Colonel Dao Vinh Thang, Head of the Road and Rail Traffic Police Department of Hanoi City Police, said that the regulation to fine people wearing substandard helmets is correct in order to reduce traffic accidents.

However, Mr. Thang also admitted that if this penalty regulation is applied, the traffic police force will face difficulties, because to date they still only rely on written guidelines to visually identify helmets, making it difficult to easily determine whether a helmet is of good quality or not, while they lack the equipment and machinery to determine whether a helmet is genuine or fake.

"According to regulations, there are only fines, but no guidelines on temporarily confiscating substandard helmets. If the helmets are confiscated, will the drivers still be allowed to operate their vehicles? And if the helmets are not confiscated, people may very well wear their old helmets again, thus continuing to violate the regulations," Mr. Thang wondered.

Colonel Dao Vinh Thang also affirmed that if people and vehicles strictly comply with traffic laws, the police are not allowed to stop vehicles to inspect and penalize those wearing "fake" helmets.

"We shouldn't immediately impose fines on people wearing substandard helmets. For now, we should only remind and educate people so they understand and consciously recognize that wearing helmets that meet standards and regulations is civilized and protects their lives when participating in traffic...", Mr. Thang said.

Concurring with this view, Colonel Dinh Van Ninh, Head of the Traffic Police Department of Ninh Binh Provincial Police, stated that traffic police officers are currently unable to distinguish between genuine and fake helmets.

"The quality of helmets should be handled by other forces for detection and management, as traffic police cannot distinguish between fake and genuine helmets," said Colonel Dinh Van Ninh.

Penalties imposed on manufacturing and business establishments.

According to traffic police, state management agencies must be determined to stop the production and sale of counterfeit helmets at the root, imposing heavy penalties on those involved in their production and sale, in order to hope to put an end to the problem of substandard helmets.

Colonel Dao Vinh Thang stated that the most important solution to prevent the sale of counterfeit helmets is to thoroughly and severely punish establishments that produce and sell counterfeit or substandard helmets, preventing businesses from circumventing the law to produce them. To achieve this, market management forces and economic police must also get involved.

According to helmet retailers, recent media reports about penalties for substandard helmets have reduced the number of people buying "fake" helmets. However, many stores, despite importing batches of quality-certified helmets, see most customers simply browsing and not intending to buy new ones, as they believe that standard helmets are heavy and expensive.
