The National Assembly Delegation of Nghe An province sought comments on the draft Law on State of Emergency.
On the afternoon of September 15, the National Assembly Delegation of Nghe An province held a conference to contribute opinions on the draft Law on State of Emergency, which will be submitted to the National Assembly for consideration and decision in the coming time.

Comrade Thai Thi An Chung - Member of the Provincial Party Executive Committee, Deputy Head of the Provincial National Assembly Delegation chaired the conference.

The Draft Law on State of Emergency, consisting of 6 chapters and 35 articles, stipulates the principles, order, procedures, and authority to declare, announce, and abolish a state of emergency; response and remedial measures applied in a state of emergency; organization of implementation of resolutions declaring and orders declaring a state of emergency; and responsibilities of agencies, organizations, and individuals in a state of emergency.

Participating in giving opinions on the draft law, delegates basically agreed on the structure and content of the draft Law on State of Emergency; at the same time, participated in giving opinions and adding some specific contents.
The issue that many delegates commented on was related to the authority, order, procedures for declaring, announcing, and abolishing the state of emergency; the responsibility of all levels, sectors, agencies, and units in implementing response and remedial measures applied in the state of emergency, especially for grassroots authorities, creating initiative in resolving emergency situations when there is no direction from superiors.

At the same time, it is necessary to more clearly define the coordination mechanism and responsibilities of agencies, organizations, and individuals responsible for applying measures in a state of emergency, avoiding overlap in authority and functions, causing difficulties in the implementation process; the obligations of citizens, organizations, and enterprises in participating and contributing to the implementation of emergency response measures, such as relocating residences, confiscating and requisitioning assets and vehicles, etc.

Some opinions also suggested additional research to consider criminal, administrative, and civil responsibilities of responsible persons in cases where decisions to apply emergency measures cause damage to the life and health of others due to subjective errors, negligence, and failure to carefully and accurately consider and assess the actual situation.
On the other hand, it is necessary to study and clarify further regulations on assignment and decentralization of agencies presiding over exercises according to the scale and frequency of organizing exercises in the locality.

The National Assembly also needs to consider and supplement more fully and clearly the provisions on the principles of international cooperation on the state of emergency; the supervisory rights of the National Assembly Standing Committee and the National Assembly in cases where the National Assembly Standing Committee does not hold a meeting and the President directly declares a state of emergency...
In addition, comments also suggested amendments and supplements related to wording, ensuring the tightness and clarity of the draft law's writing style; at the same time avoiding overlap or duplication of content between relevant current laws.

Based on the opinions of the delegates, on behalf of the National Assembly delegation of Nghe An province, comrade Thai Thi An Chung - Member of the Provincial Party Executive Committee, Deputy Head of the Provincial National Assembly Delegation received and affirmed: The Provincial National Assembly Delegation will fully synthesize the comments to report to the National Assembly Standing Committee; at the same time, use them as documents to participate in discussions and contribute to the law-making process at the next National Assembly session.
