and provincial/city levels, the Party committee at the same level shall establish a Party committee comprising a number of Party members working in that organization. Where no Party committee is established, the grassroots Party organization within that agency shall perform the leadership function as prescribed by the Central Executive Committee.

2. The Party Committee is appointed by the Party Committee at the same level; it has a secretary, and if necessary, a deputy secretary. The Party Committee operates collectively and is accountable to the Party Committee.

3. The Party Committee leads the thorough understanding and implementation of the Party's guidelines and policies; proposes to the Party Committee on directions, tasks, organization, and personnel, and makes decisions within its authority; and leads the inspection of compliance with the Party's guidelines and policies.

Chapter X

The Party leads the Ho Chi Minh Communist Youth Union.

Article 44.

1. The Ho Chi Minh Communist Youth Union is the Party's reliable reserve force, constantly replenishing the Party with young people, continuing the glorious revolutionary cause of the Party and President Ho Chi Minh; it is the core force in the youth movement; it is a socialist school; it represents the interests of young people; and it is in charge of the Ho Chi Minh Young Pioneers Organization.

2. The Party Committee directly leads the Youth Union at the same level in terms of direction, tasks, ideology, organization, and personnel.

Article 45.

Party members who are still within the age range for joining the Youth Union must participate in and work within the Youth Union organization.

Chapter 11

Party finances

Article 46.

1. The Party's finances consist of membership fees paid by members, funds from the state budget, and other sources of revenue.

2. The Central Executive Committee shall uniformly regulate the principles and procedures for managing the Party's finances and assets, and the rates of Party membership fees for Party members.

3. Annually, the Party committee hears reports and decides on the financial tasks of its level.

Chapter 10

Adherence to the Party Charter

Article 47.

Party organizations and members must strictly abide by the Party Charter.

Article 48.

Only the National Congress of Delegates has the authority to amend the Party Charter.
