Using children's photos for newspaper illustrations must have the children's consent.
If the press wants to publish photos of children as characters or illustrations in negative programs, it must have the consent of the parents, guardians of the child (under 7 years old) and the child himself (if the child is over 7 years old).
According to Circular No. 09/2017/TT-BTTTT of the Ministry of Information and Communications (effective from October 1), when posting or broadcasting news or articles related to children, press agencies must comply with regulations on content ratio, timing, duration for children and warnings about content that is not suitable for children.
Specifically, for print, radio, television and electronic newspapers: when reporting on negative incidents or violations of the law in which children are victims or involved, the children's faces must be blurred or covered and the information about the children's private lives and personal secrets must be kept confidential in accordance with Article 33 of Decree No. 56/2017/ND-CP of the Government detailing a number of articles of the Law on Children.
When using children or images of children as characters or illustrations in programs reflecting negative incidents or violations of the law: For children under 7 years old, the consent of their parents or guardians is required.
For children aged 7 years and over, consent from the child and their parents or guardians is required.
For publications: when using images of children to illustrate in publications, the consent of the parents or guardians (for children under 7 years old) must also be obtained, and the consent of the child himself or herself and the parents or guardians must be obtained.
In addition, according to Circular 09, press agencies and publishers must warn about content that is not suitable for children on radio and television programs, printed newspapers, electronic newspapers and publications.
