Nghe An National Assembly Delegation discusses two draft laws at the 9th Extraordinary Session

On the morning of February 12, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly and the draft Law on Promulgation of Legal Documents (amended).

The National Assembly delegation of Nghe An province discussed in Group 3 with the National Assembly delegations of Bac Giang and Dak Nong provinces.

Attending the discussion session were comrade Nguyen Hoa Binh - Politburo member, Permanent Deputy Prime Minister, National Assembly Delegate of Bac Giang.

At the discussion session, the National Assembly deputies of Nghe An delegation gave 4 opinions on 2 draft laws, focusing mainly on the draft Law on Promulgation of Legal Documents (amended); the law has important significance, playing the role of foundation, creating a legal corridor for the construction and organization of the implementation of the system of legal documents.

Based on the analysis of the necessity of connecting the stages of policy analysis and discussion at the National Assembly, Mr. Hoang Minh Hieu - Standing Member of the National Assembly's Law Committee, delegate of Nghe An delegation, proposed that the draft law add a provision that in the documents submitted to the National Assembly, it is necessary to add a policy impact assessment report so that National Assembly deputies have a basis for research.

Overall, through comparing the content between the current Law on Promulgation of Legal Documents and the draft amended law, delegate Hoang Minh Hieu also suggested that the drafting committee consider adding the role of National Assembly Delegations to give opinions on the draft before submitting it to the National Assembly.

The law should also promulgate some basic principles on the procedures for issuing Government documents; at the same time, it is recommended to retain the principle of ensuring transparency and responsibility for receiving and responding to opinions and recommendations in the drafting of legal documents in this law amendment as in the current law.

Also related to the draft Law on Promulgation of Legal Documents (amended), Mr. Tran Nhat Minh - full-time National Assembly member of Nghe An delegation expressed his opinions on some contents regarding the scope of regulation and requested clarification of some contents in the draft.

Especially regarding the provisions on cases allowing the issuance of legal documents under the simplified procedure, he said that it is necessary to clarify "urgent cases to resolve arising in practice" as in the draft to avoid discretion; at the same time, research and supplement specific regulations on the time for collecting opinions via the electronic information portal.

Regarding the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly, delegate Tran Nhat Minh also raised a number of specific opinions and proposals regarding the regulations on the division of authority between the National Assembly and the Government and agencies in the State apparatus.

Ms. Nguyen Van Chi - Vice Chairwoman of the National Assembly's Finance and Budget Committee highly appreciated the draft Law on Promulgation of Legal Documents (amended) for including provisions on policy consultation. However, based on the analysis of the provisions in the draft law on this content, the delegate from Nghe An suggested that it should be more clearly expressed and have provisions on policy consultation with affected subjects and experts and specialists in that field.

Similarly, regarding the policy impact assessment regulations, according to Ms. Nguyen Van Chi, it is also necessary to emphasize more on impact assessment with related subjects including beneficiaries and affected subjects.

Also related to the content of policy consultation, delegate Nguyen Van Chi also expressed her opinion that the regulation that the National Assembly agency presides over the consultation conference at the policy development stage and sends it to the drafting agency as in the draft law is unreasonable. Because the National Assembly agencies also participate in the policy review at the review stage. Therefore, according to her, it is necessary to stipulate that the drafting agency presides over the policy consultation conference at the policy development stage.

Delegate Hoang Thi Thu Hien - Permanent Vice President of Nghe An Women's Union assessed that the Law on Promulgation of Legal Documents (amended) does not have provisions on the principle of gender mainstreaming in the development and promulgation of legal documents like the current law, while this is a matter of principle. Thereby, the delegate of Nghe An delegation proposed to add the above principle to the draft law.

In addition, Ms. Hoang Thi Thu Hien also proposed to supplement the supervision regulations of the Vietnam Fatherland Front and socio-political organizations on the implementation of legal documents by State agencies such as the Party's policies and the provisions of the Constitution; at the same time, thereby contributing to ensuring timely detection of shortcomings in law enforcement and providing suggestions for corrections from issues arising in practice; more importantly, ensuring the people's rights to participate in building the Party and the political system.
