Which unit is responsible for implementing compensation under the new Land Law?
The 2024 Land Law stipulates how agencies, units and organizations are responsible for performing the tasks of compensation, support, resettlement; managing, exploiting and using recovered land funds? The issue of concern of Mr. Le Quang Dao (Nam Dan, Nghe An).
Reply: According to Article 86 of the 2024 Land Law, the agencies, units and organizations responsible for performing the tasks of compensation, support, resettlement; management, exploitation and use of recovered land funds are as follows:
1. The People's Committee at district level is responsible for directing and organizing the implementation of compensation, support and resettlement tasks according to the provisions of this Law.
2. Units and organizations performing compensation, support and resettlement tasks include one or more of the following units and organizations:
a) Land fund development organization;
b) Other units and organizations with the function of performing compensation, support and resettlement tasks;
c) Compensation, support and resettlement council. The compensation, support and resettlement council is established by the Chairman of the district-level People's Committee for each project, including: Chairman or Vice Chairman of the district-level People's Committee as Chairman; representatives of financial agencies, agencies with land management functions, and the People's Committee of the commune where the land is recovered; representatives of land users whose land is recovered; and a number of other members decided by the Chairman of the district-level People's Committee to suit local conditions. Representatives of the People's Council, the Vietnam Fatherland Front Committee at the district level, and representatives of other socio-political organizations are invited to attend meetings of the compensation, support and resettlement council for supervision.
3. Units and organizations performing the tasks of compensation, support and resettlement shall coordinate with the People's Committees at the district level to carry out compensation, support and resettlement work according to their assigned responsibilities and tasks.
4. The Chairman of the Provincial People's Committee directs and monitors the organization of compensation, support and resettlement work of the District People's Committee; promptly resolves difficulties that are not under the authority of the district.
5. Land recovered under the provisions of Articles 78 and 79 of this Law that has not been allocated or leased for use in urban areas shall be allocated to land fund development organizations for management, exploitation and use; in rural areas, it shall be allocated to the People's Committees at the commune level for management.
