On May 23, implementing the Program of the 9th Session of the 14th National Assembly, the National Assembly discussed many important contents related to the Resolution on piloting the urban government model in Da Nang city and the draft Law amending and supplementing a number of articles of the Law on Construction.

Piloting the urban government model in Da Nang city
In the morning, the National Assembly listened to the presentation of the Report on the examination of the draft Law on Residence (amended) and the Draft Resolution on piloting the organization of an urban government model in Da Nang city and a number of other specific mechanisms and policies.
In particular, the National Assembly spent a lot of time discussing and contributing opinions on contents related to the pilot and organization of urban government models and some specific mechanisms and policies in the development of Da Nang city.
Deputy Head of the National Assembly Delegation of Nghe An, Tran Van Mao, also made many comments on the content of this Draft. Specifically, the National Assembly's consideration and approval of this Resolution is extremely necessary, stemming from the practical needs of Da Nang city, ensuring the political and legal basis, in accordance with Resolution No. 18-NQ/TW dated October 25, 2017 of the 6th Central Conference (term XII), Resolution No. 43-NQ/TW dated January 24, 2019 of the Politburo, the 2013 Constitution, the Law on Organization of Local Government and the Law on Promulgation of Legal Documents.

According to the Draft, the pilot model proposed by the Government in Da Nang is different from the model in Hanoi when it does not organize People's Councils in districts. The representative of the National Assembly Delegation of Nghe An province said that this mechanism is completely suitable because Da Nang has previously piloted a similar model and achieved positive results.
However, organizing only one level of government in urban areas will partly affect the guarantee of people's representation rights, mastery rights and the supervision activities of the People's Council over the People's Committees of districts, wards and district judicial agencies, so there needs to be mechanisms to supervise the implementation of people's representation rights and mastery rights.
In addition, the Law on Planning needs to strictly regulate the authority, order and procedures for planning adjustment in order to overcome limitations and shortcomings in planning and management, avoiding arbitrary planning adjustments or changes in planning based on term thinking.
To create conditions for Da Nang city to develop and create motivation to promote localities in the Central Highlands region, the Government needs to continue researching and considering the development of appropriate mechanisms, policies, regulation rates, fee sources... when implementing.

Comments on the draft Law amending and supplementing a number of articles of the Construction Law
During the afternoon session, the National Assembly discussed a number of contents of the draft Law amending and supplementing a number of articles of the Construction Law.
Representing the National Assembly Delegation of Nghe An province, comrade Nguyen Thanh Hien - Member of the Party Committee, Deputy Head of the National Assembly Delegation of the province contributed many ideas to build this Law project such as cases that do not require a construction permit.
Because in reality, there are many localities with many complex projects that affect the environment and community safety, requiring strict management of legal procedures on construction investment.

Regarding construction order management, construction order management work nationwide in recent times still has many shortcomings. Many investors violate construction order but authorities at all levels have difficulty enforcing the decision to handle the situation due to lack of sanctions and investors not complying.
The new draft amended law only focuses on regulating the responsibility of State management under the authority of the provincial People's Committee without mentioning the role of grassroots authorities such as districts and communes, leading to untimely and ineffective handling of violations.
In addition, some contents related to the capacity conditions of organizations participating in construction activities need to be studied and revised so that the granting of construction certificates can be put into practice to improve the effectiveness of this activity.
