Is unilateral termination of an employment contract a violation of the law?
(Baonghean.vn) - According to Ms. Pham Thi O: on June 20, 2012, she signed an indefinite-term employment contract at Company X, as an Accountant with a salary of 6 million VND/month. On May 25, 2016, the company lost a printer. The company's management board claimed that Ms. O stole the printer because on the afternoon of May 25, she was the only one who left the office last because she had to do accounting work. On May 26, 2016, the company director issued a decision to dismiss Ms. O for stealing property according to Article 126 of the Labor Code. Upon receiving the decision, Ms. O disagreed, saying that the company had not considered the issue thoroughly and had rushed to the wrong conclusion about her.
In your opinion, is it right or wrong for the company to fire Ms. O? What should Ms. O do to protect her rights?
