(Baonghean.vn) - After the court ruled in favor of the case and the rice field was recovered, not long after, many iron spikes planted by bad guys appeared on that rice field. While the authorities still had not found the culprit, during the cultivation process, the rice field was suspected of being sabotaged once again.

Abnormal rice burning

For many days now, Mr. Ha Ngoc Duong (54 years old, Hanh Lam commune, Thanh Chuong district) has been heartbroken every time he visits his fields and witnesses the scene of rice fields that are about to be harvested being almost completely burned. "A few days ago, the plants had dried up but still had young roots, but now the rice fields are gradually burning, with no young roots left. The care he has taken for the past several months is considered a total loss," said Mr. Duong.

It is worth mentioning that Mr. Duong recently borrowed this field from his neighbor Nguyen Nhu Sy (75 years old) to cultivate the first crop. This is the field that was robbed by bad guys.stick a series of spikesafter a long-standing dispute that Nghe An Newspaper once reported.

After the Thanh Chuong District People's Court declared him the winner of the lawsuit and got his land back, not long after, many sharp iron spikes appeared on the field. Since then, Mr. Sy's family did not dare to cultivate it and had to leave it fallow. Feeling sorry for the fertile field, Mr. Duong asked to cultivate it, but after only the first crop, he encountered problems.

According to Mr. Duong, at the end of April, as usual, he went to visit the field and discovered some areas of rice withered abnormally. The burnt rice fields had many unusual signs such as the area of ​​rice dying unevenly, only happening in Mr. Duong's family. The rice stopped growing, burned yellow in patches, unevenly. Some adjacent grass patches also had leaf burn phenomenon... The estimated area of ​​rice dying in the fire was about 500m2. Mr. Duong's family suspected that bad people used chemicals to destroy the rice, because up to now, his family had no conflicts with anyone.

To clarify this unusual incident, the family filed a report with the local authorities. Agricultural officers and commune police went directly to the field to examine and take samples for testing.

Mr. Dang Huu Hanh - Chairman of the People's Committee of Hanh Lam commune, said that in the rice field area in the commune, only Mr. Duong's rice field was burned to death.

"Last year, the commune directly inspected Mr. Sy's rice field, which was now lent to Mr. Duong for work, and discovered 11 sharp iron spikes stuck in the field. The police also started investigating but have not found the culprit. Currently, the police are also focusing on investigating and clarifying the unusual fire that killed Mr. Duong's rice field," said Mr. Hanh.

Lending fields but not paying back

According to the case file, in 1994, Mr. Nguyen Nhu Sy's family was granted 4 plots of 2-rice fields in Van Dinh field with a total area of ​​nearly 1,700 square meters by the State and was granted a Land Use Rights Certificate in 1997. In 2001, Mr. Sy brought his family to the mountainous area also in Hanh Lam commune to do new economic activities. Therefore, Mr. Sy lent 2 sao of land to the family of his two neighbors, Mr. Le Dinh Khang and Mrs. Mai Thi Luong, 1 sao of rice fields for production. For each sao of land borrowed, these people paid Mr. Sy 30,000 VND, the loan term was 10 years. The loan agreement was only verbal, without any supporting documents. After that, even though the 10-year term had expired, Mr. Sy's family still did not claim the land back because they did not need it yet.

In the period 2012-2014, implementing the State's policy on land conversion, Mr. Sy's 4 rice fields were converted into 1 plot in another location, also with an area of ​​nearly 1,700m2.2and was granted a Land Use Right Certificate by the People's Committee of Thanh Chuong district in 2017, with a term of 50 years, the purpose of using the land for rice cultivation. Later, because he wanted to use the land for rice cultivation, Mr. Sy went directly to meet the family of Mr. Le Dinh Khang and Ms. Mai Thi Luong to request the return of the land.

After the district granted me a new land use right certificate, my family had many people and I was raising a disabled sister, so I really needed land for farming. I met the two people I lent the land to ask for it back, but they refused to return it.

Mr. Sy then had to file a petition with the local authorities. The People's Committee of Hanh Lam commune organized mediation many times but to no avail. After many years of unsuccessful land claims, Mr. Sy was forced to file a lawsuit with the People's Court of Thanh Chuong district.

Meanwhile, presenting at the Thanh Chuong District People's Court, Mr. Le Dinh Khang said that in 2001, he and his wife bought 2 sao of rice fields from Mr. Sy for 600,000 VND. "Mr. Sy said he sold the rice fields to do new economic activities. The transaction was only between me and Mr. Sy, no one witnessed it," Mr. Khang said, adding that when he carried out the land exchange, he asked the local government to issue a red book in his and his wife's names but it was not accepted.

Similar to Mr. Khang, Ms. Mai Thi Luong said that her husband bought the land from Mr. Sy for 6.5 million VND. However, there were no documents to prove the purchase.

Meanwhile, according to the verdict of the Thanh Chuong District People's Court, the verification process and the opinions of the plaintiffs and defendants at the trial showed that Mr. Sy and his wife have never completed the procedures to transfer or give away this land plot to anyone. In addition, the defendants did not provide any evidence that they had purchased the land, and the defendants themselves admitted that the sale was only verbal, without any documents or evidence. Therefore, the court ordered the two families of Mr. Khang and Ms. Luong to return the land plot of nearly 1,700m2.2for Mr. Sy's family.

The verdict of the Thanh Chuong District People's Court took effect from July 6, 2022. However, the two families who borrowed the land refused to return it, forcing Mr. Sy to repeatedly write complaints asking the local authorities to resolve the matter.

On December 30, 2022, the Civil Judgment Enforcement Office of Thanh Chuong District, together with representatives of departments and the People's Committee of Hanh Lam Commune, formed a team to enforce the return of land use rights to Mr. Sy. However, Mr. Khang's family representative was present at the enforcement session but did not sign the minutes. Meanwhile, Ms. Luong's family agreed to return more than 522m2 to Mr. Sy's family.2land.

According to Mr. Sy, after the enforcement officer came to read the order to force the return of the land, his family went down to work the land and discovered dozens of iron spikes under the field. After that, Mr. Sy submitted a petition to the authorities to clarify who planted the iron spikes in the field, preventing his family from growing rice. "The land here is a fertile land, my family wanted to produce but had to leave it fallow for the past two seasons because we have not found the person who sabotaged it," Mr. Sy said indignantly./.
